I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

WHEREAS, the Township of Middle wishes to apply for the Statewide Livable Communities Pilot Program Grant, and
WHEREAS, this grant is limited to the maintenance and upgrading of open space, parks, and playgrounds;
NOW, THEREFORE BE IT RESOLVED, that the Township Committee of the Township of Middle, County of Cape May, State of New Jersey that authorization to apply for the Statewide Livable Communities Pilot Program Grant is hereby approved and that appropriate officials are hereby authorized to sign said documents.
8. RESOLUTION 310-02– AUTHORIZATION TO APPLY
FOR THE NJ DEPARTMENT OF TRANSPORTATION – FY 2002 TRANSPORTATION ENHANCEMENT
PROGRAM - On motion by Mayor Doughty seconded by Committeemember DeLanzo

WHEREAS, the Township of Middle wishes to apply for the Department of Transportation FY 2002 Transportation Enhancement Program through the Livable Communities Pilot Program, and
WHEREAS, this grant applies to specific projects that were not funded through the TEA-21 monies;
NOW, THEREFORE BE IT RESOLVED, the Township Committee of the Township of Middle, County of Cape May, State of New Jersey that authorization to apply for the NJ Department of Transportation 2002 Transportation Enhancement Program is hereby approved and that appropriate officials are hereby authorized to sign said documents.
9. RESOLUTION 311-02– AUTHORIZATION TO APPLY
FOR STATEWIDE LOCAL DOMESTIC PREPAREDNESS EQUIPMENT GRANT PROGRAM - On
motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll
call, the following resolution was adopted
WHEREAS, the Township of Middle wishes to apply for the Statewide Local Domestic Preparedness Equipment Grant, and
WHEREAS, the purpose of this new program is to make grant funding available to municipalities in order to purchase domestic preparedness equipment for police, firefighters, and emergency medical services personnel.
NOW, THEREFORE BE IT RESOLVED, that the Township Committee of the Township of Middle, County of Cape May, State of New Jersey is hereby authorized to apply for the Statewide Local Domestic Preparedness Equipment Grant is hereby approved and that appropriate officials are hereby authorized to sign said documents.
10. RESOLUTION 312-02 – APPROVE APPLICATION FOR DEPARTMENT OF COMMUNITY AFFAIRS—FY 2003
SPECIAL GRANT REQUEST – STATEWIDE LOCAL ADA COMPLIANCE - On motion by Mayor
Doughty seconded by Committeemember
DeLanzo and passed on roll call, the following resolution was adopted
WHEREAS, the Township of Middle wishes to apply for the Statewide Local ADA Compliance Grant, and
WHEREAS, this grant will be utilized for the Martin Luther King Center, the Head Start building, and the Middle Township Police Department;
NOW, THEREFORE BE IT RESOLVED, by the Township Committee, governing body of the Township of Middle, County of Cape May, State of New Jersey, that approval for the application of the Statewide Local ADA Compliance Grant through the Department of Community Affairs is hereby approved and that appropriate officials are hereby authorized to sign said documents.
11. RESOLUTION 313-02– MIDDLE TOWNSHIP ANNUAL FREE YARD SALE - On motion by Mayor Doughty
seconded by Committeemember DeLanzo and passed on roll call, the following
resolution was adopted
WHEREAS, the Township of Middle supports the Annual Wings and Water Festival held by the Wetlands Institute, and
WHEREAS, the residents of the Township of Middle are permitted to hold an Annual Yard Sale with no charge to the residents for that weekend only;
NOW, THEREFORE BE IT RESOLVED, that Township Committee in the Township of Middle, County of Cape May, do hereby authorize the Annual Free Yard Sale to be held September 21-22, 2002 in the Township of Middle
12. RESOLUTION 314-02– DESIGNATING SEPTEMBER
23-29 AS RACE EQUALITY WEEK - On motion by Mayor Doughty seconded by
Committeemember DeLanzo and passed on roll call, the following resolution was
adopted
WHEREAS, the National League is committed to promoting racial equality and justice as a fundamental aspect of a healthy community, and
WHEREAS, the National League of Cities has urged local officials across the country to join together in a national campaign to promote racial equality and justice, and
WHEREAS, by act of Congress of the United States dated July 2, 1964, the Civil Rights Act of 1964 was adopted banning discrimination because of a person’s color, race, national origin, religion, or sex, and
WHEREAS, by act of Congress of the United States dated July 9, 1868, the 14th Amendment of the Constitution of the United States giving all persons born or naturalized in the United States the right to due process and equal protection under the law, and
WHEREAS, National League of Cities President Karen Anderson, mayor of Minnetonka, Minnesota, has invited local officials across the country to renew their commitment to ensuring racial equality and justice for all beginning on September 23, 2002, by reporting on successful programs and announcing specific actions plans for the coming year
13. RESOLUTION 315-02– INDICATING SUPPORT FOR A
CAPE MAY COUNTY ANIMAL SHELTER - On motion by Committeemember Leusner seconded by Mayor Doughty and passed on roll
call, the following resolution was adopted
WHEREAS, municipalities in the State of New Jersey are required to provide for public health, safety and welfare, and
WHEREAS, the presence of stray, unwanted and/or potentially dangerous animals is identified by the State of New Jersey as a potential public health threat, and
WHEREAS, the State of New Jersey requires that all municipalities provide for Animal Control and subsequent sheltering of stray, unwanted, and/or potentially dangerous animals, and
WHEREAS, the number of licensed animal shelters in the County of Cape May is inadequate, and
WHEREAS, the County of Cape May has proposed to construct an animal shelter facility and make “Animal Sheltering Services” available to municipalities through the means of an Interlocal Agreement, and
WHEREAS, as the Township Committee of the Township of Middle requests that the County of Cape May identify other sources of revenue that can be applied to the annual operating budget of the proposed Cape May County Animal Shelter. The additional funds to be applied to the operating budget for the Cape May County Animal Shelter could be diverted from surplus, Aramark lease, user fees for the shelter, and/or any other source of funds controlled by the County of Cape May, thus reducing proportionately the financial impact on each municipality.
NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey that this resolution be forwarded to the Board
14. RESOLUTION 316-02 – AWARD OF BID – HOUSING
REHAB #99-7 - On motion by Committeemember Leusner seconded by
Committeemember DeLanzo and passed on roll call, the following resolution was
adopted
WHEREAS, it has been deemed necessary and desirable to solicit bids for Housing Rehab Contracts #99-7, and
WHEREAS, the contract 99-7 is for the Laverne Kee residence located at 81 Indian Trail, Cape May Court House, NJ 08210, and
WHEREAS, sealed bids were received on August 26, 2002 at 10:00 A.M., and
WHEREAS, it appears that the following bids submitted represents a figure equal to the lowest bid received which complies with specifications.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Contract for the Housing Rehab Contract No. 99-7 shall be awarded to Gemini Building for a total bid price of:

FURTHER RESOLVED, that this award is conditioned certification of availability of funds and submission of appropriate affirmative action form.
15. RESOLUTION 317-02 – SUPPORTING THE CONCEPT
OF A UNIVERSAL HAND SIGNAL TO BE USED BY CHILDREN IN NEED OF HELP - On
motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following
resolution was adopted
WHEREAS, there is an alarming increase in the number of children who have been abducted, assaulted and some even tragically murdered during the past several months, and
WHEREAS, these abductions constitute a national crisis and demands the immediate attention of all citizens, as well as all those employed in the law enforcement community and in the public sector, in order to remedy this crisis and to preserve and protect our children as our most important and cherished resource, and
WHEREAS, to effectively prevent such abductions and the resulting harm that comes about, it is imperative that all our citizens be constantly vigilant for any signs or evidence pertaining to the abduction of children to the end that such abductions can be eliminated or, at the very least, that children can be recovered expeditiously and with a minimal amount of fear and trauma, and
WHEREAS, it is also important that all those individuals who would prey upon our children be apprehended and prosecuted to the fullest extent permitted by law, and
WHEREAS, this resolution is in support
of the Township of Upper Resolution No. 217-8-2002 adopted August 26, 2002, and
WHEREAS, the Township Committee of the Township of
Middle views this as a most worthwhile and constructive suggestion, which can
be easily taught and understood by our children and which the means to
communicate that need in a way that is likely to provide much needed help and
assistance and in a timely fashion.

17. RESOLUTION 319-20 – LOCAL FINANCE BOARD –
ANNUAL AUDIT OF BOOKS, ACCOUNTS, & TRANSACTIONS - On motion by
Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll
call, the following resolution was adopted
WHEREAS, N.J.S.A. 40A:5-4 requires that governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and
WHEREAS, The Annual Report of Audit for the year 1979 has been filed by a Registered Municipal Accountant with the Township Committee and also James Alexis, Township Clerk, as per the requirements of N.J.S. 40A:5-6, and a copy has been received by each member of the governing body, and
WHEREAS, The Local Finance Board has promulgated a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled:

Recommendations
and
WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled:

Recommendations
As evidenced by the group affidavit form of the governing body, and
WHEREAS, such resolution of certification shall be adopted by the governing body no further than forty-five days after the receipt of the annual audit, as per the regulations of the Local Finance Board, and
WHEREAS, all members of the governing body have received and have familiarized themselves with at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed o the affidavit, as provided by the Local Finance Board, and
WHEREAS, failure to comply with the promulgations of the Local Finance Board of the State of New Jersey may subject he members of the local governing body to the penalty provisions of R.S. 52:27BB-52 – to wit:
R.S. 52:27BB-52 – “ A local officer of member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than One Thousand Dollars( $1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office.”
NOW, THEREFORE BE IT RESOLVED, that the Township Committee of the Township of Middle,
hereby states that it has complied with the promulgation of the Local Finance Board of the State of New Jersey dated July 30, 1968 and does hereby submit a certified copy of this resolution and the required affidavit to said board to show evidence of said compliance.
18. RESOLUTION 320-02 – APPROVE RETURN FROM FAMILY LEAVE – JENNIFER GRAHAM - On
motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll
call, the following resolution was adopted
BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the Family Leave for Jennifer Graham has ended and authorization for return to work on September 4, 2002 has been approved.
19. RESOLUTION 321-02 – RESCINDING RESOLUTION
#283-02 AND APPROVING AMENDED RESOLUTION IDENTIFYING CDBG FAIR HOUSING
OFFICER—FR 2003 SMALL CITIES PROGRAM—ADDITION TO MARTIN LUTHER KING CENTER IN
WHITESBORO - On motion by Mayor Doughty seconded by Committeemember DeLanzo
and passed on roll call, the following resolution was adopted
WHEREAS, Middle Township is rescinding Resolution #283-02 adopted August 19, 2002, and
WHEREAS, Middle Township is applying for a Small Cities Community Development Block Grant from the New Jersey Department of Community Affairs to construct an addition to the Martin Luther King Community Center in Whitesboro, and
WHEREAS, Middle Township must make efforts to affirmatively further fair housing; and
WHEREAS, Middle Township has reviewed various actions that would be acceptable to the New Jersey State Department of Community Affairs and the U.S. Department of Housing and Urban Development; and
WHEREAS, Middle Township has made assurances in the grant agreement that:
(1) It will comply with the Housing and Community Development Act of 1974, as amended, and regulations issued thereto; and
(2) It will comply with the Civil Rights Act of 1964 and the regulations issued thereto it; and
(3) It will comply with the Fair Housing Act of 1968 and will affirmatively further fair housing; and
(4) It will comply with the Age Discrimination Act of 1975 and with the Rehabilitation Act of 1973.
NOW THEREFORE BE IT RESOLVED, that Tracey DeVico Taverner shall be designated as the Fair Housing Officer for Middle Township; and
BE IT FURTHER RESOLVED that the Fair Housing Officer shall contact USHUD Regional Office of Housing and Equal Opportunity and the NJ Division on Civil Rights, inform those agencies of his/her appointment as Fair Housing Officer and request Fair Housing Information, and
BE IT FURTHER RESOLVED that the Fair Housing Officer shall provide fair housing advisory services and assistance and referral advice to persons requesting such assistance from Middle Township, and
BE IT FURTHER RESOLVED that Middle Township will publish in the local newspaper of record and post at the municipal building a public notice announcing the appointment of the Fair Housing Officer and the availability of local fair housing services.

29. REPORTS -- The Treasure submitted her summary of Account Reconciliation for the months of July and August 2002. Other monthly reports submitted for August 2002 are the Construction Office, Zoning Office, Clerk’s Office, Municipal Court and Tax Collector’s Office.

33. RESOLUTION – APPROVE TEMPORARY TRAILER –
McCANN FAMILY - On motion by Committeemember Leusner seconded by
Committeemember DeLanzo and passed on roll call, the following resolution was
adopted
WHEREAS, on September 3, 2002 the home of Kathleen and George McCann, located at 307 Ridge Road Green Creek, suffered extensive fire damage, and
WHEREAS, South Jersey Adjustment Bureau, Inc. have requested permission to set up temporary housing (trailer) on their property while their home is being replaced or repaired.
NOW THEREFORE BE IT RESOLVED, that authorization for placement of an emergency trailer be and is hereby granted by the Township Committee, the governing body of the Township of Middle.
FURTHER RESOLVED, that the trailer may remain for a six (6) month time period.
FURTHER RESOLVED, that approval of said trailer is contingent upon compliance with safety requirements set forth by the Construction Official and compliance with all other regulatory agencies.
34. RESOLUTION 332-02-- TRANSFER DEPARTMENTS –
COMMUNICATIONS TO EMT FULL TIME – NANCY BURKE - On motion by
Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the
following resolution was adopted

IT RESOLVED, by the Township Committee of the Township of Middle that Nancy
Burke is hereby reassigned to EMT Full Time Position with the same salary
effective September 4, 2002.
35. PUBLIC PORTION:
Peggy Mathis – CMCH
Jim Alexis gave her an update on economy motel and said construction office is looking into permitting process with DCA. Questioned on low to moderate housing needs. Mr Alexis said we are working on our COAH requirements presently by way of housing rehab grants. Peggy praised the Shellbay Pier Project and thanked committee.
Len Pantelone – Swainton
Said he was disturbed about girls selling cookies in the neighborhood. Dr. Elder was present and asked him to get him any information so he could identify who the kids were and look to correct situation and follow policy.
Vilma Pombo – Swainton
Wanted update on Master Plan – Vince Orlando responded that they were moving along and a presentation to planning board possible in December. Environmental Commission status. Mayor Doughty said that various approaches are being considered.
Committeemember Chuck Leusner announced he would be attending future freeholder meeting with Sean McDevitt to seek reimbursement for EMS Transport at county facility.
Mayor Nate Doughty announced October 10, 2002 Golf Tournament will he held at Sand Barrens to establish scholarship fund for graduating Middle Township Seniors.
There being no further business, the meeting was adjourned at 7:50 p.m.
