THIS MEETING IS BEING RECORDED:

I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, and Committeemember DeLanzo.  Committeemember Leusner was absent.   Business Administrator Alexis, Township Clerk Coco, Attorney Gorman, Engineer Orlando and Personnel Director Lochten were present. 

1.        RESOLUTION NO. 187-02– LOCAL PUBLIC CONTRACT – AUDIT SERVICES – J. L. EZYSKE & CO. – CASCADE CORPORATION CASE - On motion By Mayor Doughty seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted:
WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and
WHEREAS, the Township of Middle requires said services and funds are available for said purpose,
NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following person is hereby appointed to the position designated below for the period beginning on June 17, 2002 through completion of the project.
BE IT FURTHER RESOLVED, that a contract be executed by the Township of Middle with the following person to supply professional services for the period from June 17, 2002 through completion of the project.
Audit Services  – J. L. Ezyske & Co. – Cascade Corporation Case
BE IT FURTHER RESOLVED that a copy of this Resolution be published in the Herald-Times a required by law.
FURTHER RESOLVED that this contract is contingent upon the certification of availability of funds and submission of State Affirmative Action Certification.

 

2.        RESOLUTION NO. 188-02– AWARD OF BID – RECONSTRUCTION OF CHURCH STREET –– ALBRECHT & HEUN - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted:
WHEREAS, it has been deemed necessary and desirable to solicit bids for Reconstruction of Church Street, and
WHEREAS, sealed bids were received on June 5, 2002 at 3:00 P.M., and
WHEREAS, it appears that the following bid submitted represents a figure equal to the lowest bid
received which complies with specifications.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Contract for the Reconstruction of Church Street shall be awarded to Albrecht & Heun for a total bid price of $59,263.00.
FURTHER RESOLVED, that this award is conditioned upon submission of Initial Project Workforce Report-Construction and Treasurer’s Certification of availability of funds.

 

3.        RESOLUTION NO. 189-02– AWARD OF BID – CAPITAL IMPROVEMENT PROGRAM  - ALBRECHT & HEUN - On motion by  Mayor Doughty  seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted:
WHEREAS, it has been deemed necessary and desirable to solicit bids for Capital Improvement Program, and
WHEREAS, sealed bids were received on June 5, 2002 at 3:00 P.M., and
WHEREAS, it appears that the following bid submitted represents a figure equal to the lowest bid received which complies with specifications.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Contract for the Capital Improvement Program shall be awarded to Albrecht & Heun for a total bid price of $394,853.00.
FURTHER RESOLVED, that this award is conditioned upon submission of Initial Project Workforce Report-Construction and Treasurer’s Certification of availability of funds.


4.        RESOLUTION NO. 190-02– REDUCE PERFORMANCE BOND -  SAM DELARSO - On motion by  Mayor Doughty seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted: WHEREAS, $20,079.50 is being held as a performance guarantee of Sam DeLarso for site improvements at Block 1, Lot 4.05, also known as Rt 47 N, Goshen, and

WHEREAS, the Engineer has conducted his inspection and determined that improvements having a value of $16,000.00 have been completed, and

WHEREAS, the Zoning Official has recommended that the performance guarantee for the above stated project be reduced to $4,079.50.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Account #22220002640 ZEA Master Account, Account #346416 Sub Account at Fleet Bank be and is hereby reduced to $4,079.50.

 

5.        RESOLUTION NO. 191-02– AWARD MAINTENANCE CONTRACT – XEROX CORPORATION - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted: WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and

       WHEREAS, the Township of Middle requires said services and funds are available for said purpose,

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following person is hereby appointed to the position designated below for the period beginning on June 4, 2002 through December 31, 2002. BE IT FURTHER RESOLVED that a copy of this Resolution be published in the Herald-Times as required by law.

FURTHER RESOLVED that this contract is contingent upon the certification of availability of funds              and submission of State Affirmative Action Certification.

 

6.        RESOLUTION NO. 192-02– CANCELLATION OF MORTGAGE - ECONOMIC DEVELOPMENT LOAN – RIO AUTO BODY SHOP - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted: NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Mortgage of Little Red School House is hereby canceled.

FURTHER RESOLVED, that the appropriate officials are hereby authorized to sign  said Cancellation of Mortgage.

 

7.        RESOLUTION NO. 193-02– CANCELLATION OF MORTGAGE – ECONOMIC DEVELOPMENT LOAN  - LITTLE RED SCHOOL HOUSE - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted:
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Mortgage of Little Red School House is hereby canceled.

FURTHER RESOLVED, that the appropriate officials are hereby authorized to sign  said Cancellation of Mortgage.

 

8.        RESOLUTION NO. 194-02– ADJUST SALARY -  GREG ARNOLD - On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed by majority on roll call, the following resolution was adopted: NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that the following employee salaries will be amended to the amount opposite their name:

10.     RESOLUTION NO. 196-02– ADOPTING THE ACCESS TO PUBLIC INFORMATION REQUEST POLICIES AND FORMS  - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted: NOW, THEREFORE BE IT RESOLVED, by the Governing Body of the Township of Middle, that the “Access to Public Information Request Policies and Forms” attached to and made a part of this Resolution, hereby be adopted.

BE IT FURTHER RESOLVED, that a copy of this Policy and Form have been distributed to all offices in the Township of Middle and is on file in the office of the Clerk of the Township of Middle.

BE IT FURTHER RESOLVED, that the Custodian of Records be permitted to appoint Deputies within each Department as the Custodian of Records as he/she sees fit.

 

11.  RESOLUTION NO. 197-02-FY 2002 LOCAL LAW ENFORCEMENT BLOCK GRANT – On  motion by Committeemember DeLanzo seconded by Mayor Doughty and passed by majority on roll call, the resolution was adopted: 

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that approval for the FY 2002 Local Law Enforcement Block Grant be and is hereby approved.

FURTHER RESOLVED, that Police Captain Joseph Evangelista is named as the Contact Person is and that the appropriate officials are hereby authorized to sign said documents.

 

12.     REVIEW OF TEMPORARY EASEMENT OLD STAGECOACH CAMPGROUND –
Township Solicitor, Bruce Gorman, does not think we should extend this easement.  Interfering in private dispute between two landowners.  Old Stagecoach is seriously in arrears on taxes.  Recommends we do not have sign removed.

 

13.     RESOLUTION NO. 198-02– CLOSED SESSION – POTENTIAL LITIGATION - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed by majority on roll call, the following resolution was adopted:

WHEREAS, the section of the Open Public Meetings Law, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Township Committee of the Township of Middle, the governing body thereof, is of the opinion that such circumstances presently exist,

NOW THEREFORE BE IT RESOLVED, by the Township of Middle, County of Cape May, State of New Jersey:

1.  The public shall be excluded from the discussion of an action upon the hereinafter-specified matter: POTENTIAL LITIGATION

2.  The general nature of the subject matter to be discussed is as follows: POTENTIAL LITIGATION

   3.  It is anticipated at this time the above subject matter will be made public as follows:
                               WHEN THE MATTER IS TERMINATED

         4.  This Resolution shall take effect immediately.  

 

13.     REPORTS –The Court Administrator submitted her report for the month of May 2002 showing                                                                                          $17,870.30 paid to the Treasurer for the General Account.

 

15.     APPROVAL OF MINUTES OF PREVIOUS MEETING - On motion by Committeemember                  DeLanzo seconded by Mayor Doughty and passed by majority on roll call, the Township Committee
  Meeting Minutes of June 3, 2002 were approved.

15.     APPROVAL OF BILLS FOR PAYMENT - On motion by Mayor Doughty  seconded by Committeemember DeLanzo and Passed by majority on roll call, the bills were ordered paid.

16.     ANNOUNCEMENT – The County of Cape May has adopted a Resolution setting the speed limits on Bayshore Road.

17.     RAFFLE – Middle Township High School All Sports Booster Club has applied to hold a Raffle on July 4, 2002, at Big Timberlake Campground.  Application is in order and fee has been paid.  On motion by  Mayor Doughty  seconded by   Committeemember DeLanzo and  passed by majority on roll call.  Raffle license #7-02 was granted.

18.     RAFFLE – Knights of Columbus has applied to hold a Raffle on July 4, 2002, at the Davies Sports Complex.  Application is in order and fee has been paid.  On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed by majority on roll call.  Raffle license #8-02 was granted.
