I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner and DeLanzo.  Business Administrator Alexis, Township Clerk Coco, Attorney Gorman, Engineer Orlando and Deputy Clerk Lochten were present.

Recreation Director Gregory Arnold presented Committeemember Leusner with a plague of special recognition for his efforts over the past twenty years for support of sport and recreation in Middle Township.

 

1.       AMERICAN LEGION LADIES AUXILIARY – POPPY DAY.

2.        ORDINANCE NO. 1104-02 – AN ORDINANCE VACATING AN UNNAMED ALLEY AS SHOWN ON SHEET 13.05 OF THE MIDDLE TOWNSHIP TAX MAP. – On motion by Committeemember DeLanzo seconded by Mayor Doughty and unanimously passed on roll call, Ordinance No. 1104-02 passed first reading. Second reading, hearing and consideration for adoption will be held on June 3, 2002 at 6:00 P.M.

3.        ORDINANCE NO. 1105-02 – AN ORDINANCE AMENDING SECTION 2218-12A(2) OF THE CODE OF THE TOWNSHIP OF MIDDLE PERTAINING TO NOTICE OF PUBLIC HEARINGS ON APPLICATIONS FOR DEVELOPMENT. – This Ordinance has been reviewed and recommended for approval by the Middle Township Planning Board Attorney. On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, Ordinance No. 1105-02 passed first reading. Second reading, hearing and consideration for adoption will be held on June 3, 2002 at 6:00 P.M.

4.        ORDINANCE NO. 1106-02 – AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 250 THEREOF ENTITLED ZONING - This Ordinance has been reviewed and recommended for approval by the Middle Township Planning Board. On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed by majority on roll call with Mayor Doughty abstaining, Ordinance No. 1106-02 passed first reading.  Second reading, hearing and consideration for adoption will be held on June 3, 2002 at 6:00 P.M.

5.        ORDINANCE NO. 1107-02 – BOND ORDINANCE PROVIDING FOR LAND ACQUISITION IN AND BY THE TOWNSHIP OF MIDDLE, IN THE COUNTY OF CAPE MAY, NEW JERSEY, APPROPRIATING $649,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $616,550 BONDS OR NOTES OF THE TOWNSHIP TO FINANCE PART OF THE COST THEREOF. - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and unanimously passed on roll call, Ordinance No. 1107-02 passed first reading. Second reading, hearing and consideration for adoption will be held on June 3, 2002 at 6:00 P.M.

 

6.        RESOLUTION NO. 122-02 – CANCELING OUTSTANDING CHECKS – COURT GENERAL ACCOUNT AND BAIL ACCOUNT – On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, there are certain checks that have been outstanding in the Middle Township Court General Account and Bail Account for a period of more than one year, and
WHEREAS, it is the desire of the Township Treasurer to return these funds to the Middle Township General Account.
NOW THEREFORE BE IT RESOLVED by the Township Committee, the Governing Body of the Township of Middle, County of Cape May, State of New Jersey that the following checks be and hereby are canceled and will be returned to the General Account of the Township of Middle.

7.        RESOLUTION NO. 123-02 – REFUND OF MONIES – SEWER DEPARTMENT – On motion by Mayor Doughty seconded by and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, there was an overpayment of funds on Account #04784, Helen Livesey in the amount of $134.62,
NOW THEREFORE BE IT AGREED, by the Township Committee of the Township of Middle, the governing body thereof, that the Director of Sewer is hereby authorized to make the adjustment to the account.


8.        RESOLUTION NO. 124-02 – CONFIRMATION OF SALE OF LAND – On motion by Mayor Doughty seconded by and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, the Township Committee of the Township of Middle, the Governing Body thereof, by proper resolution, directed that a public sale be held in the Municipal Court Room, Middle Township Hall, 33 Mechanic Street, Cape May Court House, NJ, and that certain lands and premises owned by, and situate within the township of Middle, County of Cape May, State of New Jersey, be sold as follows:

WHEREAS, said sale was held at the above time and place, and said premises were sold to the highest bidder, as follows:

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, that the sale of said premises, upon the above consideration, be and is hereby confirmed, and the Mayor and Clerk of the Township of Middle are hereby authorized and directed to convey said premises as directed by said highest bidder, by Bargain and Sale Deed, free and clear of all taxes up to and including the calendar quarter during which said sale was held.

 

9.        RESOLUTION NO. 125-02 – REFUND OF TAXES – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and unanimously passed on roll call, taxes were refunded on seven accounts due to overpayment by Mortgage Company.

10.     RESOLUTION NO. 126-02 – CANCELLATION OF TAXES – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and unanimously passed on roll call, taxes were canceled on two accounts due to 100% disabled Veteran.

11.     RESOLUTION NO. 127-02 – REFUND OF TAXES – On motion by Committeemember Leusner seconded by Mayor Doughty and               unanimously passed on roll call, taxes were refunded on two properties due to 100% total disabled Veteran.

12.     RESOLUTION NO. 128-02 – RELEASE OF TRUST ACCOUNTS – On motion by Mayor Doughty seconded by and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, certain Moneys held in Trust Accounts from time to time may have balances remaining after all fees have been paid, and
WHEREAS, the applicants are entitled to a refund of this money,
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that upon request of the Zoning Officer the following balances in the Trust Account as listed on the attached sheets shall be released.

 

13.     RESOLUTION NO. 129-02 – ENDORSE TWA PERMIT APPLICATION – SCHOOLHOUSE OFFICE PARK – On motion by Mayor Doughty seconded by and unanimously passed on roll call, the following resolution was adopted:
BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Mayor F. Nathan Doughty is hereby authorized to sign all permit applications in connection with the TWA permit for Schoolhouse Office Park.

 

 

14.     RESOLUTION NO. 130-02 – CHANGE IN CIVIL SERVICE TITLES – KATIE BERG – TELECOMMUNICATION OPERATOR P/T TO FULL TIME –VERA KALISH FROM PERSONNEL CLERK TO SENIOR PERSONNEL CLERK – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:

21.     RESOLUTION NO. 137-02 – EMERGENCY TEMPORARY BUDGET AMENDMENT - On motion by Mayor Doughty seconded by Committeemember Leusner and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, an emergent condition has arisen and no adequate provision has been made in the 2002 temporary appropriations for the aforesaid purpose, and N.J.S.A 40A:4-20 provides for the creation of an emergency appropriation for the purpose above mentioned, and
WHEREAS, the total emergency temporary resolutions adopted in the year 2002 pursuant to the provisions of Chapter 96, P.L. 1951 (N.J.S.A. 40A:4-20) including this resolution total $4,022,300.
NOW THEREFORE BE IT RESOLVED (not less than two-thirds of all members thereof affirmatively concurring) that in accordance with N.J.S.A. 40A: 4-20
1. An emergency temporary appropriation be and the same is hereby made in the amount of $2,396,550.00.
2. That said emergency temporary appropriation shall be funded in 2002 budget under the title of: Please see attached list
3. That one certified copy of this resolution be filed with the Director of Local Government Services.
