hereby declare that notice has been given to the Herald Times, the Atlantic
City Press and posted on the bulletin board of the Middle Township Municipal
Building, stating the time and place of the following meeting, as required in
P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law). The Township Committee met on the above date
at 6:00 PM at the Middle Township Municipal Building. Members present were Mayor Doughty and
Committeemember DeLanzo, Clerk/ Business Administrator Alexis, Attorney Gorman,
Engineer Orlando, & Deputy Clerk Kimberly Tomkinson. Committeemember Leusner was absent.
Mayor
Doughty asked for a moment of silence over the loss of two Middle Township
residents this past week ~ Carol Nicoletta and Irene Cohen.

A. PRESENTATION – EAGLE SCOUT CANDIDATE
JARRETT LEHMANN
- BSA Troop
65 Eagle Scout Jarrett Lehmann presented Township Committee with his request
for an Eagle Project to implement fitness stations on the nature trail at the
Clarence Davies Sports Complex. A total of 10 stations will be constructed (5
of which by himself and the rest by the troop). The use of the equipment will
be free of charge to the residents and attendants of the trail.

ORDINANCE NO. 1149-04 – VACATING A PORTION OF DE CAMP ROAD AS SHOWN ON
SHEET 19.12 OF THE TAX MAP OF THE TOWNSHIP OF MIDDLE – On motion by Mayor
Doughty seconded by Committeemember DeLanzo and passed on roll call, Ordinance

ORDINANCE NO. 1150-04 – AMENDING THE CODE OF THE TOWNSHIP OF MIDDLE,
CHAPTER 236 (FINES FOR TRAFFIC VIOLATIONS) - On motion by Committeemember
DeLanzo seconded by
Mayor Doughty and passed on roll call, Ordinance No 1150-04 passed first
reading. Second reading, public hearing and consideration for adoption will be
held on 03/01/2004 at 6:00 p.m.

RESOLUTION NO. 43-04 – AUTHORIZE MAYOR TO EXECUTE CANCELLATION OF
MORTGAGES – On motion by Committeemember DeLanzo seconded by Mayor Doughty and
passed on roll call, the following resolution was adopted.
NOW THEREFORE BE IT RESOLVED, by the Township
Committee of the Township of Middle, the governing body thereof, that the

RESOLUTION NO. 45-04 – APPROVE REQUEST FOR
FAMILY MEDICAL LEAVE – VINCENT WATKINS SR. – On motion by Committeemember DeLanzo seconded
by Mayor Doughty and passed on roll call, the following resolution was adopted.
BE IT RESOLVED, by the Township Committee, the
Governing Body of the Township of Middle, County of Cape May and State of New
Jersey, that the request for medical leave for Vincent Watkins Sr. effective

RESOLUTION NO. 47-04 – RELEASE PERFORMANCE
BOND – RICHARD F. LEEDS / LEEDS MINOR SUBDIVISION – On motion by Mayor Doughty
seconded by Committeemember DeLanzo and passed on roll call, the following
resolution was adopted.
WHEREAS, $1,000.00 is being held as a Performance
Guarantee for Richard Leeds for site plan improvements at Block 98, Lot 11.01,
also known as 19 Swainton-Goshen Road, Swainton, and
WHEREAS, the Engineer for the Township of Middle has
conducted his inspection and certified that all improvements have been
completed, and
WHEREAS, the Zoning Officer for the Township of
Middle has recommended that the performance bond be released, and
WHEREAS, the Land Use Law of the State of New Jersey
(NJS 40:55D-1 et seq) requires such a release upon recommendation by the
Township Engineer,
NOW THEREFORE BE IT RESOLVED, by the Township
Committee of the Township of Middle, the governing body thereof, that the
performance bond held at Commerce Bank under Account No. 72000 82787 be and is
hereby released.

RESOLUTION NO. 48-04 – AUTHORIZE APPLICATION
– FY 2004 FEDERAL BULLET PROOF VEST GRANT – On motion by Committeemember DeLanzo seconded by
Mayor Doughty and passed on roll call, the following resolution was adopted.
BE IT RESOLVED, by the Township Committee of the
Township of Middle, the governing body thereof, that approval for the FY 2004
Federal Bullet Proof Vest Grant be and is hereby approved.
FURTHER RESOLVED, that Police Chief Joseph
Evangelista is named as the Contact Person and that the appropriate officials
are hereby authorized to sign said documents.
17.
RESOLUTION NO. 49-04 – AMENDING APPOINTMENTS
– 2004 – On
motion by Mayor Doughty
seconded by Committeemember DeLanzo and passed on roll call, the
following resolution was adopted.
WHEREAS, Resolution 1-04 inadvertently states the
incorrect appointment for the office of Real Estate Officer, and
WHEREAS, various changes to member listing has taken
place since January 1, 2004, and
NOW THEREFORE BE IT RESOLVED, that the “Appointment”

RESOLUTION NO. 51-04 – APPROVING PAYMENT FOR
ALL BILLS – On
motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll
call, the following resolution was adopted.

RESOLVED, by the Township Committee of the Township of Middle, the governing
body thereof, that payment for all bills is hereby approved.
20.
RESOLUTION NO. 52-04 – AMENDING LOCAL PUBLIC
CONTRACT – ENGINEERING SERVICES – HATCH MOTT MACDONALD (PREVIOUSLY KILLIAM
ASSOCIATES) – GREEN CREEK SEWER PROJECT – On motion by Committeemember DeLanzo seconded
by and passed on roll
call, the following resolution was adopted. Mayor Doughty Abstained
WHEREAS, on November 1, 1999 the above referenced
contract was approved by Township Committee for said services for the Green Creek
Sewer Project (otherwise known as Resolution 290-99), and
WHEREAS, an amendment is require to said agreement
for engineering services to compensate the engineer for additional services
performed to date regarding the Water Quality Management Plan for the Green
Creek area and additional work performed in obtaining permits from the
NJDEP.
WHEREAS, the Local Public Contract Law
(N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for
professional services without advertising for bids, and
WHEREAS, the Township of Middle requires said
services and funds are available for said purpose,
NOW THEREFORE BE IT RESOLVED, by the Township
Committee, the Governing Body of the Township of Middle, County of Cape May and
State of New Jersey, that the following person is hereby appointed to the
position designated below.
BE IT FURTHER RESOLVED, that a contract be executed
by the Township of Middle with the following person to supply professional
services until the completion of said project.

FOR FEDERAL GRANTS WITH THE NEW JERSEY DIVISION OF HIGHWAY TRAFFIC SAFETY –
POLICE DEPARTMENT – On motion by Committeemember DeLanzo seconded by Mayor Doughty and
passed on roll call, the following resolution was adopted.
WHEREAS, the Middle Township Police Department wishes to apply for
federal grants with the New Jersey Department of Highway Traffic Safety, and
WHEREAS, these grants are for a period between October 1, 2004 to
September 30, 2005, and
