I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

 

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Committeemember DeLanzo, Committeemember Barry, Township Clerk James Alexis, Deputy Clerk Kimberly Tomkinson, Attorney Pickering, and Engineer Orlando.  Mayor Doughty was absent.

           

 

1.                ORDINANCE NO. 1290-08 – TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14) CALENDAR YEAR 2008 – On motion by Committeemember Barry seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1290-08 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/07/2008 at 6:00 p.m.

 

2.                ORDINANCE NO. 1291-08 – AN ORDINANCE VACATING A PORTION OF VICK STREET AND A PORTION OF WILEY STREET – On motion by Committeemember Barry seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1291-08 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/07/2008 at 6:00 p.m.

 

3.                ORDINANCE NO. 1292-08 – ESTABLISHING THE COMPENSATION OF THE OFFICERS AND EMPLOYEES OF THE TOWNSHIP OF MIDDLE – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, Ordinance No 1292-08 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/07/2008 at 6:00 p.m.

 

4.                ORDINANCE NO. 1293-08 - AN ORDINANCE OF THE TOWNSHIP OF MIDDLE AUTHORIZING REAL PROPERTY TAX EXEMPTION AND PAYMENTS  IN LIEU OF TAXES FOR PROPERTY KNOWN AS BLOCK 1414.01 LOT 14 PURSUANT TO THE LONG TERM TAX EXEMPTION LAW, N.J.S.A. 40A:20-1, ET SEQ. – On motion by Committeemember Barry seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1293-08 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/07/2008 at 6:00 p.m.

 

5.                ORDINANCE NO. 1294-08 - AN ORDINANCE OF THE TOWNSHIP OF MIDDLE, COUNTY OF CAPE MAY, NEW JERSEY, APPROPRIATING $1,074,255 FOR THE SATT BOULEVARD SANITARY SEWER PROJECT – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, Ordinance No 1294-08 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/07/2008 at 6:00 p.m.

 

6.                RESOLUTION NO. 77-08 – APPROVING MINUTES FOR PREVIOUS MEETING – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the minutes from the Township Committee meeting held February 4, 2008 and the Work Session held February 20, 2008 are hereby approved.

 

7.                RESOLUTION NO. 78-08 – APPROVE PAYMENT FOR ALL BILLS – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for the following bills in the amounts indicated are hereby approved:

2.                RESOLUTION NO. 82-08; 83-08 – APPROVAL FOR PAYMENT TERMINAL LEAVE (ITEMS A THROUGH B) – On motion by Committeemember Barry seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

(a) WHEREAS, Patricia Bond has submitted her retirement forms with an effective date of February 1st, 2008, and

WHEREAS, it is the policy of Middle Township to compensate retiring employees for accumulated sick, vacation, and personal time, and

WHEREAS, final payment is requested to be made during the months of March, July, October 2008, and 2009 and

WHEREAS, the personnel office has provided sufficient documentation verifying the amount of time accumulated and the Finance Officer has certified that time,

NOW THEREFORE BE IT RESOLVED by the Township Committee, the Governing Body of the Township of Middle, County of Cape May, State of New Jersey that payment be issued to the employee in the amount referenced below.

3.               RESOLUTION NO. 84-08 – RELEASE OF TRUST ACCOUNTS – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

WHEREAS, certain monies held in Trust Accounts from time to time may have balances remaining after all fees have been paid, and

WHEREAS, the applicants are entitled to a refund of this money,

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that upon request of the Zoning Officer the following balances in the Trust Accounts as listed on the attached sheets shall be released.

 

4.                RESOLUTION NO. 85-08 – TRANSFER OF FUNDS – RESERVES – On motion by Committeemember Barry seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, it is legal and lawful to make budget transfers on and after the first day of November in any budget year,

5.                RESOLUTION 86-08 – EMERGENCY TEMPORARY BUDGET AMENDMENT – On motion by Committeemember Barry seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, an emergent condition has arisen and no adequate provision has been made in the 2008 temporary appropriations for the aforesaid purpose; and NJSA 40A:4-20 provides for the creation of an emergency appropriation for the purpose above mentioned, and

WHEREAS, the total emergency temporary resolutions adopted pursuant to the provisions of Chapter 96 PL 1951 (NJSA 40A:4-20) including this resolution total  $2,129,794.92

NOW THEREFORE BE IT RESOLVED (not less than two-thirds of all members thereof affirmatively concurring) that in accordance with NJSA 40A:4-20

  1. An emergency temporary appropriation be and the same is hereby made in the amount of  $2,129,794.92. That said emergency temporary appropriation shall be provided for in the 2008 budget under the title of:

  1. That one certified copy of this resolution be filed with the Director of Local Government Services.
