I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner, Committeemember DeLanzo, Clerk/Administrator James Alexis, Deputy Clerk Kimberly Tomkinson, Attorney Pickering, and Engineer Orlando.

 

 

  1. PRESENTATION – LILLIAN ARMSTRONG – NEW JERSEY AUDUBON SOCIETY, CENTER FOR RESEARCH AND EDUCATION

L. Armstrong – presented a new project to Township Committee and the public that has been funded by the NJ DOT and NJ DEP for Cumberland, Salem and Cape May Counties. This project is a Viewing Guide/ Ecotourism Brochure, which gives a detailed listing of directions and site information on wildlife viewing areas within the Counties. Free advertisement will be offered to local businesses, paid for by NJ DOT. Ms. Armstrong stated that the center is conducting a site nomination process, asking residents to inform the society of favorite “viewing” sites in the area.

Committeemember DeLanzo stated that Fort Apache might be a possible focus for the brochure.

         Agenda Item No. 25 was moved to the front of the agenda and acted on as follows:

 

  1. RESOLUTION NO. 59-05 – SUPPORTING THE DELAWARE BAYSHORE BIRDING AND WILDLIFE TRAILS – On motion by Mayor Doughty seconded by Committeemember DeLanzo                    and passed on roll call, the following resolution was adopted.

WHEREAS, the New Jersey counties of Cape May, Cumberland and Salem, representing approximately 800,000 acres, is an area of significant natural beauty containing coastal habitats, marshland, wooded wetlands, Pine Barrens forests, grasslands, Delaware River watershed lands and productive farmland, numerous cultural and historic sites and possessing substantial recreational opportunities of national significance, and

WHEREAS, the Delaware Bayshore Birding and Wildlife Trails project will create a guide to local wildlife sites connected in local driving loops to help residents and visitors enjoy and appreciate the distinct natural resources of the tree counties, and

WHEREAS, according to the United States Fish and Wildlife Services 2001 National Survey of Fishing, Hunting, and Wildlife – Associated Recreation, approximately one –third of all U.S. Citizens participated in wildlife activities, and they spent approximately $40 billion, and

WHEREAS, according to the survey above, approximately 1.64 million New Jersey residents and 688,000 visitors watched wildlife in New Jersey, generating $1.24 billion in spending, and

WHEREAS, the Delaware Bayshore Birding and Wildlife Trails project will also create brochures to local businesses that encourages and recognize the importance of nature-based tourism, including food, lodging, local arts and crafts, and alternative nature-related outdoor activities, with a goal of increasing nature-based tourism within the area, and

WHEREAS, the New Jersey Department of Transportation (NJDOT) is providing funding for the Delaware Bayshore Birding and Wildlife Trails project, which is a cooperative effort between the NJDOT, the New Jersey Bureau of Travel and Tourism, the New Jersey Department of Environmental Protection and the New Jersey Audubon Society, and

WHEREAS, the Delaware Bayshore Birding and Wildlife Trails project will involve members of the local community by asking them to nominate their favorite sites for viewing wildlife, thus fostering a sense of local pride and ownership of the guide itself, and

WHEREAS, the Township of Middle is located within the tree-county area within the borders of Cape May, Cumberland and Salem.

NOW THEREFORE BE IT RESOLVED, that the Township Committee of the Township of Middle, County of Cape May, New Jersey does hereby support the Delaware Bayshore Birding and Wildlife Trails Project, and its related activities.

ORDINANCE NO. 1178-05 – AN ORDINANCE AMENDING SECTION 229-9 OF THE CODE OF THE TOWNSHIP OF MIDDLE REGARDING TOWING CONTRACTS – Following second reading, hearing, and consideration for adoption, Ordinance 1178-05 was adopted on motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call.   1. ORDINANCE NO.1179-05 - AN ORDINANCE ESTABLISHING THE COMPENSATION OF THE OFFICERS AND EMPLOYEES OF THE TOWNSHIP OF MIDDLE – Following second reading, hearing, and consideration for adoption, Ordinance 1179-05 was adopted on motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call. Complete Ordinance is on file in the Clerk’s Office.

 

  1. ORDINANCE NO. 1180-05 – A BOND ORDINANCE AUTHORIZING VARIOUS IMPROVEMENTS AT THE FORT APACHE RECREATION AREA IN THE TOWNSHIP OF MIDDLE, COUNTY OF CAPE MAY, NEW JERSEY; APPROPRIATING THE SUM OF $950,000 THEREFOR AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OR BOND ANTICIPATION NOTES OF THE TOWNSHIP OF MIDDLE, COUNTY OF CAPE MAY, NEW JERSEY, IN THE AGGREGATE PRINCIPLE AMOUNT OF UP TO $902,500; MAKING CERTAIN DETERMINATIONS AND COVENANTS; AND AUTHORIZING CERTAIN RELATED ACTIONS IN CONNECTION WITH THE FOREGOING - Following second reading, hearing, and consideration for adoption, Ordinance 1180-05 was adopted on motion by Committeemember DeLanzo seconded by Mayor Doughty                  and passed on roll call. ORDINANCE NO. 1181-05 – AN ORDINANCE ESTABLISHING A NEW FEE SCHEDULE FOR OBTAINING VITAL STATISTIC RECORDS; AMENDING CHAPTER 265, ENTITLED “FEES”, OF THE CODE OF THE TOWNSHIP OF MIDDLE, COUNTY OF CAPE MAY, NEW JERSEY - Following second reading, hearing, and consideration for adoption, Ordinance 1181-05 was adopted on motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call.   1. ORDINANCE NO. 1182-05 – ESTABLISHING FEES FOR SPECIAL SERVICE CHARGES AND SPECIAL CHARGES UNDER THE NEW JERSEY OPEN PUBLIC RECORDS LAW - On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, Ordinance No 1182-05 passed first reading. Second reading, public hearing and consideration for adoption will be held on 03/07/2005 at 6:00 p.m.

 

  1. ORDINANCE NO. 1183-05 - AMENDING THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 204, SEWERS, ARTICLE II, SECTION 15, SUBSECTION D (APPLICATION, REVIEW, INSPECTION AND CONNECTION FEES) - On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1183-05 passed first reading. Second reading, public hearing and consideration for adoption will be held on 03/07/2005 at 6:00 p.m.

 

  1. ORDINANCE NO. 1184-05 - AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER § 46 SECTION 46-1 THEREOF, ENTITLED POLICE DEPARTMENT, ESTABLISHMENT AND ORGANIZATION - On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, Ordinance No 1184-05 passed first reading. Second reading, public hearing and consideration for adoption will be held on 03/07/2005 at 6:00 p.m.

 

  1. ORDINANCE NO. 1185-05 - ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK, CALENDAR YEAR 2005 (N.J.S.A. 40A: 4-45.14) - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1185-05 passed first reading. Second reading, public hearing and consideration for adoption will be held on 03/07/2005 at 6:00 p.m.

 

  1. RESOLUTION 45-05 – EMERGENCY TEMPORARY BUDGET AMENDMENT – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, an emergent condition has arisen and no adequate provision has been made in the 2005 temporary appropriations for the aforesaid purpose; and NJSA 40A:4-20 provides for the creation of an emergency appropriation for the purpose above mentioned, and

WHEREAS, the total emergency temporary resolutions adopted pursuant to the provisions of Chapter 96 PL 1951 (NJSA 40A:4-20) including this resolution total  $490,900

NOW THEREFORE BE IT RESOLVED (not less than two-thirds of all members thereof affirmatively concurring) that in accordance with NJSA 40A:4-20

1.             An emergency temporary appropriation be and the same is hereby made in the amount of  $490,900

That said emergency temporary appropriation shall be provided for in the 2005 budget under the title of:

2.             That one certified copy of this resolution be filed with the Director of Local Government Services.
