I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner and Committeemember DeLanzo, Clerk/Business Administrator Alexis, Attorney Gorman, Engineer Orlando, Deputy Clerk Kimberly Tomkinson.

1.       RESOLUTION NO. 68-03 – PROMOTION –POLICE DEPARTMENT - On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the following employees in the Middle Township Police Department is hereby promoted to the titles opposite their name at the following salaries:

2.       PRESENTATION: Blue Star Presentation by Rudy Callendar on behalf of the American Legion.

 

3.       RESOLUTION NO. 69-03 – PERSON TO PERSON TRANSFER OF MOBILE HOME PARK LICENSE NO. 2 – GRANDE WOODS SOUTH - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, Jobin Enterprises is the holder in good standing of Mobile Home License # 2, Grande           Woods South Mobile Home Park located on Block 1436, Lots 17.02, 17.03, 23.84, & 18.02, also known as 3170 Rte 9 South, Rio Grande , and

WHEREAS, Jobin Enterprises has made application to transfer Mobile Home Park License # 2 to Grande Woods South, LLC, and

WHEREAS, all legal requirements for said transfer have been fulfilled.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Mobile Home Park License # 2 be and hereby is transferred from Jobin Enterprises to Grande Woods South, LLC.

 

4.       RESOLUTION NO. 70-03 – PERSON TO PERSON TRANSFER OF MOBILE HOME PARK LICENSE NO. 3 – GRANDE WOODS NORTH - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, Hafte, Davis, Piarulli is the holder in good standing of Mobile Home License # 3, Grande Woods North Mobile Home Park located on Block 1436, Lot 17.01, also known as 3160 Rte 9 South, Rio Grande, and

WHEREAS, Hafte, Davis, Piarulli has made application to transfer Mobile Home Park License # 3 to Grande Woods North, LLC, and

WHEREAS, all legal requirements for said transfer have been fulfilled.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Mobile Home Park License # 3 be and hereby is transferred from Hafte, Davis, Piarulli to Grande Woods North, LLC.

 

5.       MATTER OF DISCUSSION – Transferring Township Tax Lien to Casaba Real Estate Holding Company – Stewart Kay Esquire spoke representing his client Casaba Real Estate Holding Co.. Mr Kay stated that he received the correct amount from the Collector’s office to redeem the lien and was presenting his idea to Township Committee. Committee commented they did not foresee any problem with transferring the lien to his client.

 

6.       ORDINANCE NO. 1121-03 – GRANTING PERMISSION TO APPLIED WASTEWATER MANAGEMENT INC. TO OPERATE EQUIPMENT, PIPES AND MAINS FOR THE OPERATION OF A WASTEWATER COLLECTION, TREATMENT AND DISPOSAL SYSTEM WITHIN AN AREA LOCATED WITHIN THE CONFINES OF THE TOWNSHIP OF MIDDLE, CAPE MAY COUNTY, NEW JERSEY AS FURTHER DESIGNATED HEREIN – Following second reading, hearing, and consideration for adoption, Ordinance 1121-03 was adopted on motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call. 7.       ORDINANCE NO. 1122-03 – ESTABLISHING THE COMPENSATION OF THE OFFICERS AND EMPLOYEES OF THE TOWNSHIP OF MIDDLE - Following second reading, hearing, and consideration for adoption, Ordinance 1122-03 was adopted on motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call. 8.       ORDINANCE NO. 1123-03 – AMENDING CHAPTER 250, “ZONING” OF THE CODE OF THE TOWNSHIP OF MIDDLE - Following second reading, hearing, and consideration for adoption, Ordinance 1123-03 was adopted on motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call. Complete Ordinance is on file in the Clerk’s Office

 

9.       ORDINANCE NO. 1124-03 – AMENDING CHAPTER 218, SUBDIVISION OF LAND AND SITE PLAN REVIEW, OF THE CODE OF THE TOWNSHIP OF MIDDLE - Following second reading, hearing, and consideration for adoption, Ordinance 1124-03 was adopted on motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call. Complete Ordinance is on file in the Clerk’s Office

 

10.    ORDINANCE NO. 1125-03 – VACATING A PORTION OF WILDWOOD, CENTRAL, AND MAURICE AVE. AS SHOWN ON SHEET 29.02 OF THE TAX MAP OF TWP OF MIDDLE – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, Ordinance No. 1125-03 passed first reading. Second reading, public hearing and consideration for adoption will be held on March 17, 2003 at 6:00 p.m.

 

11.    RESOLUTION NO. 71-03 – AUTHORIZE CANCELLATION OF LIABILITY – RESERVE FOR REVALUATION - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS,  a $47,120.69 liability is reflected on the balance sheet as Reserve for Revaluation;

WHEREAS, the Township of Middle wishes to cancel this liability;

THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof; that said $47,120.69 liability be cancelled and transferred to surplus.

 

12.    RESOLUTION NO. 72-03 – APPROVAL FOR PAYMENT TERMINAL LEAVE – NORMAN LOCHTEN - On motion by Committeemember Leusner seconded by Committeemember DeLanzo        and passed on roll call, the following resolution was adopted.

WHEREAS, Norman Lochten has submitted his retirement forms with an effective date of March 1st, 2003, and

WHEREAS, it is the policy of Middle Township to compensate retiring employees for accumulated sick, vacation, and personal time, and

WHEREAS, final payment is requested to be made during the month of March 2003, in two payments; March 4th and March 21st, and

WHEREAS, the personnel office has provided sufficient documentation verifying the amount of time accumulated and the Finance Officer has certified that time,

NOW THEREFORE BE IT RESOLVED by the Township Committee, the Governing Body of the Township of Middle, County of Cape May, State of New Jersey that payment be issued to the employee in the amount referenced below.

15.    RESOLUTION NO. 75-03 – EMERGENCY TEMPORARY BUDGET - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, an emergent condition has arisen and no adequate provision has been made in the 2003 temporary appropriations for the aforesaid purpose; and NJSA 40A:4-20 provides for the creation of an emergency appropriation for the purpose above mentioned, and

WHEREAS, the total emergency temporary resolutions adopted in the year 2003 pursuant to the provisions of Chapter 96 PL 1951 (NJSA 40A:4-20) including this resolution total  $68,300.

NOW THEREFORE BE IT RESOLVED (not less than two-thirds of all members thereof affirmatively concurring) that in accordance with NJSA 40A:4-20

  1. An emergency temporary appropriation be and the same is hereby made in the amount of  $68,300.

That said emergency temporary appropriation shall be provided for in the 2002 budget under the title of:
