THIS MEETING IS BEING RECORDED:

I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).
The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner and Committeemember DeLanzo.  Business Administrator Alexis, Township Clerk Coco, Attorney Gorman, Engineer Orlando and Personnel Director Lochten were present. 

 

1.        RESOLUTION NO. 143-02 – INTERLOCAL SERVICES AGREEMENT BETWEEN THE TOWNSHIP OF MIDDLE AND THE BOROUGH OF CAPE MAY POINT FOR ANIMAL CONTROL – On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:
Whereas, N.J.S.A. 40-.8A-3 authorizes municipalities to enter into agreements for the purposes of exchanging, sharing and cooperating with regard to services common to said communities through Interlocal Services Agreements; and
Whereas, the Borough of Cape May Point is in need of services relating to Animal Control; and
Whereas, the Township of Middle has certain equipment and personnel available to meet the needs of the Borough of Cape May Point in this area; and
Whereas, entering into an Interlocal Services Agreement with the Borough of Cape May Point for this purpose has been deemed to be in the necessary for the health, safety and welfare and economic interests of the citizens of the Township of Middle.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that the preamble of this Resolution is hereby incorporated by reference;
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized and directed to execute the attached Interlocal Services Agreement between the Township of Middle and the Borough of Cape May Point for Animal Control Services, which is hereby incorporated by reference, pursuant to N. J. S. A. 40:8A- I et. Seq

2.        RESOLUTION NO. 144-02 – CONFIRMATION OF SALE OF LAND – On motion by Committeemember Leusner seconded by Mayor Doughty and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, the Township Committee of the Township of Middle, the Governing Body thereof, by proper resolution, directed that a public sale be held in the Municipal Court Room, Middle Township Hall, 33 Mechanic Street, Cape May Court House, NJ, and that certain lands and premises owned by, and situate within the township of Middle, County of Cape May, State of New Jersey, be sold as follows:

WHEREAS, said sale was held at the above time and place, and said premises were sold to the highest bidder, as follows:

3.        RESOLUTION NO. 145-02 – CONFIRMATION OF SALE OF LAND – On motion by Committeemember Leusner seconded by Mayor Doughty and unanimously passed on roll call, the following resolution was adopted:

5.        RESOLUTION NO. 147-02 – LOCAL PUBLIC CONTRACT – COMMUNICATION SERVICES – POLICE DEPARTMENT -  V COMM - On motion by Committeemember DeLanzo seconded by Committeemember Leusner and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and
WHEREAS, the Township of Middle requires said services and funds are available for said purpose,
NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following person is hereby appointed to the position designated below.
V COMM - COMMUNICATION SERVICES POLICE DEPARTMENT
BE IT FURTHER RESOLVED that a copy of this Resolution be published in the Herald-Times as required by law.
FURTHER RESOLVED that this contract is contingent upon the certification of availability of funds and submission of State Affirmative Action Certification.

 

6.        RESOLUTION NO. 148-02 – LOCAL PUBLIC CONTRACT – ENGINEERING SERVICES – RIO GRANDE RECREATION FACILITY – STEVE MARTINELLI - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and
WHEREAS, the Township of Middle requires said services and funds are available for said purpose,
NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following person is hereby appointed to the position designated below.
STEPHEN MARTINELLI –ENGINEERING SERVICES – RIO GRANDE RECREATION FACILITY
BE IT FURTHER RESOLVED that a copy of this Resolution be published in the Herald-Times as required by law.
FURTHER RESOLVED that this contract is contingent upon the certification of availability of funds and submission of State Affirmative Action Certification.

 

7.        RESOLUTION NO. 149-02 – AUTHORIZATION TO APPLY FOR USDA FUNDING FOR WHITESBORO/EDGEWOOD SEWER - On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:
BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that approval for the Application for USDA funding for Whitesboro/Edgewood Sewer, is hereby approved.
FURTHER RESOLVED, that the appropriate officials are hereby authorized to sign said documents.

8.        RESOLUTION NO. 150-02 – AWARD OF BID – HAROLD ARENBURG, INC. – CONSTRUCTION OF PUBLIC FISHING PIER - On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, it has been deemed necessary and desirable to solicit bids for the Construction of a Fishing Pier, and
WHEREAS, sealed bids were received on May 7, 2002 at 3:30 P.M., and
WHEREAS, it appears that the following bid submitted represents a figure equal to the lowest bid received which complies with specifications.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Contract for the Construction of the Fishing Pier shall be awarded to Harold Arenburg Inc. for a total bid price of $115,618.34.
FURTHER RESOLVED, that this award is conditioned upon submission of Initial Project Workforce Report-Construction and Treasurer’s Certification of availability of funds.

 


9.        RESOLUTION NO. 151-02 – TABULATION COMMITTEE – WATER WHEEL - On motion by Mayor Doughty  seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:
BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey that Township Clerk Sharon Coco, Chief Finance Officer Tracey DeVico, Administrator James Alexis and Engineer Vincent Orlando be and hereby are appointed to tabulate the bids to be taken on May 29, 2002 at 3:00 PM in the Middle Township Municipal Building, 33 Mechanic Street, Cape May Court House, NJ for the following:

10.     RESOLUTION NO. 152-02 – AMEND 2002 BUDGET - On motion by Mayor Doughty seconded by Committeemember DeLanzo and unanimously passed on roll call, the following resolution was adopted:
WHEREAS, the local municipal budget for the year 2002 was approved on the 4th day of February, 2002 and
WHEREAS, the public hearing on said budget has been held as advertised, and
WHEREAS, It is desired to amend said approved budget, now
THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May that the following amendments to the approved budget of 2002 be made:
