WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides
that in the preparation of its annual budget, a municipality shall limit any
increase in said budget to 2.5% unless authorized by ordinance to increase it
to 3.5% over the previous year’s final appropriations, subject to certain
exceptions; and,
WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when
authorized by ordinance, appropriate the difference between the amount of its
actual final appropriation and the 3.5% percentage rate as an exception to its
final appropriations in either of the next two succeeding years; and,
WHEREAS, the Township Committee of the Township of Middle in the County of Cape May
finds it advisable and necessary to increase its CY 2008 budget by up to 3.5%
over the previous year’s final appropriations, in the interest of promoting the
health, safety and welfare of the citizens; and,
WHEREAS, the Township Committee hereby
determines that a 1.0% increase in the
budget for said year, amounting to $158,724.99 in excess of the increase in
final appropriations otherwise permitted by the Local Government Cap Law, is
advisable and necessary; and,
WHEREAS the Township Committee hereby determines that any
amount authorized hereinabove that is not appropriated as part of the final
budget shall be retained as an exception to final appropriation in either of
the next two succeeding years.
NOW
THEREFORE BE IT ORDAINED, by the Township Committee of the Township of Middle, in the County of Cape May,
a majority of the full authorized membership of this governing body
affirmatively concurring, that, in the CY 2008 budget year, the final
appropriations of the Township of Middle
shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be
increased by 3.5%, amounting to
$555,537.47, and that the CY 2008 municipal budget for the Township of Middle be approved and adopted in
accordance with this ordinance; and,
BE
IT FURTHER ORDAINED, that any that any amount
authorized hereinabove that is not appropriated as part of the final budget
shall be retained as an exception to final appropriation in either of the next
two succeeding years; and,
BE IT ORDAINED by the Township Committee
of the Township of Middle in the County of Cape May and the State of New Jersey
as follows:
SECTION 1. The public right, title and interest in,
along, upon and over the following described land is hereby vacated,
surrendered and extinguished:
TRACT I - WILEY STREET BETWEEN BLOCKS 937 AND 940
All that
certain tract or parcel of land, situate in the Township of Middle, County of

BEGINNING at the Northwest Corner of the lot
identified as Block 940, Lot 2 which is also the Northeast Corner of the lot

SECTION 2. The Township of Middle, for itself, its successors and assigns,
reserves unto itself the right to construct, install, build, operate, maintain,
use, repair, replace and relocate such public utilities and cable television
facilities, within the described premises, which it may, at any time hereafter,
deem necessary for the public health, safety, convenience and welfare, and the
Township of Middle further reserves unto itself the right to use, maintain,
repair, replace and relocate all existing utilities and cable television
facilities owned or controlled by it located in, adjacent to, upon or through
said land, and further reserves unto itself an easement over, under, through
and across the portion of the land described as may be necessary or expedient
for the purpose of maintaining, replacing, relocating, installing, leveling,
constructing and repairing its utilities, mains and appurtenances, if any,
wherever there exists a pipeline and appurtenances thereto beneath the surface
of the aforesaid described land. The

WHEREAS, the
Diocese of Camden New Jersey, 631 Market Street, 2nd Floor, Camden
NJ 08102, owns the property known as
Block 1414.01 Lot 14 Township of Middle, Cape May County, New Jersey and plans
to sell a portion of that Lot (the “Property”) to a nonprofit, single-asset
corporation to be created for the purpose of constructing on the Property a low
income senior citizen housing complexes, which will meet in part the Township’s
obligation to provide low and moderate income housing in the Township; and
WHEREAS, The Diocesan Housing Services Corporation of
the Diocese of Camden, Incorporated (the
“Sponsor”) is applying for a federal grant through the Office of the United
States Department of Housing and Urban Development for the purpose of funding
the real property acquisition and construction of the low income senior citizen
housing development thereon; and
WHEREAS, the Sponsor will form a nonprofit single
asset corporation (the “Owner”) under laws of the State of New Jersey for the
purpose of proceeding with the construction of the senior citizen housing
development thereon; and
WHEREAS, the
proposed development will be subject to the rules and regulations of the United
States Department of Housing and Urban Development; and
WHEREAS, the
Long Term Tax Exemption Law of New Jersey, N.J.S.A. 40A:20-1, et seq. permits a
municipality to enter into a financial agreement exempting real property from
tax assessment and accepting payments in lieu of taxes where the property is a
qualified subsidized housing project for low and moderate income rental housing
for senior citizens under the aforesaid statute; and
WHEREAS, it
is necessary for the Sponsor to file with the United States Department of
Housing and Urban Development in support and as such part of its obligations to
obtain the aforementioned funding for the acquisition and construction of the
senior citizen development a copy of the financial agreement between the
aforementioned nonprofit corporation and the municipality providing for payment
in lieu of real property taxes;
NOW,
THEREFORE, BE IT ORDAINED by the Township Committee of the

The Township Committee of
the Township of Middle finds that the proposed development will meet an
existing housing need pursuant to the provisions of Section 202 of the Federal
Housing Act of 1959 and that the development will be an improvement made for
the purpose of providing low income rental housing to the senior citizens of
the Township and will serve to meet in part the Township’s obligation to
provide low and moderate income housing under its fair share obligations with
the New Jersey Council on Affordable Housing.
2.
The Township Committee
makes such determination and findings by virtue of and pursuant to and in
conformity with the Long Term Tax Exemption Law of the State of

The land and the proposed
development and improvements, after acquisition by the Owner and construction
of the low and moderate income housing project thereon, shall be exempt from
real property taxation as provided in N.J.S.A. 40A:20-1, et seq.
4.
The clerk of the Township
shall deliver a certified copy of this Ordinance approving the tax exemption
and financial agreement to the Tax Assessor.
5.
Upon adoption of the
financial agreement, a certified copy of this Ordinance and the financial
agreement shall be transmitted to the Director of the Division of Local
Government Services.
6.
In lieu of real property
taxes, the Owner shall make payment to the Township of Middle of an annual
service charge for municipal services supplied to the housing development in an
amount equal to fifteen (15) percent of the annual gross rents derived from
such housing development, provided that gross rents shall be defined to mean
that portion of the rent payable by the tenants, exclusive of any government
subsidies to the Owner, said payments to commence upon the initial occupancy of
the development. The Township shall

real property taxation hereby granted shall continue for the earlier to occur
of (a) the passage of forty (40) years from the completion of the development
or (b) a determination by the Owner and the Township that the development is no
longer useful.

The

b. The Owner shall submit annually, within ninety (90) days after the
close of its fiscal year, its auditor’s reports to the Mayor and Township
Committee of the Township and to the Director of the Division of Local
Government Services in the NJ Department of Community Affairs.
c. The Owner shall, upon request of the Township, permit inspection of the
property, equipment, buildings and other facilities of the entity, and also
permit examination and audit of its books, contracts, records, documents, and
papers by authorized representatives of the Township of Middle of the State of
New Jersey.
d. Proof shall be provided to the Township of adherence to the provisions
of any federal regulatory agreement or other federal regulations serving to
regulate the operation of the development.
9.
The United States
Department of Housing and Urban Development may rely upon this Ordinance for
the approval of the Section 202 application by the Sponsors and funding of the
development.
10.
The appropriate Township
officials are hereby authorized and directed to execute a Tax Abatement
Agreement reflecting the aforesaid annual service charge in lieu of taxes.

One copy of this Ordinance
shall be placed on file with the Township Clerk and with the Tax Assessor of

Township of Middle and a newspaper in general circulation in the County of Cape
May.

is hereby appropriated the sum of $1,074,255, which amount represents: (i) a
grant received by the Township of Middle ("Township") from the County
of Cape May, New Jersey, in the amount of $474,255; (ii) a Small Cities Block
Grant from the State of New Jersey in the amount of $400,000; and (iii) a
donation received from the Wal-Mart Corporation in the amount of $200,000, for
the extension of sanitary sewer lines along Satt Boulevard in the Township,
together with the acquisition of all materials and equipment and completion of
all work necessary therefore or related thereto, all as further described in
the information on file and available for inspection in the offices of the
Township Clerk

WHEREAS, it
was deemed necessary and desirable to solicit for bids for the Diamond Road,
Railroad Avenue, Satt Boulevard Sanitary Sewer Extension and Satt Boulevard
Road Construction Contract #21; and

Township received bids on February 20, 2008 at 10:00 AM for said project, and

NJSA 40A:11-24 delegates the time table for making awards and returning
deposits, and

statute states that the contracting unit shall award or reject the contract in
no case more than 60 days after receipt, except that the bidders who consent
thereto at the request of the contracting unit, be held for consideration for
such longer period as agreed, and

Township will request written consent from the three lowest bidders to retain
all bid documents for an additional 60 days or until an award is made.

Acknowledgement of completion of
various street opening permits for Mitchell Nichols Enterprises. M. Nichols has

Township of Middle entered into an agreement with the County of Cape May for
usage of the Records Recovery Center located at 536 Ocean View Woodbine Road,
Ocean View, on August 20, 2007, otherwise known as Resolution No 349-07, and

WHEREAS,
N.J.S. 40A:4-8 provides that the budget be read by title only at the time of
the public hearing if a resolution is passed by not less than a majority of the
full governing body, providing that at least one week prior to the date of
hearing a complete copy of the approved budget as advertised has been posted in
the Township Municipal Building and copies have been made available by the
Township clerk to persons requiring them; and
WHEREAS,
these two conditions have been met;
NOW,
THEREFORE, BE IT RESOLVED that the budget shall be read by title only.
WHEREAS,
N.J.S.A. 40A:4-78b has authorized the Local Finance Board to adopt rules that
permit municipalities in sound fiscal condition to assume the responsibility,
normally granted to the Director of the Division of Local Government Services,
of conducting the annual budget examination; and
WHEREAS,
N.J.A.C. 5:30-7 was adopted by the Local Finance Board on February 11, 1997;
and
WHEREAS,
pursuant to N.J.A.C. 5:30-7.2 through 7.5, the Township of Middle has been declared
eligible to participate in the program by the Division of Local government
Services, and the Chief Financial officer has determined that the local
government meets the necessary conditions to participate in the program for the
2008 budget year.
NOW
THEREFORE BE IT RESOLVED by the governing body of the Township of Middle that in accordance with N.J.A.C.
5:30-7.6a & 7.6b and based upon the Chief Financial Officer's
certification, the governing body has found the budget has met the following
requirements:
1. That with
reference to the following items, the amounts have been calculated pursuant to
law and appropriated as such in the budget:
a. Payment of interest and debt redemption charges
b. Deferred charges and statutory expenditures
c. Cash deficit of preceding year
d. Reserve for uncollected taxes
e. Other reserves and non-disbursement items
f. Any inclusions of amounts required for school purposes.
2. That the
provisions relating to limitation on increases of appropriations pursuant to
N.J.S.A. 40A:4-45.2 and appropriations for exceptions to limits on
appropriations found at N.J.S.A. 40A:4-45.3 et seq., are fully met (complies
with CAP law).
3. That the
budget is in such form, arrangement, and content as required by the Local
Budget Law and N.J.A.C. 5:30-4 and 5:30-5.
4. That
pursuant to the Local Budget Law:
a. All estimates of revenue are reasonable, accurate and correctly
stated,
b. Items of appropriation are properly set forth
c. In itemization, form,
arrangement and content, the budget will permit the exercise of the comptroller
function within the municipality.
5. The
budget and associated amendments have been introduced and publicly advertised
in accordance with the relevant provisions of the Local Budget Law, except that
failure to meet the deadlines of N.J.S.A. 40A:4-5 shall not prevent such
certification.
6. That all
other applicable statutory requirements have been fulfilled.
BE IT
FURTHER RESOLVED that a copy of this resolution will be forwarded to the
Director of the Division of Local Government Services upon adoption.
BE IT RESOLVED, by
the Township Committee, the Governing Body of the Township of Middle, County of
Cape May and State of New Jersey that it is hereby declared that the Local
Budget of the Township of Middle for the year 2008 was introduced and approved
at a regular meeting of the Township Committee held on March 3, 2008 and was
thereafter advertised in the Herald-Times in its issue on March 12, 2008 which
advertisement contained a notice of the date, time and place of the public
hearing, and that at least one week prior to public hearing a complete copy of
the approved budget as advertised was posted in the Middle Township Hall and
made available to each person requesting the same during said week, and that
sufficient copies of same are available for each person requesting the same at
the scheduled public hearing.
BE IT FURTHER
RESOLVED, that the Local Budget of the Township for the year 2008 was hereby
read by title only, and had public hearing on April 7, 2008.

that the Summary of Appropriations be made part of this resolution for the
adoption of the budget for the year 2008, and

advertisement contained a notice of the date, time and place of the public
hearing, and that at least one week prior to public hearing a complete copy of
the approved budget as advertised was posted in the Middle Township Hall and
made available to each person requesting the same during said week, and that
sufficient copies of same are available for each person requesting the same at
the scheduled public hearing.
BE IT FURTHER
RESOLVED, that the Local Budget of the Township for the year 2008 was hereby
read by title only, and had public hearing on April 7, 2008.
FURTHER RESOLVED,
that the Summary of Appropriations be made part of this resolution for the
adoption of the budget for the year 2008, and
FURTHER RESOLVED,
that the Local Budget of the
WHEREAS,
there is a need to purchase a vehicle for the Sewer Department, and
WHEREAS, through the State
Contract Purchasing System, Contract # A70850 (T2007), this truck is available;
and
WHEREAS,
the amount of the purchase is $19,390.30 and funds are available as evidenced
by the Chief Financial Officer's Certification; and
WHEREAS, the vehicle being
purchased by authorization of this Contract is one (1) 2008 Chevrolet
Trailblazer 4WD.
NOW THEREFORE
