I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).
The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building. Members present were Mayor Doughty, Committeemember Leusner and Committeemember DeLanzo, Clerk/ Business Administrator Alexis, Attorney Gorman, Engineer Orlando, & Deputy Clerk Dawn Stimmel
1. PRESENTATION – NATIONAL POW / MIA RECOGNITION DAY – THURSTON ELMER WOOD POST # 198
Ted Behr, State Commander, along with members of the Post # 198 presented Township Committee with a MIA/POW Day of Remembrance presentation. State Commander Behr stated that this recognition day is slated for Friday, September 19, 2003. It represents the 88,000 MIA and POW’s missing from World War II forward. There are 78,000 comrades missing from World War II alone( most lost at sea at Pearl Harbor in the Battle Ship Arizona), 126 from the Cold War, 2,000 from Vietnam,1 from the Gulf War. Their focus is that it is unacceptable for the government to leave so many solders behind.

2. BOND ORDINANCE NO. 1139-03 – PROVIDING A SUPPLEMENTAL APPROPRIATION OF $350,000.00 FOR LAND ACQUISITION IN AND BY THE TOWNSHIP OF MIDDLE, IN THE COUNTY OF CAPE MAY, NEW JERSEY AND AUTHORIZING THE ISSUANCE OF $332,500.00 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING PART OF THE APPROPRIATION. - Following second reading, hearing, and consideration for adoption, Ordinance 1139-03 was adopted on motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call. Complete Ordinance is on file in the Clerk’s Office.
3. RESOLUTION NO. 398-03 – REAFFIRMING THE REVIEW AND FINAL APPROVAL OF THE APPLICATION AND PURCHASE OF THE DEVELOPMENT EASEMENT ON THE JAMES P. HAND FARM AND APPROVING APPLICATION TO THE STATE FARMLAND PRESERVATION PROGRAM – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.
WHEREAS, the Cape May County Agriculture Development Board has granted final approval for the purchase of a Development Easement on property owned by James P. Hand, at a certified value of $6,688.89 per acre, designated as 45 acres, Block 5 Lot 44 & part of 45, also known as 456 Goshen Road, Middle Township, Cape May County, New Jersey, and
WHEREAS, the Board of Chosen Freeholders of the County of Cape May has entered into a contract to purchase said easement, and
WHEREAS, the County of Cape May, upon purchase and as owner of said easement intends to make application to the State of Agriculture Development Committee for inclusion in their program.
NOW THEREFORE BE IT RESOLVED, that the Township Committee, of the Township of Middle, County of Cape May, State of New Jersey, has reviewed the aforesaid application, pursuant to N.J.A.C. 2:76-6.10(a) 4. and in the best interest of the Township approves the application and the purchase if the development easement of the property designated as 45 acres, Block 5 Lot 44 & part of 45, Township of Middle, Cape May County, New Jersey.
BE IT FURTHER RESOLVED, the Township Committee of the Township of Middle, County of Cape May, New Jersey, approves Cape May County’s application to the State Agriculture Development Committee.
4. RESOLUTION NO. 399-03 – RELEASE OF PERFORMANCE BOND – STREET OPENING – MITCHELL NICHOLS ENTERPRISES – MICHAEL MCMENAMIN – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.
WHEREAS, $5,000.00 is being held as a performance guarantee for Mitchell Nichols Enterprises for the street opening located on Delaware Ave., Del Haven, and
WHEREAS, the Township Administrator has conducted his inspection and determined that all improvements have been completed, and
WHEREAS, it has been recommended that the performance guarantee for the above stated project be released.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the $5,000.00, be and is hereby released.
5. RESOLUTION NO. 400-03 – AUTHORIZING MAYOR TO SIGN TREATMENT WORKS APPLICATION FOR GRANDE CENTER AND WAWA – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.
WHEREAS, the Statements of Consent by Governing Body and Certification by Wastewater Conveyance System Owner are a portion of the documents that this resolution authorizes the mayor to sign on behalf of the governing body of the Township of Middle.
THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the mayor is hereby authorized to sign treatment works application for the Grande Center and Wawa.
6. RESOLUTION NO. 401-03 – APPOINTMENTS – NEW HIRES – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

9. RESOLUTION NO. 404-03 – APPROVE EXTENSION OF LEAVE - NICOLE SWEITZER – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.
WHEREAS, in accordance with the Family Leave Act and Middle Township Police Department policies, on April 21, 2003 Nicole Sweitzer was granted leave through the Family Leave Act, and
WHEREAS, on July 21, 2003 she was granted an extension until September 1, 2003 without pay.
WHEREAS, a letter received, dated August 17, 2003, requested that her maternity leave be extended, without pay, for an additional 30 days, therefore she would be returning full-time as of October 1, 2003.
BE IT RESOLVED, by the Township
Committee, the Governing Body of the Township of Middle, County of Cape May and
State of New Jersey, that the leave for Nicole Sweitzer is hereby extended
until October 1, 2003 without pay.
10. RESOLUTION NO. 405-03 – APPROVE REQUEST FOR MEDICAL LEAVE – DAWN PERDOMO – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.
BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the request for medical leave for Dawn Perdomo with dates indicated on attached schedule is hereby approved.
11. RESOLUTION NO. 406-03 – RESCINDING AWARD OF BID – D.J. ADAMS – AVALON MANOR GENERATOR REPLACEMENT – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.
WHEREAS, Resolution No. 341-03 awarded the
contract for the replacement generator for Avalon Manor in Middle Township to
D.J. Adams, and
WHEREAS, a letter has been received from
D.J. Adams stating that they have been debarred by the State of New Jersey and
no longer can provide the materials and installation requested in the bid
specifications.
NOW THERFORE BE IT RESOLVED, by the
Township Committee of the Township of Middle, State of New Jersey, that
Contract # 16 awarding the Avalon Manor Generator Replacement to D.J. Adams is
hereby rescinded.
12. RESOLUTION
NO. 407-03 – AWARD OF BID – CONTRACT
NO. 16 – AVALON MANOR, GENERATOR REPLACEMENT – SCALFO ELECTRICAL INC. – On
motion by Committeemember Leusner seconded by Committeemember DeLanzo and
passed on roll call, the following resolution was adopted.
WHEREAS, on July 2, 2003 at 10:00 a.m. bids were received for the purchase of a Generator Replacement for Avalon Manor in Middle Township, and
WHEREAS, on August 4, 2003 the bid was awarded to D.J. Adams, Inc., but do to debarment, the award must be rescinded, and
WHEREAS, the second lowest bidder, Scalfo Electrical, Inc. indicated that they are willing to perform the work for their recorded bid amount indicated below

NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Contract for the Generator Replacement for Avalon Manor in Middle Township shall be awarded to the following Contractor for the total bid price listed below:

13. RESOLUTION NO. 408-03 – APPROVE COMPUTER SERVICE AND MAINTENANCE CONTRACT – POLICE DEPARTMENT – RIO TECH SUPPORT – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.
WHEREAS, the Township of Middle wishes to renew their contract for computer service and maintenance with Rio tech Support, and
WHEREAS, this contract would be utilized for the Police Department, and
WHEREAS, the period of the contract is defined as August 19, 2003 through December 31, 2003.

17. RESOLUTION NO. 412-03 - AUTHORIZING THE CAPE MAY COUNTY DEPARTMENT OF HEALTH TO USE THE WHITESBORO RECREATIONAL CENTER AS A VACCINATION SITE AND/OR ISOLATION FACILITY IN THE EVENT OF A POST EVENT EMERGENCY INVOLVING THE RELEASE OF CHEMICAL AND/OR BIOLOGICAL AGENTS – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.
WHEREAS, the Middle Township Local Board of Health has recommended the Whitesboro Recreational Center aka Martin Luther King Center as a Vaccination Site and/pr Isolation Facility in the event of a Post Event Emergency involving the release of Chemical and/or Biological Agent, and
WHEREAS, this request has come via the Cape May County Department of Health in cooperation with the Centers for Disease Control and the New Jersey State Department of Health & Senior Services, in response to the President of the United States initiative to enhance the homeland security against potential terroristic attacks involving the use of weapons of mass destruction, working to identify potential site facilities in the event of a public health emergency involving the release of chemical or biological agents.

RESOLUTION NO. 415-03 – REINFORCING THE FREEHOLDER BOARD’S DETERMINATION TO HAVE THE TRAFFIC SIGNALS REMOVED FROM THE NEW JERSEY GARDEN STATE PARKWAY AND FORMALLY REQUESTING THE SEPARATE PHASE OPERATION AT THE THREE INTERSECTIONS UNTIL THE PROJECT IS FINALLY COMPLETE – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.
WHEREAS, Middle Township is the only municipality that host the New Jersey Garden State Parkway with traffic lights, and
WHEREAS, the Cape May County Board of Chosen Freeholders has repeatedly expresses the essential need to have the traffic lights removed from the New Jersey Garden State Parkway, and
WHEREAS, the Board has emphasized that besides the negative impact the traffic congestion caused by these lights have on the future vitality of the tourism economy in Cape May County, it presents immediate and serious safety conditions for both residents and visitors, and
WHEREAS, the Board believes the inadequate improvements to Route 47 in addition to the lack of progress on the Route 55 completion project continues to significantly contribute to the gridlock and safety problems of the traffic lights on the Garden State Parkway, and
WHEREAS, notwithstanding the Board’s efforts and determination in working with local, state, and federal officials to ultimately have all these traffic lights removed, the Board believes that there exists an immediate need to make lane expansion and improvements at Interchange 11 at the Crest Haven Complex as well as effectuate an operational change in the traffic signals by creating a separate phase for East and West Bound traffic on both Interchange 11, Interchange 10 at Stone Harbor Blvd. and Interchange 9 at Shellbay Avenue, and
WHEREAS, in the interim period awaiting the removal of the traffic lights, the Board believes that this operational change of the traffic signals is essential in reducing the immediate and serious safety conditions at the interchanges.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that it hereby formally and urgently requests that the New Jersey Highway Authority Division within the new Jersey Turnpike Authority establish an operational change in the traffic signals be creating a separate phase for East and West Bound traffic on Interchange 9 at Shellbay Avenue, Interchange 10 at Stone Harbor Blvd. and at Interchange 11 at the Crest Haven Complex.
22. RESOLUTION NO. 416-03 – APPROVE REQUEST FOR MEDICAL LEAVE – BRIAN MCDERMOTT – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.
BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the request for unpaid medical leave for Brian McDermott August 25, 2003 through August 29, 2003 and September 8, 2003 through September 12, 2003 (total of 2 weeks) is hereby approved.

RESOLUTION NO. 417-03 – AUTHORIZING COMBINATION
OF STIPEND AND BASE SALARY – BONITA MILLARD – On motion by Committeemember
Leusner seconded by Mayor Doughty and passed on roll call, the following
resolution was adopted.
BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the stipend of $999.00 for Bonita Millard as Deputy Registrar of Vital Statistics be added to her base salary as employee of the Township of Middle.
24. RESOLUTION
NO. 418-03 – SUPPORTING
SENATE BILL 838 – CLARIFIES THAT PUNITIVE DAMAGES MAY NOT BE AWARDED AGAINST
PUBLIC ENTITIES OR PUBLIC EMPLOYEES ACTING WITHIN THE SCOPE OF THEIR EMPLOYMENT
IN ANY ACTION – On motion by Mayor Doughty seconded by Committeemember DeLanzo
and passed on roll call, the following resolution was adopted.
WHEREAS,
the August 11, 2003 decision by NJ Supreme Court held that public agencies may
be required to pay punitive damages to individuals who prevail in lawsuits
brought under the Law Against Discrimination or the Conscientious Employee
Protection Acts, and
WHEREAS, when punitive damages are levied against a public sector
employer, the taxpayers, who are innocent of any wrongdoing, are the ones held
accountable, and
WHEREAS, there is pending legislation which seeks to protect our
law-abiding, taxpaying residents from such liability, and
WHEREAS, S-838 is designated to clarify that punitive damages may not be
awarded against public entities in any action.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township
of Middle, the governing body thereof, to support Senate Bill #838.

26. RESOLUTION
NO. 420-03 – APPROVE RETURN FROM
FAMILY MEDICAL LEAVE – MELISSA THOMAS – On motion by Committeemember DeLanzo
seconded by Committeemember Leusner and passed on roll call, the following
resolution was adopted.
BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the Family Medical Leave for Melissa Thomas has ended and authorization for return to work on September 8, 2003 has been approved.
27. RESOLUTION NO. 421-03 – SOCIAL AFFAIRS
PERMIT – WILDWOOD CATHOLIC HIGH SCHOOL – On motion by Committeemember

following resolution was adopted.
WHEREAS, Wildwood Catholic High School has applied for approval to sell alcoholic beverages at a Golf Tournament to be held at Stone Harbor Golf Club, 905 US Hwy Rte 9, CMCH, on October 6, 2003 from 12:00 p.m. to 5:00 p.m., and
WHEREAS, they have provided proper documentation to the Township of Middle,
NOW, THEREFORE BE IT RESOLVED, that the Township Committee, in the Township of Middle, does hereby approve the Social Affairs Permit.
28. RESOLUTION NO. 422-03 – APPROVE RETURN FROM FAMILY MEDICAL LEAVE /
PART TIME – ROBERT HODGES – On motion by Mayor Doughty seconded by
Committeemember DeLanzo and passed on roll call, the following resolution was
adopted.
WHEREAS, Mr. Hodges will return to work in half-day increments until further notice, and
WHEREAS, the medical leave program will stay in effect until Mr. Hodges returns to work full time.
BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that authorization for return to work for Robert Hodges on a half-day schedule until further notice beginning on September 8, 2003 has been approved.

BE IT RESOLVED by the Township Committee of the Township of Middle,
County of Cape May, that the Chief Financial Officer be instructed to draw
checks in the above noted amounts payable to the above mentioned parties, as a
refund of 2003 taxes.
BE IT FURTHER RESOLVED that a certified copy of this resolution be given
to the Chief Financial Officer of the Township of Middle.
30. RESOLUTION NO. 424-03 – APPROVE – ADOPT A
SPOT GRANT – On motion by Committeemember Leusner seconded by
Committeemember DeLanzo and passed on roll call, the following resolution was
adopted.
BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that a Mini Grant for the “Adopt a Spot Projects”, be and are hereby awarded to the following:

31. RESOLUTION NO. 425-03 – AUTHORIZATION TO
PURCHASE VEHICLE FROM CAPE MAY COUNTY MOSQUITO COMMISSION - On motion by Mayor Doughty seconded by
Committeemember DeLanzo and passed on roll call, the following resolution was
adopted.
WHEREAS, the Cape May County Mosquito Commission is currently in possession of a 1990 Dodge Pickup Truck which is no longer needed for public use, and
WHEREAS, it is the desire of the Cape May County Mosquito Commission to dispose of this vehicle, and
WHEREAS, the Township of Middle has expressed a desire to obtain this vehicle for official use, and
NOW THEREFORE BE IT RESOLVED, by the Township Committee, of the Township of Middle, County of Cape May, that the purchase of a 1990 Dodge Pickup Truck from the Cape May County Mosquito Commission for the sum of $1.00 (One Dollar) is hereby authorized.
32. RESOLUTION NO. 426-03 – TABULATION
COMMITTEE – VEHICLE LEASING – On motion by Committeemember Leusner seconded
by Committeemember DeLanzo and passed on roll call, the following resolution
was adopted.

IT RESOLVED, by the Township Committee, the Governing Body of the Township of
Middle, County of Cape May and State of New Jersey that Township
Clerk/Administrator James Alexis, Chief Finance Officer Tracey DeVico, and
David May of the Zoning Office be and hereby are appointed to tabulate the bids
to be taken on October 9, 2003 at 10:00 a.m. in the Middle Township Municipal
Building, 33 Mechanic Street, Cape May Court House, NJ for the following:

33. RESOLUTION NO. 427-03 – APPROVE APPLICATION
FOR RAFFLE LICENSE – KNIGHTS OF COLUMBUS – On motion by Mayor Doughty
seconded by Committeemember DeLanzo and passed on roll call, the following resolution
was adopted.
WHEREAS, Knights of Columbus has applied to Legalized Games of Chance Control Commission for a Raffle License, and
WHEREAS, the location will be at, 626 Goshen Road, Cape May Court House, NJ 08210, otherwise known as Davies Sports Complex, has been approved by the Middle Township Committee as an Amusement Game Zone, and
WHEREAS, the Department of Law and Public Safety, Division of Consumer Affairs, Legalized Games of Chance Control Commission, determines fees and rules of conduct,
WHEREAS, the proper application and fee have been received.
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Raffle Night October 12, 2003 at the location of 626 Goshen Road, Cape May Court House, NJ 08210, (otherwise know as Davies Sports Complex) is hereby approved.
34. RESOLUTION NO. 428-03 – ENDORSING APPROVAL
CERTIFICATE FOR USED MOTOR VEHICLE DEALER – On motion by Mayor Doughty
seconded by Committeemember DeLanzo and passed on roll call, the following
resolution was adopted.
WHEREAS, K & S t/a Kindle Ford Mercury Lincoln, Inc. dba Cape Auto Sales has submitted an application for a used motor vehicle dealer license to operate Cape Auto Sales at 368 Rte 47 S, Cape May Court House, NJ; and
WHEREAS, the applicant has applied to the Planning Board for approval of the location for use as used motor vehicle dealer, and
WHEREAS, September 11, 2003, the Planning Board did approve the site plan for the used motor vehicle dealer at 368 Rte 47 S, Cape May Court House, NJ; and
NOW, THEREFORE, BE IT RESOLVED, by the Township Committee, of the Township of Middle, County of Cape May, State of New Jersey, that the municipal clerk is authorized to sign the approval certificate for this used motor vehicle license.

COMMENT:
Mayor Doughty reminded everyone of the Harvest Festival next month. He also commented on the Shellbay Fishing Pier and the large gathering of tourist the populate the area.
Vilma Polmbo – asked Committee if Martindale’s is licensed to sell used cars at their corner and if so shouldn’t the area be paved?
Mayor Doughty stated that they have indeed been sited and their application is due to be presented to the Zoning Board.
Mayor Doughty informed the public that due to the Hurricane, the Cape May Lewis Ferry has shut down and have been relocated to a area in Pennsylvania.
There being no
further business, the meeting was adjourned at 7:00 p.m.
