I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

PRESENTATION BY CAPE EXPRESS SOCCER – Mike Granaghan from Cape Express Soccer presented a donation from the league in the amount of $4000.00 towards the Middle Township Recreation Program and the complex lighting. Stated that he would like to see in the near future the entire facility lighted.

  1. RESOLUTION NO. 98-06 – APPROVING MINUTES FOR PREVIOUS MEETING – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the minutes from the Township Committee meeting held February 6, 2006 are hereby approved.

 

  1. RESOLUTION 99-06 – APPROVING PAYMENT FOR ALL BILLS – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for the following bills in the amounts indicated are hereby approved:

  1. REPORTS: Municipal Court for the month of January; Treasure’s Department for the month of January; Construction Official for the month of February; Municipal Clerk for the month of February; Zoning Official for the month of February; Tax Collector for the month of February;

 

  1. RESOLUTION NO. 100-06 – ESTABLISHING: 1.   FAIR AND OPEN PROCESS FOR CONTRACTS 2.  CRITERIA TO BE CONSIDERED IN AWARDING CONTRACTS; AND 3.  POSITIONS FOR WHICH PROPOSALS SHALL BE SOLICITED – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, N.J.S.A. 19:44A-20.4 et. seq. requires that contracts with a value exceeding $17,500 be awarded pursuant to a “fair and open” or “non-fair and open” process; and 

WHEREAS,  the Township Committee feel the best interests of the residents of Middle Township would be best served by the Township requesting proposals and qualifications, and considering and awarding contracts by use of a Fair and Open process; and

WHEREAS, the Township Committee desires to establish the Fair and Open Process; and

WHEREAS, the Township Committee desires to establish the criteria for the consideration of proposals and qualifications, and the award of Contracts submitted in accordance with the Fair and Open Process; and

WHEREAS, the Township Committee desires to establish the positions which for the year 2006 shall be subject to the Fair and Open Process and also where stated below additional criteria for certain position; and

WHEREAS, the Township Committee has decided to go beyond what is required by the state statute and to submit all professional services contracts to the Fair and Open process, even those that are below the $17,500.00 threshold;

NOW THEREFORE BE IT RESOLVED,  by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that:

1.  THE FAIR AND OPEN PROCESS

A.  The Township Committee of the Township of Middle has determined that the following procedure constitutes a fair and open process and shall be the manner in which requests for proposals and qualifications are sought, accepted, and awarded:

1.                A request for proposals and qualifications shall be publicly advertised on the Township of Middle’s internet website beginning on March 7, 2006 and continuing on the website through March 8, 2006;

2.                The Township shall accept proposals until 12:00 o’clock noon on March 20, 2006.

3.                Proposals shall be in a sealed envelope addressed to:

The envelope shall also state the name of the person or entity submitting the proposal and the position for which the proposal is submitted. 

4.                The envelope shall contain one original and three copies of the proposal.

5.                The proposal shall include (this is mandatory) at a minimum, a statement of the following:

A.                Qualifications and Experience of person or entity specifically with regard to the position sought

B.                Scope of Services proposed to be provided

C.                Contact Information, including name, address, phone number, email address

D.                Fee Proposal

E.                Office Staffing Plan and Resources 

F.                Location of Office from which services shall be provided

G.               References

H.                Potential Conflicts

6.                On March 20, 2006 at 12:00 noon, James Alexis shall open each of the proposals and shall announce the proposals received by name, and a short summary of the proposal and qualifications.

7.                The proposals shall be submitted to Township Committee for consideration at its meeting on March 20, 2006 at 6:00 p.m. at which time Township Committee may award a contract by approving a resolution, or, it may choose to award at the next regularly scheduled Township Committee meeting.  If a majority votes to seek interviews, interviews may be held between Township Committee and the person or entity that submitted proposals.  Township Committee may send proposals to Township Board’s or Agency’s for consideration and approval as is appropriate.

2.  CRITERIA BY WHICH REQUESTS FOR PROPOSALS AND QUALIFICATIONS SHALL BE EVALUATED

A.                The Township of Middle hereby discloses in writing that all of the submissions in response to the Request for Proposals and Qualifications submitted through the fair and open process described above, will be evaluated by the Township Committee of the Township of Middle and awarded or rejected on the basis of the following criteria.  Proposals will be evaluated by the Township Committee of the Township of Middle on the basis of the most advantageous, price and other factors considered.  The evaluation will consider:

1.                Experience and reputation in the field

2.                Knowledge of the Township of Middle and the subject matter to be addressed under the contact

3.                Availability to accommodate any required meetings of the agency

4.                Compensation proposal

5.                Other factors if demonstrated to be in the best interest of the Township of Middle

B.                The following criteria, found under the competitive contracting rules at N.J.A.C. 5:34-4.2, if determined to be of assistance, may also be considered by Township Committee.  These criteria are not intended to be limiting or all-inclusive, and they may be adapted or supplemented in order to meet the Township Committee’s needs.  No criteria will unfairly or illegally discriminate or exclude otherwise capable vendors.

I.                 Technical criteria:

a.                Proposed methodology:

i.                 Does the vendor’s proposal demonstrate a clear understanding of the scope of work and related objectives?

ii.                 Is the vendor’s proposal complete and responsive to the specific RFP requirements?

iii.                Has the past performance of the vendor’s proposed methodology been documented?

iv.                Does the vendor’s proposal use innovative technology and techniques?

v.                 Are sound environmental practices such as recycling, energy efficiency, and waste reduction used?

II.                 Management criteria:

a.                Project management:

i.                 How well does the proposed scheduling timeline meet the agency’s needs?

ii.                 Is there a project management plan?

b.                History and experience in performing the work:

i.                 Does the vendor document a record of reliability of  timely delivery and on-time and on-budget implementation?

ii.                 Does the vendor demonstrate a track record of service as evidenced by on-time, on-budget, and contract compliance performance?

iii.                Does the vendor document industry or program experience?

iv.                Does the vendor have a record of moral integrity?

c.                Availability of personnel, facilities, equipment and other resources:

i.                 To what extent does the vendor rely on in-house resources vs. contracted resources?

ii.                 Are the availability of in-house and contract resources documented?

d.                Qualification and experience of personnel:

i.                 Documentation of experience in performing  similar work by employees and when appropriate, sub-contractors?

ii.                 Does the vendor make use of business capabilities or initiatives that involve women, the disadvantaged, small and/or minority owned business establishments?

iii.                Does the vendor demonstrate cultural sensitivity in hiring and training staff?

III.                Cost criteria:

a.                Cost of goods to be provided or services to be performed:

i.                 Relative cost:  How does the cost compare to other similar  proposals?

ii.                 Full explanation:  Is the price and its component charges, fees, etc., adequately explained or documented?

b.                Assurances of performance:

i.                 If required, are suitable bonds, warranties, or guarantees provided?

ii.                 Does the proposal include quality control and assurance programs?

c.                Vendor’s financial stability and strength:

i.                 Does the vendor have sufficient financial resources to meet its obligations?

III.                REQUEST FOR PROPOSALS AND QUALIFICATIONS ARE SOUGHT FOR THE FOLLOWING POSITIONS

A.  Municipal Solicitor - Legal Advisor to the Township Committee and Administrative Staff.  Includes all litigation, draft and review ordinances, resolutions, and any and all other matters regarding the Township’s legal issues.  Also solicitor to Cable Television Advisory Board, Economic Development Council, and Sewer and Water Department.  Township Committee meets twice a month in the evening; there are frequent daytime meetings.  Cable Advisory Board meets quarterly.  The Solicitor is required to be in Township Hall at least one day a week to meet with department heads and employees.  The Solicitor is expected to be immediately available to Township Committee members and the Administrator; at least one full time staff member is to be assigned to do Township work.  Minimum qualifications are at least five years experience in some governmental capacity.  

B.  Conflict Solicitor - Where Municipal Solicitor has conflict, matter to be handled by this attorney.  Same requirements as the Municipal Solicitor.

C.  Labor Solicitor - Legal Advisor to the Township Committee and Administrative Staff on labor law issues, including civil service issues, disciplinary matters, hiring and firing of employees, and negotiating contracts. 

D.  Municipal Engineer - Three year term - Municipal Engineer serves as advisor to Township Committee, advisor to public works department, and sewer and water departments.  Also engineer to the Zoning and Planning Boards.  Required to have planner certification as well as P.E..  Required to spend at least one day a week in Township Hall meeting with residents regarding engineering and planning/zoning issues.  Township Committee meets twice a month, planning board meets twice a month, and zoning board once a month, all in the evening.  The Engineer is expected to be immediately available to Township Committee members and the Administrator.  Minimum qualifications are at least five years experience in some governmental capacity.  Required also to have sufficient staff to meet Township’s demands.

E.  Municipal Auditor - The auditor performs annual audit of Township Finances, assists with preparation of annual budget, and is always immediately available to discuss compliance with the Township Administrator and CFO.

F.  Municipal Prosecutor - Prosecutes in the Township’s municipal Court.  Court meets every Wednesday.

G.  Municipal Public Defender - Represents defendants who qualify for public defender in municipal court.  Court meets every Wednesday.

H.  Zoning Board of Adjustment Solicitor - Attorney representing the Zoning Board of Adjustment.  The Zoning Board meets one evening a month.

I.  Planning Board Solicitor - Attorney representing the Planning Board.  The Planning Board meets two evenings a month.

J.  Rent Leveling Board Solicitor - Attorney represents the Rent Leveling Board.  The Rent Leveling Board meets quarterly.

K.  Hearing Officer - Attorney sitting as a hearing officer on employee disciplinary matters.

L.  Economic Development and Grant Administrator Consultants - provide administrative services for economic development board, home rehabilitation program for low income homeowners, evaluation services for loan program to businesses, and assist in applications for grants involving the same.

M.  Grant Application and Housing Rehabilitation Consultant - completes applications and makes efforts to obtain grants particularly Housing Rehabilitation Grants.

N.   Grant, Utility, and Legislative Consultant - completes grant applications and advises Township Committee on utility and legislative issues impacting the Township.

O.  Beach Erosion Prevention and Replenishment Consultant - completes grant applications and advises Township Committee on beach erosion prevention and beach replenishment issues and funding, particularly federal funding.

 

  1. RESOLUTION NO. 101-06 – APPROVE – ADOPT A SPOT GRANT – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

  1. RESOLUTION NO. 102-06 – CANCELING OUTSTANDING CHECKS – GENERAL ACCOUNT – On motion by Committeemember DeLanzo seconded by Mayor Doughty                    and passed on roll call, the following resolution was adopted.

WHEREAS, there are certain checks that have been outstanding in the Middle Township General Account for a period of more than six months, and

WHEREAS, it is the desire of the Township Treasurer to return these funds to the Middle Township General Account.

WHEREAS, CARA has applied to Legalized Games of Chance Control Commission for a Raffle License, and

  1. RESOLUTION NO. 106-06 – APPROVE APPLICATION FOR RAFFLE LICENSE – 50/50 – OUR LADY OF ANGELS CHURCH – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, Our Lady of Angels Church has applied to Legalized Games of Chance Control Commission for a Raffle License to conduct a “50 / 50”, and

WHEREAS, the location will be at, Rte 9 & Crest Haven Road, Cape May Court House, NJ 08210, otherwise known as The Cape May County Park & Zoo, has been approved by the Middle Township Committee as an Amusement Game Zone, and

  1. RESOLUTION NO. 107-06 – AUTHORIZE POLICE TO SIGN SERVICE AGREEMENT – MOBILE DATA COMPUTERS – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that an authorized representative of the Township of Middle be and hereby is authorized to sign said Agreement between the Township of Middle Police Department and the Cape May County Prosecutors Office in order to provide 24 hours, seven days a week, New Jersey Criminal Justice Information System Services via mobile data computers.

 

  1. RESOLUTION NO. 108-06 – SOCIAL AFFAIRS PERMIT – WILDWOOD GOLF CLUB INC. – On motion by Committeemember DeLanzo seconded by Mayor Doughty                    and passed on roll call, the following resolution was adopted.

WHEREAS, Wildwood Golf Club Inc. has applied for approval to sell alcoholic beverages at a Volunteer Dinner at the Wildwood Golf Club, Inc., 1170 Golf Club Road, CMCH, on March 31, 2006 from 5:00pm to 1:00 a.m., and

WHEREAS, they have provided proper documentation to the Township of Middle,

NOW, THEREFORE BE IT RESOLVED, that the Township Committee, in the Township of Middle, does hereby approve the Social Affairs Permit.

 

  1. RESOLUTION NO. 109-06 – AWARD OF BASE BID – WHITESBORO SCHOOL CONTRACT NO. 3 – AIR CONTROL TECHNOLOGY INC. – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, it has been deemed necessary and desirable to solicit bids for a Fire Alarm System within the Whitesboro School in the Township of Middle, and

WHEREAS, bids were received on January 25, 2006 at 10:00 AM

WHEREAS, it appears that Air Control Technology Inc. has submitted the lowest responsible base bid.

 NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the Contract for a Fire Alarm System towards the Whitesboro School in the Township of Middle, shall be awarded to the following for the total bid price listed below:

Air Control Technology Inc. -  $20,763.00

FURTHER RESOLVED, that this award is conditioned upon certification of funds and submission of appropriate affirmative action forms.

  1. RESOLUTION NO. 110-06 – REJECT BIDS – CONSTRUCTION AN/OR RECONSTRUCTION OF PORTIONS OF THE FORMER WHITESBORO SCHOOL / HEADSTART BUILDING – CONTRACT NO. 3 – ALTERNATE NO. 1 – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, following public advertisement, bids for Construction and/or Reconstruction of portions of the former Whitesboro School including a “Fire Alarm System” and “Air Conditioning” were received by the Township of Middle on January 25, 2006 at 10am at the Township Hall, and

WHEREAS, the contract (a.k.a. Contract No. 3) was broken into a base bid assigned to “Installation of Smoke Detectors and Communication Relay” and an Alternate No. 1 assigned to “Design and Installation of an Air-Conditioning System”

WHEREAS, one bid was received for Alternate No. 1, and

WHEREAS, the bid did not meet all of the specifications required for this project, and

WHEREAS, it appears to be in the best interest of the Township to reject the bid.

 

NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle that the bid for Alternate No. 1 (Air Conditioning System towards the Former Whitesboro School) submitted by GE Mechanical shall be and is hereby rejected.

 

  1. RESOLUTION NO. 111-06 – RELEASE OF TRUST ACCOUNTS – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, certain monies held in Trust Accounts from time to time may have balances remaining after all fees have been paid, and

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that upon request of the Zoning Officer the following balances in the Trust Account as listed on the attached sheets shall be released.

 

  1. RESOLUTION NO. 112-06 – NEW JERSEY DEPARTMENT OF COMMUNITY AFFAIRS – SAGE – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, The Department of Community Affairs has recently implemented a grant administration system call SAGE (System for Administrating Grants Electronically).  SAGE gives the Township the ability to apply for many DCA grants, process payments and track grants/loans from the beginning of the application process through to the last payment.  Only authorized individuals will be eligible to gain access to SAGE, and

WHEREAS, the Township of Middle does hereby wish to participate in the SAGE program available through the DCA.

NOW THEREFORE BE IT RESOLVED, by the Township Committee, of the Township of Middle, County of Cape May, State of New Jersey, that authorization is hereby granted to participate in said program.

BE IT FURTHER RESOLVED that the following individuals are hereby authorized to have access to SAGE:

  1. RESOLUTION NO. 113-06 – AUTHORIZE APPLICATION – CONTINUATION FUNDING FOR SAFE AND SECURE COMMUNITIES PROGRAM – GRANT P-3388 – On motion by Mayor Doughty seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that approval for the application for the Safe and Secure Communities Program (Grant P-3388), in the amount of $60,000.00,be and is hereby approved.

FURTHER RESOLVED, that Police Chief Joseph Evangelista is named as the Contact Person and that the appropriate officials are hereby authorized to sign said documents.

 

  1. RESOLUTION NO. 114-06 – APPOINTMENT – RECREATION ADVISORY COUNCIL – On motion by Committeemember DeLanzo seconded by                    and passed on roll call, the following resolution was adopted.

  1. RESOLUTION NO. 115-06 – AUTHORIZING THE STATE OF NEW JERSEY TO ENFORCE THE ELEVATOR SUB CODE – On motion by Committeemember DeLanzo           seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.             

WHEREAS, the Township of Middle no longer finds it feasible to enforce the Elevator Sub Code, and

WHEREAS, the Township of Middle shall and hereby gives the State of New Jersey Elevator Safety Unit jurisdiction as of March 6, 2006 to enforce the Elevator Sub Code, and

WHEREAS, the elevator inspection cycles are October and April of each year.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, New Jersey, that as of March 6, 2006 the Elevator Sub Code Official will no longer enforce the Elevator Sub Code.

 

  1. ACKNOWLEDGING RECEIPT OF AWARDS – ATLANTIC COUNTY MUNICIPAL JOINT INSURANCE FUND- The Township of Middle is in receipt of two (2) awards and has earned $1500.00 as a result of outstanding performance in the 2005 ACM JIF Safety Program.

 

  1. RESOLUTION NO. 116-06 – ACKNOWLEDGEMENT OF RESIGNATION – On motion by Committeemember DeLanzo seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.
