I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner, Committeemember DeLanzo, Clerk/Administrator James Alexis, Deputy Clerk Kimberly Tomkinson, Attorney Pickering, and Engineer Orlando.

ORDINANCE NO. 1204-05 - AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 236-10 THEREOF, ENTITLED VEHICLES AND TRAFFIC, SECTION II TRAFFIC REGULATIONS, AUTHORIZING A NO THRU TRAFFIC SCHEDULE - Following second reading, hearing, and consideration for adoption, Ordinance 1204-05 was adopted on motion by Mayor Doughty seconded by Committeemember Leusner                  and passed on roll call. Complete Ordinance is on file in the Clerk’s Office.

ORDINANCE NO. 1207-05 – AN ORDINANCE OF THE TOWNSHIP OF MIDDLE, COUNTY OF CAPE MAY AND STATE OF NEW JERSEY TO AMEND CHAPTER 236-35 THEREOF, ENTITLED VEHICLES AND TRAFFIC SCHEDULE VII “STOP INTERSECTIONS” – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1207-05 passed first reading. Second reading, public hearing and consideration for adoption will be held on 09/19/2005 at 6:00 p.m.

 

  1. RESOLUTION NO. 407-05 – APPROVING MINUTES FROM THE PREVIOUS MEETING – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the minutes from the Township Committee meeting held August 1, 2005 are hereby approved.

 

  1. RESOLUTION NO. 408-05– APPROVING PAYMENT FOR ALL BILLS – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for the following bills in the amounts indicated are hereby approved:

  1. RESOLUTION NO. 409-05 – APPROVE REQUEST FOR FAMILY MEDICAL LEAVE – KATIE D’ALONZO – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the request for Family Medical Leave for Katie D’Alonzo utilizing some accrued paid sick days from August 4, 2005 through September 30, 2005 is hereby approved.

 

  1. RESOLUTION NO. 410-05 – REDUCTION OF PERFORMANCE BOND – ROS LEN INC. – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted. Mayor Doughty ABSTAIN

WHEREAS, $604,390.20 is being held as a performance guarantee of Ros Len Inc. for site improvements at Block 13.02, Lot 8.01, 8.02, 10, also known as Route 9 North, Swainton, and

WHEREAS, the Engineer has conducted his inspection and determined that improvements having a value of $460,572.50 have been completed, and

WHEREAS, the Zoning Official has recommended that the performance guarantee for the above stated project be reduced to $143,817.70.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the Irrevocable Letter of Credit No. 1051 with Cape Savings Bank be and is hereby reduced to $143,817.70

 

  1. RESOLUTION NO. 411-05 – AUTHORIZE CHANGE IN EMPLOYEE STATUS FROM PART TIME TO FULL TIME – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

  1. RESOLUTION NO. 412-05 – APPROVE RETURN FROM FAMILY MEDICAL LEAVE – MADONNA SILL – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the Family Medical Leave for Madonna Sill has ended and authorization for return to work on July 30, 2005 has been approved.

 

  1. RESOLUTION NO. 413-05 – 2005 HOTEL /MOTEL LICENSE APPROVAL – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

 

  1. RESOLUTION NO. 414-05 – REFUND OF PAYMENT – SEWER – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.         

WHEREAS, $1800.00 was collected by the Sewer Department for a connection fee for Block 439 lot 25, and

 

WHEREAS, the original house was demolished and a new house was built

  1. RESOLUTION NO. 415-05 – AUTHORIZING MIDDLE TOWNSHIP AMBULANCE CORPS TO SOLICIT FUNDS IN THE ROADWAYS OF THE TOWNSHIP OF MIDDLE – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

WHEREAS, Ordinance 1009-98 permits application to made to the Township of Middle by charitable organizations to solicit funds in the roadway of the Township of Middle, and

WHEREAS, Middle Township Ambulance Corp. has submitted an application to the Municipal Clerk Office, and

WHEREAS, the dates and times of the charitable solicitation are listed within the written application submitted by the Middle Township Ambulance Corp. and attached to this Resolution, and

WHEREAS, the Chief of Police of the Township of Middle has reviewed the application of the Middle Township Ambulance Corp and has determined that there is no public safety reason for the Township of Middle to deny this application,

NOW, THEREFORE, BE IT RESOLVED by the Township Committee, of the Township of Middle, County of Cape May, State of New Jersey, hereby grants permission for the Middle Township Ambulance Corps. to solicit funds on the roadways of Middle Township.

 

  1. RESOLUTION NO. 416-05 – APPROVE APPLICATION FOR RAFFLE LICENSE – CMC 4-H FOUNDATION INC. – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, The CMC 4-H Foundation has applied to Legalized Games of Chance Control Commission for a Raffle License, and

WHEREAS, the location will be at, 355 CH SO Dennis Rd, CMCH, NJ 08210 has been approved by the Middle Township Committee as an Amusement Game Zone, and

WHEREAS, the Department of Law and Public Safety, Division of Consumer Affairs, Legalized Games of Chance Control Commission, determines fees and rules of conduct,

WHEREAS, the proper application and fee have been received.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Raffle Night October 14, 2005 at the location of 355 CH SO Dennis Rd, CMCH, NJ 08210 to be held at 9:00pm is hereby approved.

 

  1. RESOLUTION NO. 417-05 – APPROVE CHANGE ORDER #1 – EASY STREET SANITARY SEWER PROJECT – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that the attached Change Order #1 DECREASE in contract amount, in the amount of $8,583.77 for the Easy Street Sewer Project, awarded to F.W. Shawl & Sons Inc. be and is hereby approved.

  1. RESOLUTION NO. 419-05 – APPROVAL OF PAYMENT TERMINAL LEAVE – TINA CAMP –On motion by Mayor Doughty seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

WHEREAS, Tina Camp has submitted her resignation with an effective date of February 18th, 2005, and

WHEREAS, it is the policy of Middle Township to compensate resigning employees for accumulated vacation, compensation, and personal time, and

WHEREAS, the personnel office has provided sufficient documentation verifying the amount of time accumulated and the Finance Officer has certified that time,

  1. RESOLUTION NO. 421-05 – APPROVE INTERLOCAL SERVICE AGREEMENT BETWEEN THE BOROUGH OF CAPE MAY POINT AND THE TOWNSHIP OF MIDDLE – BUS SHELTERS – On motion by Mayor Doughty seconded by Committeemember DeLanzo                   and passed on roll call, the following resolution was adopted.

BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Interlocal Agreement between the Township of Middle and the Borough of Cape May Point for Bus Shelters effective August 15, 2005 with an expiration of December 31, 2005, be and is hereby ratified.

FURTHER RESOLVED, that the appropriate officials are hereby authorized and directed to sign said contract.

 

  1. RESOLUTION NO. 422-05 – PUBLIC SALE OF LAND – On motion by Mayor Doughty           seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

WHEREAS, the local Lands and Buildings Law (N.J.S.  40A-12-1 et seq) authorizes the sale of any real property, capital improvements or interest herein, not needed for public use, and

WHEREAS, it appears to be in the best interest of the Township of Middle to dispose of certain real property which is not needed for public use, which property is more fully described as in Schedule "A" annexed hereto,

NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, as follows:

1.  It is hereby determined that the parcels of real property set forth in Schedule "A" annexed hereto are not needed for public use.                                      

2.  Said parcels of real property shall be sold at a public auction sale to be conducted by Tracey L. DeVico Taverner, Chief Financial Officer, at the Middle Township Hall, Meeting Room, 33 Mechanic Street, Cape May Court House, New Jersey, or her designee, on Thursday, September 15, 2005 at 9:00 A.M.  A notice of said sale, which notice shall include the entire contents of this Resolution, shall be published in the Herald Times in its issues of August 24, 2005 and August 31, 2005.
