I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).
The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building. Members present were Mayor Doughty, Committeemember Leusner and Committeemember DeLanzo, Clerk/ Business Administrator Alexis, Attorney Gorman, Engineer Orlando, & Deputy Clerk Kimberly Tomkinson.
1. PRESENTATION BY DENNIS ROBERTS –
On behalf of Dennis Roberts of the Bellevue Tavern and his family a check
was presented to Township Committee for the Middle Township Recreation
Department in the amount of $3,000.00 from the proceeds of the 8th
Annual Golf Tournament. Also, Mr. Roberts presented a check to Mr. Blanks of
the Concerned Citizens of Whitesboro for the Whitesboro Recreation Center.
Committee announced their sincere thanks to the Roberts and commented on the
$35,000.00 received on behalf of the Township Recreation Department over the
last 8 years. Mr. Blanks thanked Mr. Roberts for his generosity and spoke of
the Belleview Tavern Scholarship that the Concerned Citizens present to the
Students of Middle Township.
2. ORDINANCE NO. 1138-03 – AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 236, VEHICLES AND TRAFFIC; ARTICLE VI, SCHEDULES; SCHEDULE I: SPEED LIMITS – Following second reading, hearing, and consideration for adoption, Ordinance 1138-03 was adopted on motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call. Complete Ordinance is on file in the Clerk’s Office.
3. RESOLUTION NO. 359-03 – SUPPORTING CONTINUATION OF THE “PROPERTY TAX REIMBURSEMENT PROGRAM” AS INITIALLY CONTEMPLATED AND IMPLEMENTED – SUPPORTING ASSEMBLY BILL #3627 – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.
WHEREAS, as the property tax burden increase under inflationary pressures, Senior Citizens on fixed incomes find it increasingly difficult to meet all of their financial obligations; and
WHEREAS, one of the favorable ways the State of New Jersey assisted Senior Citizens was to establish the “Property Tax Reimbursement Program” , which froze property taxes by reimbursing qualified New Jersey resident property owners for property tax increases; and
WHEREAS, the State of New Jersey has decided that it could not afford to fund the “Property Tax Reimbursement Program” this year due to other fiscal priorities, thus eliminating the relief the State had previously instituted under this program; and
WHEREAS, Joe Pennacchio, Assemblyman of the 26th New Jersey legislative district has introduced legislation identified as A-3627, that strives to remove the income level eligibility to receive a Homestead Property Tax Reimbursement; and
WHEREAS, the Township of Middle values its Senior Citizens and desires to see them enjoy the benefits of the remedial purposes that gave rise to the original “Property Tax Reimbursement Program” as well as those that have inspired Assemblyman Pennacchio’s legislation; so
NOW THEREFORE BE IT RESOLVED, by the Township Committee, of the Township of Middle, County of Cape May, governing body thereof, that we call upon the State of New Jersey to return to the original “Property Tax Reimbursement Program” and restore the necessary funding to make this possible for our Senior Citizens. The Township of Middle hereby communicates its support of Assembly Bill A-3627, introduced by Joe Pennacchio, Assemblyman of the 26th Legislative District, which would render more Senior Citizens eligible for a property tax freeze.

RESOLUTION NO. 360-03 – APPROVE ADOPT A SPOT GRANT – On
motion by Committeemember Leusner seconded by Mayor Doughty and passed on roll
call, the following resolution was adopted.

RESOLUTION NO. 361-03 – APPROVE APPLICATION FOR RAFFLE
LICENSE – CASINO NIGHT – BISHOP MCHUGH REGIONAL CATHOLIC SCHOOL PTA – On
motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll
call, the following resolution was adopted.
WHEREAS, Bishop McHugh Regional Catholic School PTA has applied to Legalized Games of Chance Control Commission for a Raffle License to conduct a “Casino Night”, and
WHEREAS, the location will be at, 1170 Golf Club Road, Cape May Court House, NJ 08210, otherwise known as Wildwood Country Club, has been approved by the Middle Township Committee as an Amusement Game Zone, and
WHEREAS, the Department of Law and Public Safety, Division of Consumer Affairs, Legalized Games of Chance Control Commission, determines fees and rules of conduct,
WHEREAS, the proper application and fee have been received.

RESOLUTION NO. 362-03 – APPROVE APPLICATION FOR RAFFLE

adopted.

RESOLUTION NO. 365-03 – APPROVE REQUEST FOR MEDICAL
LEAVE – HARRY MICHAEL LAWRENCE – On motion by Mayor Doughty seconded by

and passed on roll call, the following resolution was adopted.
BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the request for medical leave for Harry Michael Lawrence with dates indicated on attached schedule is hereby approved.

RESOLUTION NO. 366-03 – ORDER REMOVAL OF VEHICLES FROM
MUNICIPAL PARKING LOT – HARVEST FESTIVAL – On motion by Committeemember
DeLanzo seconded by Committeemember Leusner and passed on roll call, the
following resolution was adopted.
BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that an Order to Remove Vehicles from the Municipal Parking Lot from the close of business on Friday October 24, 2003 until 7:00 AM on Sunday October 26, 2003 for the Harvest Festival is hereby approved.

RESOLUTION NO. 367-03 – RATIFY PROMISE OF DEFENSE AND
INDEMNIFICATION AGREEMENT WITH CAPE MAY COUNTY FOR USE OF COUNTY PARKING LOT –
HARVEST FESTIVAL – On motion by Committeemember DeLanzo seconded by
Committeemember Leusner and passed on roll call, the following resolution was
adopted.
BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Promise Of Defense And Indemnification Agreement between the County of Cape and the Township of Middle for the use of the County Parking Lot on October 25, 2003 for the Harvest Festival, be and is hereby ratified.
FURTHER RESOLVED, that the appropriate officials are hereby authorized and directed to sign said agreement.

RESOLUTION NO. 368-03 – ADOPTING POLICY REGARDING
POLITICAL ACTIVITIES AT HARVEST FESTIVAL – On motion by Committeemember
DeLanzo seconded by Committeemember Leusner and passed on roll call, the
following resolution was adopted.
WHEREAS the Middle Township Harvest
Festival is conducted as a celebration of the Fall Season, and
WHEREAS the Fall Season coincides with the annual election, and
WHEREAS it has been deemed necessary and desirable to keep the Middle Township
Harvest Festival free from the exigencies of the political campaigns.
NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Harvest Festival Policy annexed hereto and made a part hereof be and hereby is adopted.
POLICY RE: POLITICAL ACTIVITY AT HARVEST FESTIVAL
1. No political candidate, committee, part, organization, or other form of political entity may lease a booth at the Middle Township Harvest Festival.
2. No person or entity leasing a Harvest Festival Booth for other than political purposes may utilize that booth for political campaigning or any other form of political activity. Any person engaging in political activity from a leased booth shall be immediately ejected from the Harvest Festival.
3. In accordance with the right of assembly guaranteed by the Bill of Rights of the United States Constitution, political candidates may appear as patrons/customers of the Harvest Festival, provided that they do not set up a fixed location for campaigning on the Harvest Festival grounds.
4. No person or entity shall set up political signage within the confines of the Harvest Festival premises.

RESOLUTION NO. 369-03 – AUTHORIZATION TO CLOSE BOYD
STREET – HARVEST FESTIVAL – On motion by Committeemember DeLanzo seconded
by Committeemember Leusner
and passed on roll call, the following resolution was adopted.
BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that authorization to close the section of Boyd Street from Hand Avenue to Church Road on October 25, 2002 from 6:00 AM until 7:00 PM for the Harvest Festival is hereby approved.
14.
RESOLUTION NO. 370-03 – ALLOWING CONSUMPTION OF ALCOHOL
IN OPEN CONTAINERS AT HARVEST FESTIVAL
- On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll
call, the following resolution was adopted.
WHEREAS, the Township of Middle is conducting a “Harvest Festival” between 10:00 a.m. and 5:00 p.m. on October 25, 2003, and
WHEREAS, certain purveyors have acquired one day licenses for the sale of alcoholic beverages at said Harvest Festival, and
WHEREAS, Section 84-10 of the Code of the Township of Middle prohibits the carrying or consumption of alcoholic beverages in open containers in public areas within the Township of Middle, and
WHEREAS, it has been deemed in the best interest of the Township of Middle to permit the carrying or consumption of alcoholic beverages in an open container at the Harvest Festival.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Section 84-10 of the Code of the Township of Middle be and hereby is suspended on October 25, 2003 between the hours of 10:00 a.m. and 5:00 p.m. in the Municipal Parking Lot behind the Township Hall at 33 Mechanic Street, Cape May Court House, New Jersey.
FURTHER RESOLVED that this lifting of the fore scribed prohibition shall apply only to the time and place described above.
15.
RESOLUTION NO. 371-03 – AMENDING CAPITAL BUDGET – On
motion by Committeemember Leusner seconded by Committeemember DeLanzo and
passed on roll call, the following resolution was adopted.
WHEREAS, the local capital budget for year 2003 was adopted on the 2nd day of June, 2003, and
WHEREAS, it is desired to amend said capital budget section.
NOW THEREFORE BE IT RESOLVED, by the Township Committee, of the Township of Middle, County of Cape May, State of New Jersey, that the following amendment(s) to the capital budget section of 2003 be made.
BE IT FURTHER RESOLVED, that two (2) certified copies of this resolution be filed forthwith in the Office of the Director of Local Government Services.

372-03– APPROVING PAYMENT FOR ALL BILLS – On motion by

19. RESOLUTION NO. 374-03 – AUTHORIZATION TO
APPLY FOR 2004 LIVABLE COMMUNITY GRANT – ADA UPGRADES TO HISTORIC MUNICIPALLY
OWNED BUILDINGS – On motion by Committeemember DeLanzo seconded by
Committeemember Leusner

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that authorization to apply for the 2004 Livable Community Grant for ADA upgrades to historic municipally owned buildings is hereby approved.

22. RESOLUTION NO. 377-03 – AUTHORIZATION TO
CLOSE BENNYS LANDING – ANNUAL LUAU – On motion by Committeemember Leusner

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that authorization is given to close Benny’s Landing Road in Cape May Court House on August 23, 2002 from 4:00 PM to Midnight for the Benny’s Landing Annual Luau.
23. RESOLUTION NO. 378-03 – LOCAL PUBLIC
CONTRACT – MICHAEL J. LANGE – APPRAISAL SERVICES – On motion by

call, the following resolution was adopted.
WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and

26. RESOLUTION NO. 381-03 – REDUCTION OF
PERFORMANCE BOND – PETER W. ATKINSON – On motion by Committeemember Leusner
seconded by Committeemember DeLanzo and passed on roll call, the following
resolution was adopted.
WHEREAS, $147,227.00 is being held as a performance guarantee of Peter W. Atkinson for site improvements at Block 12.01, Lot 42.05, also known as White Sands Estates, and
WHEREAS, the Engineer has conducted his inspection and determined that improvements having a value of $32,265.00 have been completed, and
WHEREAS, the Zoning Official has recommended that the performance guarantee for the above stated project be reduced to $114,962.00.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Tri-Party Allocation Category Agreement at Sturdy Savings Bank be and is hereby reduced to $114,962.00
27. RESOLUTION NO. 382-03 – RELEASE PERFORMANCE
BOND – EASTERN SHORES DEVELOPING INC. – On motion by Committeemember
Leusner seconded by Committeemember DeLanzo and passed on roll call, the
following resolution was adopted.
WHEREAS, $9,297.81 is being held as a Performance Guarantee for Eastern Shores Developing Inc. for site plan improvements for an extension of Cherry Street, Green Creek and
WHEREAS, the Engineer for the Township of Middle has conducted his inspection and certified that all improvements have been completed, and
WHEREAS, the Zoning Officer for the Township of Middle has recommended that the performance bond be released, and
WHEREAS, the Land Use Law of the State of New Jersey (NJS 40:55D-1 et seq) requires such a release upon recommendation by the Township Engineer,
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Account No. 72000 82674 with Commerce Bank in the name of Eastern Shores Developing Inc. be and is hereby released.

WHEREAS, certain monies held in Trust Accounts from time to time may have balances remaining after all fees have been paid, and
WHEREAS, the applicants are entitled to a refund of this money,

30. RESOLUTION NO. 385-03 – AUTHORIZING
EMPLOYEE TRANSFER BETWEEN DEPARTMENTS PUBLIC WORKS TO SEWER AND WATER – MICHAEL
GABRYS – On motion by Mayor Doughty seconded by Committeemember Leusner and
passed on roll call, the following resolution was adopted.
BE
IT RESOLVED, by the Township Committee of the Township of Middle that Michael
Gabrys is hereby reassigned to Sewer and Water Department with the same salary
effective September 1, 2003.
31. RESOLUTION NO. 386-03 – SOCIAL AFFAIRS
PERMIT – THE WETLANDS INSTITUTE – On motion by Committeemember Leusner
seconded by Committeemember DeLanzo and passed on roll call, the following
resolution was adopted.
WHEREAS, The Wetlands Institute has applied for approval to sell alcoholic beverages at a Fundraiser to be held at The Wetlands Institute, 1075 Stone Harbor Blvd., Stone Harbor, on September 17, 2003 from 6 p.m. to 10 p.m., and
WHEREAS, they have provided proper documentation to the Township of Middle,
NOW, THEREFORE BE IT RESOLVED, that the Township Committee, in the Township of Middle, does hereby approve the Social Affairs Permit.
32. RESOLUTION NO. 387-03 – CLOSED SESSION –
NON – PERSONNEL CONTRACT NEGOTIATION – On motion by Committeemember Leusner
seconded by Committeemember DeLanzo and passed on roll call, the following
resolution was adopted.
WHEREAS, the section of the Open Public Meetings Law, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, the Township Committee of the Township of Middle, the governing body thereof, is of the opinion that such circumstances presently exist,
NOW THEREFORE BE IT RESOLVED, by the Township of Middle, County of Cape May, State of New Jersey:
1. The public shall be excluded from the discussion of an action upon the hereinafter specified matter: NON-PERSONNEL CONTRACT NEGOTIATION.
2.
The general nature of the subject matter to be discussed is as

WIRELESS AIRPLANE SPORTS PILOT OFFICE OF CAPE MAY COUNTY – On motion by
Committeemember Leusner seconded by Mayor Doughty and passed on roll call, the

PUBLIC COMMENT:
Mayor Doughty
commented on the Benny’s Landing Annual Luau on August 23, 2003. He informed
the public that you do not have to be a resident of Benny’s Landing to attend.
There is plenty of food, music and fun for all.
Committeemember
DeLanzo announced that the summer camps at the Goshen Sports Complex and the
Whitesboro Recreation are coming to a close in about a week or so.
Committeemember
Leusner asked Committeemember DeLanzo about the Clam Bake held by the
Historical Society at the 4-H Fairgounds.
Committeemember
DeLanzo stated that it went very well.
Debbie Holsworth –
future resident of Sand Castle Cove – asked about the status of the
development.
Bruce Gorman
informed Mrs. Holsworth that a 3 way tentative agreement has taken place with
Chris Barone and that he anticipates Mr. Barone moving by the end of the week.
He stated that this is good news and hopes to see signed papers in a couple of
days.
Mayor Doughty stated that there were 12
people at a recent meeting concerning this development… Mayor Doughty and Kathy
Meers were among two of them. Barone agreed to the Mayor’s ideas and requested
15-20 days to make corrections.
D. Holsworth – Asked
if after the completion of the repairs if the work will again be videotaped?
Mayor Doughty – yes
Terry Allen – asked
about the possible plans to fix Norbury’s Landing?
James Alexis –
stated that this is a ongoing project between the County and the Township. A
material list has been sent to the County of Cape May to start the mending of
the bulkhead.
Mr. Allen – How do
we push the idea?
