This Special Meeting was called pursuant to the provisions of the Open Public Meeting Law. Notices of this meeting were emailed to the Cape May County Gazette, Atlantic City Press and the Cape May County Herald on August 29, 2006. In addition, copies of notices were posted on the bulletin board in the Municipal Building and filed in the office of the Municipal Clerk on aforementioned date. Notices on the bulletin board have remained continuously posted.  Members present were Mayor Doughty, Committeemember Leusner, Committeemember DeLanzo, Clerk/ Business Administrator Alexis, Solicitor Pickering, & Deputy Clerk Kimberly Tomkinson.

 

  1. RESOLUTION NO. 439-06 – APPROVING PAYMENT FOR ALL BILLS – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for the following bills in the amounts indicated are hereby approved:

                                    Dedicated Trust             $   6,027.88      

                                    Current Acct.                             $   597,280.69

 

  1. RESOLUTION NO. 440-06 – TABULATION COMMITTEE – CONSTRUCTION AND/OR RECONSTRUCTION OF PORTIONS OF THE FORMER WHITESBORO SCHOOL / HEADSTART BUILDING – CONTRACT NO. 4 – On motion by Mayor Doughty seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey that Township Clerk/Administrator James Alexis, Deputy Township Clerk Kimberly Tomkinson, Chief Finance Officer Tracey DeVico, and a representative of Marino & Irick be and hereby are appointed to tabulate the bids to be taken on November 15, 2006 at 10:00 a.m. in the Middle Township Municipal Building, Conference Room, 33 Mechanic Street, Cape May Court House, NJ for the following:

CONSTRUCTION AND/OR RECONSTRUCTION OF PORTIONS OF THE FORMER WHITESBORO SCHOOL / HEADSTART BUILDING

CONTRACT NO. 4

LEAD ABATEMENT AND WINDOW REPLACEMENT

 

  1. RESOLUTION NO. 441-06 – TABULATION COMMITTEE – CONTRACT #2006-1, 2006-2, 2006-3 – HOME REHABILITATION OF 3 HOMES IN MIDDLE TOWNSHIP – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey that Township Clerk James Alexis, Chief Finance Officer Tracey DeVico, and Jill Zarharchuck be and hereby are appointed to tabulate the bids to be taken on September 14, 2006 at 1:00p.m. in the Middle Township Municipal Building, 33 Mechanic Street, Cape May Court House, NJ for the following:

CONTRACT #2006-1, 2006-2 AND 2006-3 - HOME REHABILITATION OF 3 HOMES IN MIDDLE TOWNSHIP 

 

  1. RESOLUTION NO. 442-06 – AUTHORIZING MAYOR TO SIGN NJDOT FORMS – US RTE 9 AND MAIN DRIVE (GRANDE VILLAGE) – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Mayor F. Nathan Doughty be and hereby is authorized to sign the required NJDOT Major Access Permit in connection with the Permit No. S-9-S-0003-2005.

FURTHER RESOLVED, that said permit does not call for a traffic signal.

 

  1. RESOLUTION NO. 443-06 – AUTHORIZING MAYOR TO SIGN NJDOT FORMS – US RTE 9 AND SATT BLVD. – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Mayor F. Nathan Doughty be and hereby is authorized to sign the required NJDOT Major Access Permit in connection with the Permit No. S-9-S-0008-2005

FURTHER RESOLVED, that said permit does not call for a traffic signal.

 

  1. RESOLUTION NO. 444-06 – RELEASE OF PERFORMANCE BOND – STREET OPENING – L & M DEVELOPMENT – On motion by Committeemember Leusner seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, $5,000.00 is being held as a performance guarantee for L & M Development / Marv Austin for the street opening located at 101 Rutledge, and

WHEREAS, certified Public Works Manager has conducted his inspection and determined that all improvements have been completed, and

WHEREAS, it has been recommended that the performance guarantee for the above stated project be released.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the $5,000.00, be and is hereby released.

 

  1. RESOLUTION NO. 445-06 – CLOSED SESSION – POTENTIAL LITIGATION AND CONTRACT NEGOTIATION – On motion by Committeemember DeLanzo seconded by Committeemember Leusner and passed on roll call, the following resolution was adopted.

WHEREAS, the section of the Open Public Meetings Law, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Township Committee of the Township of Middle, the governing body thereof, is of the opinion that such circumstances presently exist,

NOW THEREFORE BE IT RESOLVED, by the Township of Middle, County of Cape May, State of New Jersey:

1.) The public shall be excluded from the discussion of an action upon the hereinafter specified matter: POTENTIAL LITIGATION AND CONTRACT NEGOTIATION

2.) The general nature of the subject matter to be discussed is as follows: POTENTIAL LITIGATION AND CONTRACT NEGOTIATION

3.) It is anticipated at this time the above subject matter will be made public as follows:

3.)   This Resolution shall take effect immediately.
