I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

 

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember DeLanzo, Clerk/Business Administrator Alexis, Attorney Pickering, Engineer Orlando, Deputy Clerk Kimberly Tomkinson. Committeemember Leusner was absent.

 

 

1.      ORDINANCE NO. 1165-04 – VACATING A PORTION OF WOODSIDE ROAD AS SHOWN ON SHEET 19.13 OF THE TAX MAP OF THE TOWNSHIP OF MIDDLE - Following second reading, hearing, and consideration for adoption, Ordinance 1165-04 was adopted on motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call. Complete Ordinance is on file in the Clerk’s Office.

 

2.      ORDINANCE NO. 1162-04 – CREATING THE COMMUNITY DEVELOPMENT CORPORATION OF THE TOWNSHIP OF MIDDLE, CAPE MAY COUNTY, NEW JERSEY – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, Ordinance No 1162-04 passed first reading. Second reading, public hearing and consideration for adoption will be held on 07/19/2004 at 6:00 p.m.

 

3.      RESOLUTION NO. 347-04 – APPROVING MINUTES FOR PREVIOUS MEETING – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the minutes from the Township Committee meeting held June 7, 2004 are hereby approved.

 

4.      RESOLUTION NO. 348-04 – APPROVING PAYMENT FOR ALL BILLS – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for all bills is hereby approved.

 

5.      REPORTS – The following offices have submitted their monthly reports for the months indicated: Municipal Court of the month of May; Treasure’s Office for the month of May;

 

6.      RESOLUTION NO. 349-04 – 2004 HOTEL / MOTEL LICENSE APPROVAL – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

8.      RESOLUTION NO. 358-04 – RELEASE OF TRUST ACCOUNTS – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, certain monies held in Trust Accounts from time to time may have balances remaining after all fees have been paid, and

WHEREAS, the applicants are entitled to a refund of this money,

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that upon request of the Zoning Officer the following balances in the Trust Account as listed on the attached sheets shall be released.

 

9.      RESOLUTION NO. 359-04 – ENABLING RESOLUTION – DEPARTMENT OF ENVIRONMENTAL PROTECTION – GREEN ACRES – FORT APACHE – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”) provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes, and

WHEREAS, the Township of Middle desires to further the public interest by obtaining a loan of $251,000.00 and/or grant of $375,000.00 from the State to fund the following project:

                     FORT APACHE RECREATIONAL COMPLEX

NOW THEREFORE BE IT RESOLVED, by the Township Committee, of the Township of Middle, governing body thereof that F. Nathan Doughty, or the successor to the office of Mayor, is hereby authorized to:

a.)         make application for such a loan and/or such a grant

b.)         provide additional application information and furnish such documents as may be required

c.)         act as the authorized correspondent of the above named applicant, and

 

WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award, and

WHEREAS, the applicant is willing to use the State’s funds in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the State for the above named project.

FURTHER BE IT RESOLVED, by the Township Committee, of the Township of Middle:

1.)                           That the Mayor of the above named body is hereby authorized to execute an agreement and any amendment thereto with the State known as Fort Apache, and

2.)                           That the applicant has its matching share of the project, if a match is required in the amount of $____________.

3.)                           That, in the event the State’s funds are less than the total project cost specified above, the applicant ha the balance of funding necessary to complete the project, and

4.)                           The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project.

5.)                           That this resolution shall take effect immediately.

 

10.   RESOLUTION NO. 360-04 – RELEASE OF PERFORMANCE BOND – BURDETTE TOMLIN HEALTH ENTERPRISES – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, $15,541.56 is being held as a Performance Guarantee for Burdette Tomlin Health Enterprises for site plan improvements at Block 131, Lot 1, also known as 2 Stone Harbor Blvd., Cape May Court House and

WHEREAS, the Engineer for the Township of Middle has conducted his inspection and certified that all improvements have been completed, and

WHEREAS, the Zoning Officer for the Township of Middle has recommended that the performance bond be released, and

WHEREAS, the Land Use Law of the State of New Jersey (NJS 40:55D-1 et seq) requires such a release upon recommendation by the Township Engineer,

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Account No. 72000 82667 with Commerce Bank in the name of Burdette Tomlin Health Enterprises be and is hereby released.

 

11.   RESOLUTION NO. 361-04 – LOCAL PUBLIC CONTRACT – AUDIT SERVICES – FORD SCOTT SEIDENBURG & KENNEDY – SHELLBAY & CREST HAVEN SANITARY SEWER PROJECTS – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted. Mayor Doughty Abstained from roll call.

WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and

WHEREAS, the Township of Middle requires said services and funds are available for said purpose,

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following person is hereby appointed to the position designated below for the period beginning on June 21, 2004 through completion of the project.

BE IT FURTHER RESOLVED, that a contract be executed by the Township of Middle with the following person to supply professional services for the period from June 21, 2004 through completion of the project.

Audit Services  – Ford Scott Seidenburg & Kennedy– Shellbay and Crest Haven Sanitary Sewer Projects

BE IT FURTHER RESOLVED that a copy of this Resolution be published in the Herald-Times as required by law.

FURTHER RESOLVED that this contract is contingent upon the certification of availability of funds and submission of State Affirmative Action Certification.

 

12.   RESOLUTION NO. 362-04 – LOCAL PUBLIC CONTRACT – ENGINEERING SERVICES – HATCH MOTT MACDONALD – SHELLBAY & CREST HAVEN SANITARY SEWER PROJECTS – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted. Mayor Doughty abstained on roll call.

WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and

WHEREAS, the Township of Middle requires said services and funds are available for said purpose,

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following person is hereby appointed to the position designated below for the period beginning on June 21, 2004 through completion of the project.

WHEREAS, the need to amend said Resolution has arisen, and

20.   RESOLUTION NO. 370-04 – APPROVE APPLICATION FOR RAFFLE LICENSE – RIO GRANDE RESCUE SQUAD, INC. – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, Rio Grande Rescue Squad Inc. has applied to Legalized Games of Chance Control Commission for a Raffle License, and

WHEREAS, the location will be at, 603 Maryland Ave., Rio Grande, NJ 08210, has been approved by the Middle Township Committee as an Amusement Game Zone, and

WHEREAS, the Department of Law and Public Safety, Division of Consumer Affairs, Legalized Games of Chance Control Commission, determines fees and rules of conduct,

WHEREAS, the proper application and fee have been received.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Raffle Night July 26, 2004 at the location of 603 Maryland Ave., Rio Grande, is hereby approved.

 

21.   RESOLUTION NO. 371-04 – RATIFY CONTRACT – WESTERN PEST SERVICES – CLARENCE DAVIES SPORTS COMPLEX – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Contract between the Township of Middle and Western Pest Services effective June 21, 2004 and valid for two years, be and is hereby ratified.

FURTHER RESOLVED, that the appropriate officials are hereby authorized and directed to sign said contract.

 

22.   RESOLUTION NO. 372-04 – AMENDING DEPOSITORY CURRENT FUNDS – 2004 - On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, it has been deemed necessary to create and maintain a new account in connection with the Green Acres Grant Fund.

NOW THEREFORE BE IT FURTHER RESOLVED, that the Sturdy Savings Bank shall be the depository for the following account of the Township of Middle for the year 2004, and that all disbursements shall be made by checks signed by the following:

23.   RESOLUTION NO. 373-04 – AUTHORIZING THE MAYOR TO SIGN AFFORDABLE HOUSING AGREEMENT – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Mayor F. Nathan Doughty be and hereby is authorized to sign the Affordable Housing Agreement with C.C.C. Trivest Enterprises involving units 201, 203, 205, 207, 209, and 211 at Gateway Shores, Middle Township.

 

24.   RESOLUTION NO. 374-04 – AUTHORIZE EXECUTION OF GRANT AGREEMENT FOR NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION’S MUNICIPAL STORMWATER REGULATION PROGRAM – GRANT NO. WQ04-181 – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, an application was made to the State of New Jersey Department of Environmental Protection for the Municipal Stormwater Regulation Program, and

WHEREAS, said application was approved for funding in the amount of $9,022.00, and

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Mayor and/or Township Administrator is hereby authorized to sign the grant agreement and therefore authorizing the Chief Financial Officer to endorse corresponding payment voucher in connection with said grant.

 

25.   RESOLUTION NO. 375-04 – AUTHORIZATION TO CLOSE SUNRAY BEACH ROAD FROM BAYSHORE ROAD TO PINE ROAD– CMC DISABLED AMERICAN VETS – ANNUAL PICNIC – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that authorization is hereby given to close the Corner of Bayshore Road and Sunray Beach Rd. on August 14, 2004 from noon to 6:00 pm for their Annual Picnic.

 

26.    RESOLUTION NO. 376-04 – APPOINT SUMMER RECREATION EMPLOYEES – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.
