I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner and Committeemember DeLanzo.   Business Administrator Alexis, Attorney Gorman, Engineer Orlando and Personnel Director Lochten were present.

1.        ORDINANCE NO. 1108-02 – AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 250 THEREOF ENTITLED “ZONING.”    Following second reading, hearing and consideration for adoption, Ordinance No. 1108-02 was adopted on motion by   Mayor Doughty seconded by Committeemember Leusner and passed on roll call.  Complete Ordinance is on file in the Clerk’s office. BE IT ORDAINED by the Township Committee of the Township of Middle in the County of Cape May and State of New Jersey as follows:

SECTION 1.  Section 250-7 of the Code of the Township of Middle is hereby amended and as follows:                                                     TO                                  FROM

Copies of the revisions are available in full at the Zoning, Engineer and Clerk's Office.      SECTION 3. All other Ordinances in conflict or inconsistent with this Ordinance are hereby repealed, to the extent of such conflict or inconsistency.

SECTION 4. Should any section, paragraph, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid for any reason, the remaining portions of this Ordinance shall not be affected thereby and shall remain in full force and effect, and to this end the provisions of this Ordinance are hereby declared to be severable.

SECTION 5. This Ordinance shall become effective immediately upon final passage and publication, according to law.

 

2.        ORDINANCE NO. 1109-02 – AN ORDINANCE AUTHORIZING THE ACQUISITION OF BLOCK 466.01 LOT 37.03 ALSO KNOWN AS FORT APACHE CAMPGROUND. Following second reading, hearing and consideration for adoption, Ordinance No. 1109-02 was adopted on motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call.  Complete Ordinance is on file in the Clerk’s office.

NOW THEREFORE BE IT ORDAINED by the Township Committee of the Township of Middle in the County of Cape May and State of New Jersey as follows:

SECTION 1. The appropriate Township Officials are hereby authorized to commence and complete condemnation proceedings with regard to the lands and premises know as Block 466.01 Lot 37.03 also know as Fort Apache Campground.

SECTION 2. Township of Middle shall file Declaration of Taking for real estate know as Block 466.01 Lot 37.03.

SECTION 3. All other Ordinances in conflict or inconsistent with this Ordinance are hereby repealed, to the extent of such conflict or inconsistency.

SECTION 4. Should any section, paragraph, sentence clause or phrase of this Ordinance be declared thereby and shall remain in full force and effect, and to this end the provisions of this Ordinance are hereby declared to be severable.

SECTION 5. This Ordinance shall become effective immediately upon final passage and publication, according to law.

 

3.        ORDINANCE NO. 1110-02 – AN ORDINANCE AMENDING CHAPTER 215 OF THE CODE OF THE TOWNSHIP OF MIDDLE.  The purpose of this ordinance is to amend and supplement the addition of the following: Definitions, the term “Public Works Superintendent” as used in this chapter, shall be deemed to include the “Administrative Director of Public Works.”  On motion by Mayor Doughty seconded by Committeemember Leusner and passed on roll call.

BE IT ORDAINED by the Township Committee of the Township of Middle in the County of Cape May and State of New Jersey as follows:

SECTION 1.  Chapter 215 of the Code of the Township of Middle is hereby amended and supplemented by the addition of the following: BE IT ORDAINED by the Township Committee of the Township of Middle in the County of Cape May and State of New Jersey as follows: “Definitions – the term “Public Works Superintendent” as used in this chapter shall be deemed to include the “Administrative Director of Public Works.”

4.        RESOLUTION  NO 204-02– APPROVED FAMILY LEAVE – ROSIE JEFFERSON – On motion by Mayor Doughty seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted:

BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the Family Leave for Rosie Jefferson from July 1, 2002 for a period not to exceed 12 weeks, is hereby approved.

 

5.        RESOLUTION NO 205-02– DEDICATION OF A PORTION OF THE EXISTING BIKE PATH AT THE DAVIES SPORTS COMPLEX IN HONOR OF VERA B. LENNON.   On motion by Committeemember Leusner seconded by Mayor Doughty and passed on roll call, the following resolution was adopted:

WHEREAS, Vera B. Lennon retired to Middle Township in the year 1989 with her husband Lenny.  The past twelve years of her life she continued to help others and was a role model to many.

WHEREAS, Vera was a remarkable woman who gave many hours to various non-profit organizations and government agencies within the Township of Middle and throughout the County of Cape May.

NOW THEREFORE BE IT RESOLVED, I, F. Nathan Doughty, Mayor of Middle Township on behalf of Deputy Mayor Charles M. Leusner and Committeewomen Susan L. DeLanzo, am honored to dedicate a portion of the existing Bike Path at the Davies Sports Complex, located in Middle Township, County of Cape May, in honor of this remarkable woman, Vera B. Lennon.  She was our neighbor, our friend, and will always be remembered as “A true spirit of volunteerism.”

6.        RESOLUTION NO 206-02 – CONFIRMATION OF SALE OF LAND –  On motion by  Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following Resolution was adopted:

WHEREAS, the Township Committee of the Township of Middle, the Governing Body thereof, by proper resolution, directed that a public sale be held in the Municipal Court Room, Middle Township Hall, 33 Mechanic Street, Cape May Court House, NJ, and that certain lands and premises owned by, and situate within the township of Middle, County of Cape May, State of New Jersey, be sold as follows:

7.        RESOLUTION NO 207-02 – AUTHORIZE AGREEMENT BETWEEN NEW JERSEY TRANSIT CORPORATION AND THE TOWNSHIP OF MIDDLE FOR THE INSTALLATION AND MAINTENANCE OF BUS SHELTERS - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following Resolution was adopted:

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, hereby authorized location of Bus Stop Shelters at the attached locations

 

8.        RESOLUTION NO 208-02– RELEASE OF PERFORMANCE BOND – STURDY SAVINGS - On motion by Committeemember Leusner seconded by  Committeemember DeLanzo and passed on roll call, the following Resolution was adopted:

WHEREAS, $188,092.57 is being held as a performance guarantee of Sturdy Savings Bank for site improvements at Block 332, Lot 1, also known as 506 South Main Street CMCH, and

WHEREAS, the Engineer has conducted his inspection and determined that all improvements have been completed, and

WHEREAS, the Zoning Official has recommended that the performance quarantee for the above stated project be released.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Account #110199 at Fleet Bank is hereby released.


 

9.        RESOLUTION NO 209-02 – REQUESTING STATE OF NEW JERSEY TO PLACE A MID-BLOCK CROSSWALK IN THE VICINITY OF SCHOOLHOUSE LANE AND ELEMENTARY SCHOOL NO. 1 - On motion by Mayor Doughty seconded by Committeemember Leusner and passed on roll call, the following Resolution was adopted: WHEREAS, the School Superintendent, Dr. Robert Elder requested a Mid-Block Crosswalk along Rt US 9, beginning at a point 275 feet north of the prolongation of the northerly curb line of Schoolhouse Lane and extending Ten (10) feet northerly therefrom.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the State of New Jersey is hereby requested to place a Mid-Block Cross Walk along Rt US 9, beginning at a point 275 feet north of the prolongation of the northerly curb line of Schoolhouse Lane and extending Ten (10) feet northerly therefrom.

 

10.     RESOLUTION NO 210-02– REQUESTING STATE OF NEW JERSEY TO PLACE A MID-BLOCK CROSSWALK IN THE VICINITY OF US RT 9 AND CHURCH STREET - On motion by  Mayor Doughty  seconded by  Committeemember Leusner  and  passed on roll call, the following Resolution was adopted: WHEREAS, Dale Foster, P.E. Cape May County Engineer requested a Mid-Block Crosswalk along Rt US 9, beginning at a point 272 feet south of the prolongation of the southerly curb line of Church Street and extending Ten (10) feet southerly therefrom.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the State of New Jersey is hereby requested to place a Mid-Block Cross Walk along Rt US 9, beginning at a point 272 feet south of the prolongation of the southerly curb line of Church Street and extending Ten (10) feet southerly therefrom.

 

11.     RESOLUTION NO 211-02– CANCELING OUTSTANDING CHECKS – GENERAL ACCOUNT - On motion by Committeemember Leusner seconded by  Committeemember DeLanzo and  passed on roll call, the following Resolution was adopted: WHEREAS, there are certain checks that have been outstanding in the Middle Township General Account for a period of more than one year, and

WHEREAS, it is the desire of the Township Treasurer to return these funds to the Middle Township General Account.

NOW THEREFORE BE IT RESOLVED by the Township Committee, the Governing Body of the Township of Middle, County of Cape May, State of New Jersey that the following checks be and hereby are canceled and will be returned to the General Account of the Township of Middle.

12.     RESOLUTION NO 212-02 – AWARD OF BID – PURCHASE OF ALL-SPORT PORTABLE FENCE – SPORTS PRODUCTS PLUS - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following Resolution was adopted: WHEREAS, it has been deemed necessary and desirable to solicit bids for the purchase of Allsport Portable Fence in the Township of Middle, and

        WHEREAS, bids were received on June 17, 2002, at 3:00 PM

        WHEREAS, it appears that Sports Products Plus has submitted the only responsible bid.

        NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Contract for the Allsport Portable Fence in the Township of Middle, shall be awarded to the following for the total bid price listed below:

Sports Products Plus -  $17,920.00

FURTHER RESOLVED, that this award is conditioned upon certification of funds and submission of appropriate affirmative action forms.

 

13.  RESOLUTION NO 213-02– APPROVE AMUSEMENT GAMES ANNUAL 4-H FAIR - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and  passed on roll call, the following Resolution was adopted: WHEREAS, the Township of Middle, County of Cape May, and State of New Jersey contains a place where an Agricultural Fair and Exhibition organized for the purpose of holding Agricultural Fairs and Exhibitions which is approved by the State Department of Agriculture, and

        WHEREAS, proper applications have been made to the Township of Middle, County of Cape May, State of New Jersey and the proper fees have been paid.

   THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May and State of New Jersey that the Amusement Games applicants are hereby licensed by the Township of Middle pursuant to the "Amusement Games Licensing Law" for the games mentioned in said applications for the period of July 18, 2002 through July 20, 2002 at the Cape May County 4-H Fairgrounds, Dennisville Rd. Cape May Court House, NJ.

 

14.  RESOLUTION NO 214-02– TABULATION COMMITTEE – HOUSING REHABILITATION CONTRACT #99-7 - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following Resolution was adopted: BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey that, Temporary Chief Finance Officer Tracey Taverner, Administrator James Alexis, Mark Blauer, Grants Administrative Assistant and Director of Grants Melville Atwood be and hereby are appointed to tabulate the bids to be taken on July 15, 2002 at 10:00 AM in the Middle Township Municipal Building, 33 Mechanic Street, Cape May Court House, NJ for the following:

        HOUSING REHABILITATION GRANT-CONTRACT #99-7

 

15.     RESOLUTION  NO 215-02– REDUCTION OF PERFORMANCE BOND – ENTERPRISE LLC - On motion by Mayor Doughty  seconded by  Committeemember DeLanzo and  passed on roll call, the following Resolution was adopted: WHEREAS, $83,545.92 is being held as a Performance Guarantee for Enterprise LLC for site plan improvements at Block 918, Lot 1.09, also known as Enterprise Drive Burleigh, and

WHEREAS, the Engineer for the Township of Middle has conducted his inspection and certified that all in the amount of $78,545.92 have been completed, and

WHEREAS, the Zoning Officer for the Township of Middle has recommended that the performance bond be reduced to $5,000.00, and

WHEREAS, the Land Use Law of the State of New Jersey (NJS 40:55D-1 et seq) requires such a release upon recommendation by the Township Engineer,

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Tri-Party Allocation Category Agreement with Sun National Bank in the name of Enterprise LLC be and is hereby reduced to $5,000.00.

 

16.     RESOLUTION NO 216-02 – REDUCTION OF PERFORMANCE BOND – JOHN FORD - On motion by  Mayor Doughty  seconded by  Committeemember DeLanzo and  passed on roll call, the following Resolution was adopted:

WHEREAS, $153,915.10 is being held as a Performance Guarantee for John Ford for site plan improvements at Block 1435.03, Lot 23.02, also known as 3167 Route 9 South Rio Grande, and

WHEREAS, the Engineer for the Township of Middle has conducted his inspection and certified that all improvements in the amount of $52,869.80 have been completed, and

WHEREAS, the Zoning Officer for the Township of Middle has recommended that the performance bond be reduced to $101,045.30, and

WHEREAS, the Land Use Law of the State of New Jersey (NJS 40:55D-1 et seq) requires such a release upon recommendation by the Township Engineer,

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Tri-Party Category Agreement with Sturdy Savings Bank in the name of John P. Ford and Michael b. Nestor be and is hereby reduced to $101,045.30.

 

17.     RESOLUTION  NO 217-02– REDUCTION OF PERFORMANCE BOND – FRANK CARPINO - On motion by Mayor Doughty seconded by Committeemember DeLanzo and  passed on roll call, the following Resolution was adopted: WHEREAS, $108,264.00 is being held as a Performance Guarantee for Frank Carpino for site plan improvements at Block 12.01, Lot 45, also known as Route 9 & Fairway Drive Swainton, and

WHEREAS, the Engineer for the Township of Middle has conducted his inspection and certified that all improvements in the amount of $8,475.00 have been completed, and

WHEREAS, the Zoning Officer for the Township of Middle has recommended that the performance bond be reduced to $99,789.00, and

WHEREAS, the Land Use Law of the State of New Jersey (NJS 40:55D-1 et seq) requires such a release upon recommendation by the Township Engineer,

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Subdivision Bond with American Manufactures Mutual in the name of Frank Carpino be and is hereby reduced to $99,789.00.

 

18.     RESOLUTION  NO 218-02– RELEASE – PERFORMANCE BOND – ROBERT CLARKE JR. - On motion by  Mayor Doughty seconded by Committeemember DeLanzo and  passed on roll call, the following Resolution was adopted: WHEREAS, $1,817.57 is being held as a Performance Guarantee for Robert Clarke Jr. for site plan improvements at Block 163.01, Lot 1.03, also known as 6 Route 47 South, and

WHEREAS, the Engineer for the Township of Middle has conducted his inspection and certified that all improvements have been completed, and

WHEREAS, the Zoning Officer for the Township of Middle has recommended that the performance bond be released, and

WHEREAS, the Land Use Law of the State of New Jersey (NJS 40:55D-1 et seq) requires such a release upon recommendation by the Township Engineer,

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Account No. 170367438 with Sun National Bank in the name of Robert Clarke Jr. be and is hereby released.

 

19.     RESOLUTION NO 219-02– RELEASE – PERFORMANCE BOND – JAMES COVELLO – HOUSE MOVING - On motion by  Committeemember DeLanzo seconded by  Mayor Doughty  and  passed on roll call, the following Resolution was adopted: WHEREAS, $5,000.00 is being held as a Performance Guarantee of James Covello for a structure moved to Block 118.04 Lot 8 also known as 26 Meadowview Lane Avalon Manor, and

WHEREAS, the Township Engineer for the Township of Middle has conducted his inspection and certified that all improvements have been completed, and

       WHEREAS, the Zoning Official has requested the release of said guarantee.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Account #523270 with Fleet Bank be and is hereby released.

 

20.     RESOLUTION  NO 220-02– INSERT SPECIAL ITEM OF REVENUE -CLEAN COMMUNITIES FY 2002- On motion by Committeemember Leusner seconded by Mayor Doughty  and  passed on roll call, the following Resolution was adopted. WHEREAS, R.S. 40A:4-87 provides the Director of the Division of Local Government Services may approve the insertion of any Special Item of Revenue in the budget of any Municipality when such item shall have been made available by law and the amount whereof was not determined at the time of adoption of budget, and

       WHEREAS, said Director may also approve the insertion of an appropriation for an equal amount.

       NOW THEREFORE BE IT RESOLVED, that the Township Committee, the Governing Body of the   Township of Middle, County of Cape May and State of New Jersey, hereby requests the director of the division of Local Government Services to approve the insertion of additional items of revenue in the budget of the year 2002 in the sum of:

Clean Communities FY2002-$8,283.27

BE IT FURTHER RESOLVED, that like sum be and the same is hereby appropriated under the   following caption:

21.     RESOLUTION NO 221-02– INSERT SPECIAL ITEM OF REVENUE – GREEN ACRES LAND ACQUISITION - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following Resolution was adopted. WHEREAS, R.S. 40A:4-87 provides the Director of the Division of Local Government Services may approve the insertion of any Special Item of Revenue in the budget of any Municipality when such item shall have been made

       Available by law and the amount whereof was not determined at the time of adoption of budget, and

       WHEREAS, said Director may also approve the insertion of an appropriation for an equal amount. NOW THEREFORE BE IT RESOLVED, that the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, hereby requests the director of the division of Local Government Services to approve the insertion of additional items of revenue in the budget of the year 2002 in the sum of:

22.     RESOLUTION  NO 222-02– INSERT SPECIAL ITEM OF REVENUE – DRUNK DRIVING ENFORCEMENT FUND FY 2001- On motion by  Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following Resolution was adopted WHEREAS, R.S. 40A:4-87 provides the Director of the Division of Local Government Services may approve the insertion of any Special Item of Revenue in the budget of any Municipality when such item shall have been made available by law and the amount whereof was not determined at the time of adoption of budget, and

WHEREAS, said Director may also approve the insertion of an appropriation for an equal amount.     NOW THEREFORE BE IT RESOLVED, that the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, hereby requests the director of the division of Local Government Services to approve the insertion of additional items of revenue in the budget of the year 2002 in the sum of:

Drunk Driving Enforcement Fund FY 2001 - $16,163.91

23.     RETIREMENT – Sharon Coco, Township Clerk has submitted her letter of retirement effective September 1, 2002.  For the record, all committee people praised Sharon for service and professionalism.

24.     RESOLUTION  NO 223-02- TEMPORARY APPOINTMENT – ACTING TOWNSHIP CLERK - JAMES ALEXIS - On motion by  Committeemember Leusner  seconded by  Mayor Doughty and  passed on roll call, the following Resolution was adopted:

WHEREAS, the Township Committee of the Township of Middle deems it advisable to appoint an Acting Township Clerk, who shall have all the powers and perform all the duties of the Township Clerk during such times and for such specific periods as the Township Clerk shall be absent.

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, that James Alexis be and is hereby appointed as Acting Township Clerk for the Township of Middle effective July 1, 2002 until September 1, 2002.

Effective July 10, 2002.

 

25.     RESOLUTION NO 224-02–  APPOINTMENT -  TOWNSHIP CLERK/BUSINESS ADMINISTRATOR  - JAMES ALEXIS – On motion by  Committeemember Leusner  seconded by Committeemember DeLanzo  and  passed on roll call, the following Resolution was adopted: BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey that the following person be and is hereby appointed to fill the following position for the term of office opposite their name:

26.     STREET VACATION REQUEST – LOUIS ALTOBELLI – RIO AUTO BODY – has requested the vacation of Maple Avenue from Route 9 to Second Avenue in Edgewood.  The Township Engineer reviewed the request and recommended that the applicant submit a survey to determine if there are any structures encroaching on the adjoining property that would have to be moved before the street is vacated.  Township Committee directed the applicant to have the survey prepared and submitted to the Engineer prior to the Attorney preparing the vacation ordinance.  Mr. Altobelli has submitted the survey.  The Township Engineer has reviewed and will report.  Bruce said notices could be sent for 1st meeting in August.  Get him documentation.

27.     RAFFLE – Bishop McHugh has applied to hold two (2) Raffles on October 19, 2002, at the Wildwood Country Club.  Application is in order and fee has been paid. On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call. Raffle license #09-02 and 10-02 was granted.

28.     REPORTS – The Treasurer submitted her Summary of Account Reconciliation for the month of March 2002.

29.     APPROVAL OF MINUTES FOR PREVIOUS MEETINGS - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the Township Committee Meeting Minutes of May 20, 2002 and June 17, 2002 were approved.

37.   RESOLUTION – PROFESSIONAL SERVICES AGREEMENT – TRIAD ASSOCIATES FOR KING COMMUNITY CENTER PROJECT.  On motion by Committeemember Leusner seconded by Mayor Doughty and passed on roll call, the following Resolution was adopted. WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and

        WHEREAS, the Township of Middle requires said services and funds are available for said purpose,
