I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00PM at the Middle Township Municipal Building.  Members present were Mayor Doughty and Committeemember Leusner and DeLanzo. Business Administrator Alexis, Township Clerk Coco, Attorney Bruce Gorman, Township Engineer Orlando and Personnel Director Lochten were present.

1.       PRESENTATION – NATURE CONSERVANCY.  – Mayor Doughty presented Plaques of Appreciation to Jay Laubengeyer and Michael Catania, representatives of the Nature Conservancy, for their efforts in preserving land in Middle Township for open space. 

2.        ORDINANCE NO. 1100-02 – AN ORDINANCE AMENDING CHAPTER 218, SUBDIVISION OF LAND AND SITE PLAN REVIEW, OF THE CODE OF THE TOWNSHIP OF MIDDLE – This Ordinance pertains to signs and has been reviewed by the Middle Township Planning Board and recommended for approval. Action on the Ordinance was tabled.

3.        ORDINANCE NO. 1101-02 – AN ORDINANCE AMENDING CHAPTER 218-48, SUBDIVISION OF LAND AND SITE PLAN REVIEW, OF THE CODE OF THE TOWNSHIP OF MIDDLE – This Ordinance pertains to escrow accounts and has been reviewed by the Middle Township Planning Board and recommended for approval. On motion by Mayor Doughty seconded by  Committeemember DeLanzo and unanimously passed on roll call, Ordinance No. 1101-02 passed first reading. Second reading, public hearing and consideration for adoption will be held on April 15, 2002 at 6:00 P.M.

4.        ORDINANCE NO. 1102-02 – AN ORDINANCE AMENDING CHAPTER 250, “ZONING” OF THE CODE OF THE TOWNSHIP OF MIDDLE – This Ordinance pertains to accessory structures and has been reviewed by the Middle Township Planning Board and recommended for approval. On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, Ordinance No. 1102-02 passed first reading. Second reading, public hearing and consideration for adoption will be held on April 15, 2002 at 6:00 P.M.

5.        ORDINANCE NO. 1103-02 – AN ORDINANCE AMENDING CHAPTER 250, “ZONING”, OF THE CODE OF THE TOWNSHIP OF MIDDLE BY ESTABLISHING A ZONING PERMIT – This Ordinance has been reviewed by the Middle Township Planning Board and recommended for approval. On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, Ordinance No. 1103-02 passed first reading. Second reading, public hearing and consideration for adoption will be held on April 15, 2002 at 6:00 P.M.

6.        RESOLUTION NO. 87-02 – SEWER RECONNECTION FEE - On motion by Mayor Doughty         seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:
BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Sewer Reconnection fee for the term February 13, 2002 through February 13, 2003 shall be $1500.00.

7.        RESOLUTION NO. 88-02– APPOINTMENT – TELECOMMUNICATION OPERATOR P/T – STEVEN SMEARMAN  - On motion by Committeemember DeLanzo seconded by Mayor Doughty and unanimously passed on roll call, the following resolution was adopted:
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that the following employee is hereby appointed to the following position at the salary opposite their name:

8.        RESOLUTION NO. 89-02 – AUTHORIZE APPLICATION – FY 2002 BULLET PROOF VEST PARTNERSHIP GRANT  - On motion by Committeemember DeLanzo seconded by Mayor Doughty and unanimously passed on roll call, the following resolution was adopted:
BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that approval for the FY 2002 Bullet Proof Vest Partnership Grant be and is hereby approved.
FURTHER RESOLVED, that Police Captain Joseph Evangelista is named as the Contact Person and that the appropriate officials are hereby authorized to sign said documents.

 

 


 

9.        RESOLUTION NO. 90-02 – CONFIRMATION OF SALE OF LAND - On motion by Committeemember Leusner seconded by Mayor Doughty and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, the Township Committee of the Township of Middle, the Governing Body thereof, by proper resolution, directed that a public sale be held in the Municipal Court Room, Middle Township Hall, 33 Mechanic Street, Cape May Court House, NJ, and that certain lands and premises owned by, and situate within the township of Middle, County of Cape May, State of New Jersey, be sold as follows:

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, that the sale of said premises, upon the above consideration, be and is hereby confirmed, and the Mayor and Clerk of the Township of Middle are hereby authorized and directed to convey said premises as directed by said highest bidder, by Bargain and Sale Deed, free and clear of all taxes up to and including the calendar quarter during which said sale was held.

 

10.     RESOLUTION 91-02  – CLOSED SESSION – LABOR NEGOTIATIONS -  On motion by Mayor Doughty seconded by  Committeemember DeLanzo and passed by majority on roll call, with Committeemember Leusner abstaining, the following resolution was adopted:
WHEREAS, the section of the Open Public Meetings Law, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, the Township Committee of the Township of Middle, the governing body thereof, is of the opinion that such circumstances presently exist,
NOW THEREFORE BE IT RESOLVED, by the Township of Middle, County of Cape May, State of New Jersey:
The public shall be excluded from the discussion of an action upon the hereinafter specified matter: LABOR NEGOTIATIONS
The general nature of the subject matter to be discussed is as follows: LABOR NEGOTIATIONS
It is anticipated at this time the above subject matter will be made public as follows:
      WHEN THE MATTER IS TERMINATED
This Resolution shall take effect immediately.

 

11.     RAFFLE – The Rio Grande Fire Company Ladies Auxiliary has applied to hold nine raffle games coinciding with Bingo at the Rio Grande firehouse. Fee has been paid and application is in order. On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, Raffle License No. 01-02 was granted.

12.     REPORTS – The Township Clerk submitted her report for the month of February, 2002 showing $11,329.50 paid to the Treasurer for the General Account, $406.00 for the Dog Account and $200.00 for Trust Other. The Zoning Official submitted her report for the month of February 2002 showing $2,047.00 paid to the Treasurer for the General Account and $25,283.56 for Trust Other. The Construction Official submitted his report for the month of February 2002 showing $21,364.00 paid to the Treasurer for the General Account and $1,065.00 for Trust Other. The Tax Collector submitted her report for the month of February 2002 showing $2,871,839.52 in Total Receipts. The Court Administrator submitted her report for the month of February 2002 showing $17,569.26 paid to the Treasurer. The Treasurer submitted her Summary of Account Reconciliation for the months of January and February, 2002.

13.     APPROVAL OF MINUTES OF PREVIOUS MEETING – On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, the minutes of Township Committee meetings held on March 4, 2002 were approved.

14.     APPROVAL OF BILLS FOR PAYMENT – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and unanimously passed on roll call, the bills were ordered paid.

15.     ANNOUNCEMENT – Their will be a Public Information Center set up in the Court Room at the Municipal Building on March 21, 2002 by the New Jersey Department of Transportation to review Intersection Improvement at Route 9 an Crest Haven Road.


PUBLIC PORTION -

Florence Love, Grassy Sounds – asked about the status of Condemnation proceedings for access road to her home in Grassy Sounds.
Attorney Gorman – their was a problem with one of the titles and the search needed to be redone. As soon as all the paperwork is complete it will proceed through courts.

Len Panteleo, Swainton – wants Committee to hire a Public Advocate to represent the residents of the Township at hearings in front of the Zoning and Planning Boards. He stated that other Municipalities have hired Public Advocates to do this.
Vilma Pombo – stated that she thinks that would be a good idea.
Mayor Doughty – asked Mr. Panteleo to supply him with a list of Municipalities that have done this.

Ed Letts, Oslo Avenue Rio Grande – concerned with dirt bikes in his neighborhood.
Committeemember Leusner – asked if he had called police.
Letts – yes, Officer Elias responded. 
Letts – stated that he is going to sign complaints against the individuals.

Letts – asked Committee to pass an Ordinance regulating Doctor’s hours. He stated that the Methadone Clinic in his neighborhood opens at 5:15 AM.
Attorney Gorman – stated that he does not think Committee can regulate Doctor’s hours.  However there are other things that can be done such as enforcement of noise regulations and parking regulations.
Committeemember Leusner – stated that Doctor Manlandro and Kevin French had promised to relocate the clinic and have reneged on their promise.
Letts – thanked Committeemember Leusner and Administrator Alexis for their efforts in the clean up at the Electric Plant located at the end of Railroad Avenue. Conective has put up a fence to keep people from going back there and dumping trash.

Mr. Long, Honeysuckle Lane – dirt bikes in his neighborhood have been reduced by about 75% since the last meeting.
Alexis – The Action property was contacted and will be gating the road to keep the dirt bikes out of the gravel pit.

Everett Lonergan, Del Haven – is interested in obtaining land for a business to legally operate dirt bikes.

Vilma Pombo – asked about Harbor Bay Mall
Mayor Doughty – can’t discuss because the matter is in litigation

Committeemember Leusner announced that the Township has received a AAA Bond Rating.

Mayor Doughty announced that the Middle Township Boys Basketball team won the State Group II Championship.
