I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember Leusner, Committeemember DeLanzo, Clerk/Administrator James Alexis, Deputy Clerk Kimberly Tomkinson, Attorney Pickering, and Engineer Orlando.

  1. RESOLUTION NO. 138-06 AND PRESENTATION OF PLAQUE – NAMING THE ROBERT “OCKIE” WISTING FORT APACHE RECREATIONAL COMPLEX – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Township of Middle wishes to honor the contributions to the Rio Grande section of the Township of Middle, by Robert “Ockie” Wisting; and

WHEREAS, Ockie distinguished himself by over 51 years of volunteer service to the residents and visitors of Rio Grande; and

WHEREAS, Ockie responded to more than 3600 emergency calls, including responding to a call the day before he passed away; and

WHEREAS, Ockie shall be ever remembered for his caring and nurturing of many, many, many young men and women participating in the Rio Grande Volunteer Fire Company, where he freely gave of his experience in life by training and giving guidance to the young participants; and

WHEREAS, Ockie distinguished himself with his uncanny ability to be innovative with his career as a welder and developing a tool nicknamed the “Ockie Nozzle”; and

WHEREAS, the Township Committee of the Township of Middle directs that the Fort Apache Recreation Complex be forever known as the “Robert  Ockie” Wisting Fort Apache Recreation Complex.”

NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that the Fort Apache Recreation Complex is hereby renamed to be “Robert “Ockie” Wisting Fort Apache Recreation Complex.”

  1. RESOLUTION NO. 139-06 – SOCIAL AFFAIRS PERMIT – BURDETTE TOMLIN MEMORIAL HOSPITAL AUXILIARY – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, Burdette Tomlin Memorial Hospital Auxiliary has applied for approval to sell alcoholic beverages at a Volunteer Awards TEA to be held at Wildwood Golf Club, 1170 Golf Club Road, Cape May Court House, on April 21, 2005 from 11:30 am to 4:00 pm, and

WHEREAS, they have provided proper documentation to the Township of Middle,

NOW, THEREFORE BE IT RESOLVED, that the Township Committee, in the Township of Middle, does hereby approve the Social Affairs Permit.

 

  1. RESOLUTION NO. 140-06 – COOPERATIVE PAPER SHREDDING DAY – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Township of Middle and the Cape May County Municipal Utilities Authority have for many, many years participated in various recycling activities; and

WHEREAS, it is advantageous for the residents of Middle Township to have access to proper recycling of documents; and

WHEREAS, the Cape May County MUA has offered to the Township of Middle, the paper shredding event, which shall be scheduled for April 29, 2006 from 9:00 AM to 12:00 Noon; and

WHEREAS, the Township of Middle wishes to fully cooperate with the County of Cape May in jointly providing this service to its residents; and

 

WHEREAS, the paper shredding event shall take place on Saturday morning, April 29, 2006 in the municipal parking lot off of Boyd Street in Cape May Court House;

NOW, THEREFORE BE IT RESOLVED that the governing body of the Township of Middle, County of Cape May, State of New Jersey, approve the cooperative paper shredding event, and shall restrict accessibility to the municipal parking lot on Saturday, April 29, 2006 between 9:00 AM and 12:00 Noon, for those individuals who wish to take advantage of the accessibility of privately having their documents shredded.

ORDINANCE NO. 1218-06 – AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 229, ENTITLED TOWING - On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, Ordinance No 1218-06 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/17/2006 at 6:00 p.m.

ORDINANCE NO. 1219-06 – AN ORDINANCE OF THE TOWNSHIP OF MIDDLE, COUNTY OF CAPE MAY AND STATE OF NEW JERSEY TO AMEND CHAPTER 46 OF THE TOWNSHIP CODE REGARDING THE ORGANIZATION AND ESTABLISHMENT OF THE POLICE DEPARTMENT – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, Ordinance No 1219-06 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/17/2006 at 6:00 p.m.

 

  1. RESOLUTION NO. 141-06 – APPROVING MINUTES FOR PREVIOUS MEETING – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the minutes from the Township Committee meeting held March 6, 2006 are hereby approved.

BE IT RESOLVED by the Township Committee of the Township of Middle the governing body thereof, that the Agreement between Employee Care and the Township of Middle for the Employee Assistance Program effective April 1, 2006 through March 31, 2007, be and is hereby ratified.

FURTHER RESOLVED, that the appropriate officials are hereby authorized and directed to sign said agreement.

  1. RESOLUTION NO. 150-06– TABULATION COMMITTEE – COMMUNICATION TOWER – PUBLIC WORKS YARD – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Township of Middle has solicited for bids on November 7, 2006 via Resolution No. 592-05, and later rejected via Resolution No. 87-06,and

WHEREAS, the Township once again solicited for bids on February 6, 2006 via Resolution No. 75-06 to accept bids on March 7, 2006. No bids where received on such a date therefore constituting the rebid of said project.

BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey that Clerk/ Administrator James Alexis, Deputy Clerk Kimberly Tomkinson, and a representative from the Finance Office, be and hereby are appointed to tabulate the bids to be taken on April 20, 2006 at 10:00 a.m. in the Middle Township Municipal Building, 33 Mechanic Street, Cape May Court House, NJ for the following:

  1. RESOLUTION NO. 152-06 – URGING RE-INTRODUCTION OF LEGISLATION TO EXEMPT MUNICIPAL CLERKS FROM PENALTIES FOR OPEN PUBLIC RECORDS ACT VIOLATIONS UNDER CERTAIN CIRCUMSTANCES – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, A-4063 was introduced during the 2004-2005 legislative session and failed to be enacted and has subsequently died; and

                                    WHEREAS, A-4063 exempts the municipal clerk from penalties for Open Public Records Act violations under certain circumstances; and

                                    WHEREAS, currently under the Open Public Records Act, (OPRA) the municipal clerk is held responsible for not fulfilling the request, even when the record is in the possession of another official; and

                                    WHEREAS, the proposed legislation would exempt the municipal clerk if it can be proven that a municipal clerk has exercised due diligence in attempting to collect a record requested under OPRA, by documenting at least two attempts to collect the records within seven days of receiving the request; and

                                    WHEREAS, the municipal official in actual possession of the record will be deemed to be the custodian of the requested record, and therefore liable for any violations, penalties or disciplinary proceedings that may result from an unreasonable denial of access to the requested record; and

                                    WHEREAS, it is the belief of the Township Committee that the official in possession of the requested record should be the one responsible for violations of the Open Public Records Act and considered custodian of the record; and

                                    WHEREAS, the Township Committee of the Township of Middle, urges the State Assembly to re-introduce the amendments to the Open Public Records Act as proposed in A-4063; and

                                    WHEREAS, the Township Committee also urges the State Senate to join the Assembly with companion legislation that would similarly amend the Open Public Records Act.

NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, as follows:

1. That the Township of Middle, Township Committee supports the intent and provisions of the proposed amendments to the Open Public Records Act.

2. That the Township of Middle, Township Committee urges the re- introduction of this legislation during the next legislative session.

3. That the Township of Middle, Township Committee urges  the State Senate to join the Assembly with companion legislation.

  1. RESOLUTION NO. 153-06 – REDUCTION OF PERFORMANCE BOND – TOMPKINS BUILDERS – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

WHEREAS, $129,939.94 is being held as a performance guarantee of Tompkins Builders for site improvements at Block 132.01, Lot 8, and

WHEREAS, the Engineer has conducted his inspection and determined that improvements having a value of $63,365.28 have been completed, and

WHEREAS, the Zoning Official has recommended that the performance guarantee for the above stated project be reduced to $66,574.66.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the NJ Administrative Code Standardized Performance Guarantee, No. 5013649, with Bond Safeguard Insurance Co. be and is hereby reduced to $66,574.66

 

  1. RESOLUTION NO. 154-06 – REAFFIRMING THE TOWNSHIP OF MIDDLE’S OPPOSITION TO THE DISCHARGE OF TREATED NERVE AGENT VX INTO THE DELAWARE RIVER – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Township Committee of the Township of Middle of Cape May County (hereinafter “Committee”) adopted a resolution regarding its opposition to any discharge of VX Nerve Agent Waste Disposal into the Delaware Rive by the DuPont Company, and

WHEREAS, Resolution No. 378-04, adopted June 21, 2004, supported prohibited the discharge of treated nerve agent VX from Dupont’s treatment facility in Salem County, New Jersey into the Delaware River in order to preserve our resources and environment from pollution and contamination, and

WHEREAS, recent news reports indicate the Environmental Protection Agency (hereinafter “EPA”) has dropped its opposition to a plan to transfer the VX Nerve Agent by-product to Salem, New Jersey for treatment and disposal into the Delaware River, and

WHEREAS, the Committee steadfastly opposes the importation of the VX by-product into the State of New Jersey and its proposed discharge into the Delaware River.

NOW THEREFORE BE IT RESOLVED, by the Township Committee, of the Township of Middle, County of Cape May, New Jersey, as follows:

1.       All of the above recitals are incorporated herein by reference as if repeated in length.

2.       The Committee reaffirms its position of the imposition of a moratorium on any discharge of VX Nerve Agent Waste into the Delaware River.

3.       The Committee reaffirms its position that NJDEP not grant any permits for the treatment and disposal of VX Nerve Agent into the Delaware River.

4.       The Committee requests New Jersey Governor Jon Corzine and Delaware Governor Ruth Minner to oppose any discharge of VX Nerve Agent Waste in the Delaware River.

5.       The Committee of the Township of Middle of the County of Cape May shall send a copy of tis Resolution to New Jersey Governor Jon Corzine; Delaware Governor Ruth Ann Minner; NJDEP Commissioner Lisa P. Jackson; United States Senator Frank R. Lautenberg; Unites States Senator Robert Menendez; and United States Congressman Frank A. LoBiondo requesting their support for opposing the importation and discharge of VX Nerve Agent into the Delaware River

 

  1. RESOLUTION NO. 155-06 – CLOSED SESSION – CONTRACT NEGOTIATION AND MATTERS OF PENDING LITIGATION – On motion by Committeemember Leusner       seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the section of the Open Public Meetings Law, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Township Committee of the Township of Middle, the governing body thereof, is of the opinion that such circumstances presently exist,

NOW THEREFORE BE IT RESOLVED, by the Township of Middle, County of Cape May, State of New Jersey:

1.) The public shall be excluded from the discussion of an action upon the hereinafter specified matter: CONTRACT NEGOTIATION AND MATTERS OF PENDING LITIGATION

2.) The general nature of the subject matter to be discussed is as follows: CONTRACT NEGOTIATION AND MATTERS OF PENDING LITIGATION

3.) It is anticipated at this time the above subject matter will be made public as follows:

4.)   This Resolution shall take effect immediately.

 

  1. RESOLUTION NO. 156-06 – AUTHORIZING APPLICATION TO THE CAPE MAY COUNTY 2006 MUNICIPAL PUBLIC IMPROVEMENTS JOINT VENTURE PROGRAM FOR THE BIKE PATH EXTENSION – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted

WHEREAS, in 2006, The County of Cape May will make funds available to municipal governments in the County of Cape May through the “2006 Municipal Public Improvements Joint Venture Program”, and

WHEREAS, a Cape May County Bond Ordinance has made a total of $3,800,000.00 in funds available for the purpose of funding the Joint Venture Program in 2006, and

WHEREAS, the purpose of the Joint Venture program is to provide funding to support municipal recreation projects in order to enhance the recreation opportunities for area residents and visitors by providing a variety of high quality, accessible facilities throughout Cape May County, and

WHEREAS, the County of Cape May has developed a set of programmatic parameters and associates documents that will govern the implementation of the program, and

WHEREAS, the municipality desires to pursue funds from the Joint Venture program for the purpose of a Bike Path Extension, and

WHEREAS, the municipality hereby agrees to provide for the proper long-term maintenance of any project funded by the 2006 Municipal Improvements Joint Venture Program.

NOW THEREFORE BE IT RESOLVED, that the Township of Middle does hereby authorize the application for such a grant; and, upon receipt of the Interlocal Agreement from the County of Cape May, does further authorize the execution of the grant agreement.

BE IT FURTHER RESOLVED, that the persons whose names, titles, and signatures appear below are authorized to sign the application, and that they or their successors in said titles are authorized to sign the agreement, and any other documents necessary in connection therewith.

RESOLUTION NO. 157-06 – ESTABLISHING: 1.   FAIR AND OPEN PROCESS FOR CONTRACTS 2.  CRITERIA TO BE CONSIDERED IN AWARDING CONTRACTS; AND 3.  POSITIONS FOR WHICH PROPOSALS SHALL BE SOLICITED (BOND COUNCIL AND CONFLICT ENGINEER) – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Township Committee has previously this year established a Fair and Open Process by which the Township requests proposals and qualifications, and considers and awards contracts; and

WHEREAS, in addition to the positions previously made subject to the Fair and Open Process,  the Township Committee desires to add certain positions to those subject to the Process; and

NOW THEREFORE BE IT RESOLVED,  by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that:

1.  THE FAIR AND OPEN PROCESS

A.  The Township Committee of the Township of Middle has determined that the following procedure constitutes a fair and open process and shall be the manner in which requests for proposals and qualifications are sought, accepted, and awarded:

1.                A request for proposals and qualifications shall be publicly advertised on the Township of Middle’s internet website beginning on March 22, 2006 and continuing on the website through March 23, 2006;

2.                The Township shall accept proposals until 12:00 noon on April 7, 2006.

3.                Proposals shall be in a sealed envelope addressed to:

The envelope shall also state the name of the person or entity submitting the proposal and the position for which the proposal is submitted.

B.                Scope of Services proposed to be provided

6.                On April 7, 2006 at 12:00 noon , James Alexis shall open each of the proposals and shall announce the proposals received by name, and a short summary of the proposal and qualifications.

7.                The proposals shall be submitted to Township Committee for consideration at its meeting on April 17, 2006 at 6:00 pm at which time Township Committee may award a contract by approving a resolution, or, it may choose to award at the next regularly scheduled Township Committee meeting.  If a majority votes to seek interviews, interviews may be held between Township Committee and the person or entity that submitted proposals.  Township Committee may send proposals to Township Board’s or Agency’s for consideration and approval as is appropriate.

2.    CRITERIA BY WHICH REQUESTS FOR PROPOSALS AND QUALIFICATIONS SHALL BE EVALUATED

A.    The Township of Middle hereby discloses in writing that all of the submissions in response to the Request for Proposals and Qualifications submitted through the fair and open process described above, will be evaluated by the Township Committee of the Township of Middle and awarded or rejected on the basis of the following criteria.  Proposals will be evaluated by the Township Committee of the Township of Middle on the basis of the most advantageous, price and other factors considered.  The evaluation will consider:

1.    Experience and reputation in the field

2.    Knowledge of the Township of Middle and the subject matter to be addressed under the contact

3.    Availability to accommodate any required meetings of the agency

4.    Compensation proposal

5.    Other factors if demonstrated to be in the best interest of the Township of Middle

B.    The following criteria, found under the competitive contracting rules at N.J.A.C. 5:34-4.2, if determined to be of assistance, may also be considered by Township Committee.  These criteria are not intended to be limiting or all-inclusive, and they may be adapted or supplemented in order to meet the Township Committee’s needs.  No criteria will unfairly or illegally discriminate or exclude otherwise capable vendors.

 

I.     Technical criteria:

a.    Proposed methodology:

i.     Does the vendor’s proposal demonstrate a clear understanding of the scope of work and related objectives?

ii.     Is the vendor’s proposal complete and responsive to the specific RFP requirements?

iii.    Has the past performance of the vendor’s proposed methodology been documented?

iv.    Does the vendor’s proposal use innovative technology and techniques?

v.     Are sound environmental practices such as recycling, energy efficiency, and waste reduction used?

II.     Management criteria:

a.    Project management:

i.     How well does the proposed scheduling timeline meet the agency’s needs?

ii.     Is there a project management plan?

b.    History and experience in performing the work:

i.     Does the vendor document a record of reliability of  timely delivery and on-time and on-budget implementation?

ii.     Does the vendor demonstrate a track record of service as evidenced by on-time, on-budget, and contract compliance performance?

iii.    Does the vendor document industry or program experience?

iv.    Does the vendor have a record of moral integrity?

c.    Availability of personnel, facilities, equipment and other resources:

i.     To what extent does the vendor rely on in-house resources vs. contracted resources?

ii.     Are the availability of in-house and contract resources documented?

d.    Qualification and experience of personnel:

i.     Documentation of experience in performing  similar work by employees and when appropriate, sub-contractors?

ii.     Does the vendor make use of business capabilities or initiatives that involve women, the disadvantaged, small and/or minority owned business establishments?

iii.    Does the vendor demonstrate cultural sensitivity in hiring and training staff?

 

III.    Cost criteria:

a.    Cost of goods to be provided or services to be performed:

i.     Relative cost:  How does the cost compare to other similar  proposals?

ii.     Full explanation:  Is the price and its component charges, fees, etc., adequately explained or documented?
