I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner and Committeemember DeLanzo, Clerk/ Business Administrator Alexis, Attorney Gorman, Engineer Orlando, & Deputy Clerk Dawn Stimmel

 

 

1.          ORDINANCE NO. 1140-03 – AUTHORIZING THE ACQUISITION OF BLOCK 937 LOT(S) 21, 23 OF THE TAX MAP OF THE TOWNSHIP OF MIDDLE – On motion by Committeemember Leusner seconded by Mayor Doughty and passed on roll call, Ordinance No 1140-03 passed first reading. Second reading, public hearing and consideration for adoption will be held on 10/06/2003 at 6:00 p.m.

                                                                      

2.          RESOLUTION NO. 389-03 – MIDDLE TOWNSHIP ANNUAL FREE YARD SALE – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Township of Middle supports the Annual Wings and Water Festival held by the Wetlands Institute, and

WHEREAS, the residents of the Township of Middle are permitted to hold an Annual Yard Sale with no charge to the residents for that weekend only;

NOW, THEREFORE BE IT RESOLVED, that Township Committee in the Township of Middle, County of Cape May, do hereby authorize the Annual Free Yard Sale to be held September 13-14, 2003 in the Township of Middle

 

3.          RESOLUTION NO. 390-03 – AWARD OF BID – DR. MARTIN LUTHER KING CENTER – SMALL CITIES ADDITION – FABBRI BUILDERS – ALTERNATES 2 AND 3 – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

WHEREAS, it has been deemed necessary and desirable to solicit bids for the Small Cities Additions to the Dr. Martin Luther King Center in the Township of Middle, and

WHEREAS, bids were received on July 10, 2003, at 2:00 PM

WHEREAS, it appears that Fabbri Builders has submitted the lowest responsible bid.

WHEREAS, Resolution No. 328-03 was awarded for a purchase price that included the base bid,  Alternate No. 4, 7, and 10, and

WHEREAS, this resolution is for the award of Alternate No’s 2 and 3.

 

4.          RESOLUTION NO. 391-03 – AWARD OF CONTRACT – M/A COM / TEKTRON CORPORATION – UPGRADING THE CURRENT SAFETY COMMUNICATIONS SYSTEM – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

WHEREAS, there is a need to upgrade the current Public Safety Communications System for the Township of Middle, in the County of Cape May, State of New Jersey, and

WHEREAS, this can be purchased through State Contract # A53753 and State Contract # A53752, and

WHEREAS, the maximum amount of the purchase is $426,184.85 and funds are available as evidenced by the Chief Financial Officer's Certification; and

WHEREAS, public bids are not required when the purchase is under State Contract in accordance with 40A:11-12 of the Local Public Contracts Law.

NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Chief Finance Officer is hereby authorized and directed to approve and forward the following Purchase Order’s to:

PO #1 for Radio Infrastructure:                   M/A COM in care of TekTron     $217,904.33

5.          RESOLUTION NO. 392-03 – TABULATION COMMITTEE – TAX REVALUATION – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey that Township Clerk/Administrator James Alexis, Chief Finance Officer Tracey DeVico, Tax Assessor Joseph Ravitz, and Deputy Clerk Kimberly Tomkinson be and hereby are appointed to tabulate the bids to be taken on November 17, 2003 at 10:00 a.m. in the Middle Township Municipal Building, 33 Mechanic Street, Cape May Court House, NJ at the 2nd Floor Conference Room for the following:

6.          RESOLUTION NO. 393-03 – CONFIRMATION OF SALE OF LAND – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Township Committee, the Governing Body of the Township of Middle, by proper resolution, directed that a public sale be held at the meeting room, 33 Mechanic Street, Cape May Court House, N.J., and that certain lands and premises owned by, and situated within, the Township of Middle, County of Cape May, State of New Jersey, be sold, as follows:

Resolution No.: 198-03                              Adopted: May 5, 2003          Sale Date: May 28, 2003

WHEREAS, said public sale was held at the above time and place, and said premises were sold to the highest bidder, as follows:

WHEREAS, said highest bidder has requested that said lands and premises be conveyed as follows:

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, that the sale of said premises, upon the above consideration, be and is hereby confirmed, and the Mayor and Clerk of the Township of Middle are hereby authorized and directed to convey said premises as directed by said highest bidder, by Bargain and Sale Deed, free and clear of all taxes up to and including the calendar quarter during which said sale was held.

 

7.          RESOLUTION NO. 394-03 – RELEASE OF PERFORMANCE BOND – STREET OPENING – GABRIEL ROSICA – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, $5,000.00 is being held as a performance guarantee for Gabriel Rosica for a street opening located at 100 E. Pennsylvania Ave, Rio Grande (No. 14-03), and

WHEREAS, after completion of the above referenced opening (No. 14-03), permission was granted to roll the bond posted as a performance guarantee for Gabriel Rosica for a street opening located at 107 Walsh Ave., Rio Grande (45-03), and

WHEREAS, the Township Administrator has conducted his inspection and determined that all improvements have been completed, and

WHEREAS, it has been recommended that the performance guarantee for the above stated projects be released.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the $5,000.00, be and is hereby released.

 

8.          RESOLUTION NO. 395-03 – AUTHORIZE APPLICATION – CONTINUATION FUNDING FOR SAFE AND SECURE COMMUNITIES PROGRAM – GRANT P-2788 – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that approval for the application for the Safe and Secure Communities Program (Grant P-2788) be and is hereby approved.

FURTHER RESOLVED, that Police Chief Joseph Evangelista is named as the Contact Person and that the appropriate officials are hereby authorized to sign said documents.

 

9.          RESOLUTION NO. 396-03 – APPROVING PAYMENT FOR ALL BILLS – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for all bills is hereby approved.

 

10.      RESOLUTION NO. 397-03 – LOCAL PUBLIC CONTRACT – MICHAEL LANGE – APPRAISAL SERVICES – BLOCK 937 LOTS 21 & 23 – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and

WHEREAS, the Township of Middle requires said services and funds are available for said purpose,

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following person is hereby appointed to the position designated below for the period beginning on August 28, 2003 through completion of the project.

BE IT FURTHER RESOLVED, that a contract be executed by the Township of Middle with the following person to supply professional services for the period from August 28, 2003 through completion of the project.

BE IT FURTHER RESOLVED that a copy of this Resolution be published in the Herald-Times as required by law.

FURTHER RESOLVED that this contract is contingent upon the certification of availability of funds and submission of State Affirmative Action Certification.

11.      PUBLIC COMMENT:

 

 

Deputy Mayor Leusner commented on the Quails Concert held at the Performing Arts Center. He stated how wonderful the performance was.

 

Mayor Doughty informed the public that on August 22, 2003 a specimen tested positive for West Nile Disease in Seaville.

 

James Alexis stated that he had spoke with Judy Hansen at the Cape May County Mosquito Commission and aerial spraying is to take place in North Cape May Court House areas.

 

Mayor Doughty read into record “Spout Off” from Cape May County Herald regarding Wetlands Institute.

 

Mayor Doughty commented on the ground breaking at the new Animal Shelter. He stated it was a nice event.

 

Committeemember DeLanzo commented on the ground breaking at the Martin Luther King Center. Commissioner Bass Levin could not make it. They will be holding a ceremony after building is complete.

 

Bruce Gorman stated that the Sandcastle Cove Development issue is completely resolved.

 

Committeemember Leusner stated that he would like to have a meeting to adopt the Township Seal. This has never been done.

 

Committeemember DeLanzo commented on the Atlantic Cape Community College Lighthouse Event that took place last Friday. Only 77-80 people attended and only 3 lighthouses were sold. A.C.C.C. wants to put lighthouses on display at the Hamilton Mall. Committeemember DeLanzo spoke with Anthony McCurdy and he stated that he was interested in marketing our 2 lighthouses. This must be approved be resolution.
