I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner and Committeemember DeLanzo, Clerk/ Business Administrator Alexis, Solicitor Pickering, Engineer Orlando, & Deputy Clerk Kimberly Tomkinson.

 

 

1.        RESOLUTION NO. 99-04 – APPOINTMENTS- NEW HIRES-POLICE DEPARTMENT – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

2.        ORDINANCE NO. 1149-04 – VACATING A PORTION OF DE CAMP ROAD AS SHOWN ON SHEET 19.12 OF THE TAX MAP OF THE TOWNSHIP OF MIDDLE – Following second reading, hearing, and consideration for adoption, Ordinance 1149-04 was adopted on motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call. 3.        ORDINANCE NO. 1150-04 – AMENDING THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 236 (FINES FOR TRAFFIC VIOLATIONS) - Following second reading, hearing, and consideration for adoption, Ordinance 1150-04 was adopted on motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call. 4.        ORDINANCE NO. 1152-04 – AMENDING SECTION 46-1 OF THE CODE OF THE TOWNSHIP OF MIDDLE – Following second reading, hearing, and consideration for adoption, Ordinance 1152-04 was adopted on motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call. Complete Ordinance is on file in the Clerk’s Office.

Joe Rich – Asked committee to clarify the ordinance and what it entailed.

Committeemember Leusner read off the particulars of the Ordinance and stated that it establishes a “Chain of Command” within the Police Department.

 

5.        ORDINANCE NO. 1153-04 – CREATING THE MIDDLE TOWNSHIP COUNCIL ON THE ARTS – – Following second reading, hearing, and consideration for adoption, Ordinance 1153-04 was adopted on motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call. Complete Ordinance is on file in the Clerk’s Office.

 

6.        ORDINANCE NO. 1154-04 – VACATING A PORTION OF IOWA AVENUE AS SHOWN ON SHEET 33.01 OF THE TAX MAP OF THE TOWNSHIP OF MIDDLE - Following second reading, hearing, and consideration for adoption, Ordinance 1154-04 was adopted on motion by    seconded by   and passed on roll call. 7.        ORDINANCE NO. 1151-04 – CREATING A HOTEL / MOTEL OCCUPANCY TAX IN THE TOWNSHIP OF MIDDLE  – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1151-04 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/05/2004 at 6:00 p.m.

Public Hearing: Solicitor Pickering explained to the public and committee the fees involved with the proposed ordinance and that this tax would take place as of July1st.

Vilma Polmbo – asked if this would apply to campgrounds with cabins?

J. Alexis – No

Andy from Pierces Point – where will the funds derived be deposited?

Committeemember Leusner – General Fund. He explained that the police department receives multiple calls each year to Hotel/Motels.

Laquita Jack – Del Haven – asked why the tax is not as high as those charged in Wildwood?

Committeemember Leusner stated that the State Legislature created a 3% cap.

 

8.        ORDINANCE NO. 1155-04 – VACATING A PORTION OF WHITING LANE AS SHOWN ON SHEET NUMBER 14 OF THE TAX MAP OF THE TOWNSHIP OF MIDDLE – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1155-04 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/05/2004 at 6:00 p.m.

 

9.        ORDINANCE NO. 1148-04 – TO ESTABLISH EMERGENCY MEDICAL TRANSPORT SERVICES FOR SERVICES RENDERED WITHIN THE TOWNSHIP OF MIDDLE, COUNTY OF CAPE MAY AND STATE OF NEW JERSEY – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1148-04 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/05/2004 at 6:00 p.m.

Committeemember DeLanzo informed the public on the reason and intention of this ordinance stating cost facts that the municipality faces every year with the EMS Services.

Committeemember Leusner stated that costs for EMS Services are steadily rising each year and 30% of calls in Middle Township are to Nursing Homes in which the Township does not receive any funds from since they are tax exempt. He stated that one of the main reasons for the billing is to relieve the taxpayers from the total burden of these costs.

Committeemember DeLanzo stated that on a Final Note – Middle Township needs their volunteers and will continue to help there needs.

Committeemember Leusner stated that he supports this ordinance 100% and believes that nursing homes take advantage of the EMS Services. He informed that public that the cost of this service to them can indeed be recouped by their insurance companies.

Mayor Doughty stated that he did not want to reiterate the words of the committee members, but supports this ordinance also 100%.

    

10.    RESOLUTION NO. 100-04 – RELEASE OF PERFORMANCE BOND – STREET OPENING – J.W. HAND & SONS – MITCHELL HAND – On motion by Mayor Doughty seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

WHEREAS, $5,000.00 is being held as a performance guarantee for J.W. hand & Sons – Mitchell Hand for the street opening located at 3121, 3123, 3125 Shunpike, Rio Grande, and

WHEREAS, the Administrative Director of Public Works has conducted his inspection and determined that all improvements have been completed, and

WHEREAS, it has been recommended that the performance guarantee for the above stated project be released.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the $5,000.00, be and is hereby released.

 

11.    RESOLUTION NO. 101-04 – ADOPTION OF UPDATED PERSONNEL POLICY MANUAL AND PERSONNEL POLICY HANDBOOK – 2004 – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

James Alexis thanked Personnel Director Vera Kalish and employee Allison Hunter for their hard work with the updating of the Personnel Policy Manual and Handbook. “Outstanding Job!”

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the

Township of Middle, the governing body thereof, that the Personnel Policy Manual & Personnel Policy Handbook dated January 2004 is hereby adopted.

FURTHER RESOLVED, that should any section, paragraph, sentence, clause or phrase of this manual be declared unconstitutional or invalid for any reason, the remaining portions of said manual shall not be affected thereby and shall remain in full force and effect, and to this end the provisions of mentioned manual are hereby declared to be serverable.

FURTHER RESOLVED, this manual shall become effective immediately upon approval of this resolution and all other manuals in conflict or inconsistent with the updated version dated January 2004 are hereby repealed, to the extent of such conflict or inconsistency.

 

12.    RESOLUTION NO. 102-04 – APPROVING MINUTES FOR PREVIOUS MEETING – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the minutes from the Township Committee meeting held February 2, 2004 are hereby approved.

 

13.    RESOLUTION NO. 103-04 – APPROVING PAYMENT FOR ALL BILLS – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for all bills is hereby approved.

 

14.    RESOLUTION NO. 104-04 – APPOINTMENT – MUNICIPAL SOLICITOR – JAMES PICKERING – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

15.    RESOLUTION NO. 105-04 – APPROVE CARRY-OVER OF ACCUMULATED LEAVE – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

16.    RESOLUTION NO. 106-04 – RATIFY AGREEMENT – EMPLOYEE CARE – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

BE IT RESOLVED by the Township Committee of the Township of Middle the governing body thereof, that the Agreement between Employee Care and the Township of Middle for the Employee Assistance Program effective April 1, 2004 through March 31, 2005, be and is hereby ratified.

 

FURTHER RESOLVED, that the appropriate officials are hereby authorized and directed to sign said agreement.

17.    RESOLUTION NO. 107-04 – APPROVE APPLICATION FOR RAFFLE LICENSE – GREEN CREEK VOLUNTEER FIRE CO. – On motion by Committeemember Leusner seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, Green Creek Volunteer Fire Co. has applied to Legalized Games of Chance Control Commission for a Raffle License, and

WHEREAS, the location will be at, 14 Bayshore Road, Green Creek, NJ 08219, otherwise known as Green Creek Fire Hall, has been approved by the Middle Township Committee as an Amusement Game Zone, and

WHEREAS, the Department of Law and Public Safety, Division of Consumer Affairs, Legalized Games of Chance Control Commission, determines fees and rules of conduct,

WHEREAS, the proper application and fee have been received.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Raffle Night September 8, 2004 at the location of 14 Bayshore Rd., Green Creek, (otherwise know as Green Creek Fire Hall), is hereby approved.

 

18.    RESOLUTION NO. 108-04 – APPROVE APPLICATION FOR RAFFLE LICENSE – BISHOP MCHUGH REGIONAL CATHOLIC SCHOOL P.T.A. – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, Bishop McHugh Regional Catholic School P.T.A. has applied to Legalized Games of Chance Control Commission for a Raffle License, and

WHEREAS, the location will be at, 1765 Rte 9, Swainton, NJ 08210, otherwise known as Sand Barrens Golf Club, has been approved by the Middle Township Committee as an Amusement Game Zone, and

WHEREAS, the Department of Law and Public Safety, Division of Consumer Affairs, Legalized Games of Chance Control Commission, determines fees and rules of conduct,

WHEREAS, the proper application and fee have been received.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Raffle Night May 20, 2004 at the location of 1765 Rte 9, Swainton, (otherwise know as Sand Barrens Golf Club), is hereby approved.

20.    RESOLUTION NO. 109-04 – RENEWAL – TOWING LICENSES – 2004 – (HITECH AUTO) – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the several Towing license renewal applications listed below have been found to be in proper form, and the fees paid in each case.

21.    RESOLUTION NO. 110-04 – APPROVING PERSON TO PERSON TRANSFER – WILDWOOD GOLF AND COUNTRY CLUB TO WILDWOOD GOLF CLUB INC.– On motion by Committeemember Leusner seconded by Mayor Doughty and passed on roll call, the following resolution was adopted. Committeemember DeLanzo ABSTAINED

Whereas, an application has been filed for a person to person transfer of Liquor License No. 0506-31-006-002, heretofore issued to Wildwood Golf and Country Club, for the premises located at 1170 Golf Club Road, Cape May Court House, NJ, and

WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid, and the license has been properly renewed for the current license term, and

WHEREAS, the applicant is qualified to be licensed according to all standards established by Title 33 of the New Jersey Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions consistent with Title 33, and

WHEREAS, the applicants have disclosed, and the issuing authority has reviewed, the source of all funds in financing of said license, and

WHEREAS, the municipality has received a written statement, under oath, signed by an authorized representative of both the transferor and transferee, affirming that the transferees are aware of all obligations outstanding to the New Jersey Alcoholic Beverage manufactures, wholesales, and distributors, and that either the transferees have been or will be satisfied by the transferor out of the proceeds of the sale of the licensed business.

WHEREAS, the transferor and the transferee have certified to the Township of Middle that the Board of Trustees, Officers and Members are the same individuals regarding the change of name status for the club license to known as Wildwood Golf Club.

NOW THEREFORE BE IT RESOLVED, that the Township Committee, of the Township of Middle, County of Cape May, State of New Jersey, does hereby approve, effective March 28, 2004, the transfer of the aforesaid liquor license no. 0506-31-006-002 to Wildwood Golf Club Inc., and does hereby direct the Municipal Clerk to endorse the license certificate to the new ownership as follows: “This license, subject to all its terms and conditions, is hereby transferred to Wildwood Golf Club, Inc., effective March 28, 2004.

FURTHER RESOLVED, that one certified copy of this resolution be forwarded to the Director of the Division of Alcohol Beverage Control.

22.    RESOLUTION NO. 111-04 – LOCAL PUBLIC CONTRACT – MC CLURE’S POWER SYSTEMS, INC. – GENERATOR MAINTENANCE – SEWER PUMP STATIONS – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Local Public Contract Law (N.J.S.A.40A:11-1 et seq.) provides for the award of contracts, for professional services without advertising for bids, and

WHEREAS, the Township of Middle requires said services and funds are available for said purpose,

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following person is hereby appointed to the position designated below.

24.    RESOLUTION NO. 113-04 – RELEASE OF TRUST ACCOUNTS – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, certain monies held in Trust Accounts from time to time may have balances remaining after all fees have been paid, and

WHEREAS, the applicants are entitled to a refund of this money,

26.    RESOLUTION NO. 115-04 – AUTHORIZING SUBMISSION OF REQUEST TO COUNTY OF CAPE MAY FOR APPROVAL OF EXPENDITURE OF FUNDS FROM THE MUNICIPAL LAW ENFORCEMENT TRUST ACCOUNT (MLETA) – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Middle Township Police Department wishes to purchase a Live Scan Fingerprint System for use at Police Headquarters, and

WHEREAS, an application must be submitted to the County of Cape May Forfeiture Program to approval expenditure of funds from the Municipal Law Enforcement Trust Account (MLETA).

NOW THEREFORE BE IT RESOLVED, by the Township Committee, of the Township of Middle, County of Cape May, State of New Jersey that authorization is hereby granted to the Middle Township Police Department to submit a request for approval for expenditure of funds for the purchase of a Live San Fingerprint System.

FURTHER RESOLVED, that appropriate officials are hereby authorized to sign said documents.
