I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).

The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building.  Members present were Mayor Doughty, Committeemember DeLanzo, Committeemember Barry, Township Clerk James Alexis, Deputy Clerk Kimberly Tomkinson, Deputy Clerk Dawn Stimmel, Attorney Pickering, and Engineer Orlando.

 

  1. RESOLUTION NO. 123-07 – APPOINTMENT – NEW HIRE - POLICE DEPARTMENT– On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey, that the following employee is hereby appointed to the following position at the salary opposite their name:

  1. RESOLUTION NO. 124-07 – APPROVING PAYMENT FOR ALL BILLS – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for the following bills in the amounts indicated are hereby approved:

  1. RESOLUTION NO. 125-07– APPROVING MINUTES FOR PREVIOUS MEETING – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the minutes from the Township Committee meeting held March 19, 2007 are hereby approved.

ORDINANCE NO. 1256-07 – ESTABLISHING THE COMPENSATION OF THE OFFICERS AND EMPLOYEES OF THE TOWNSHIP OF MIDDLE - On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, Ordinance No 1256-07 passed first reading. Second reading, public hearing and consideration for adoption will be held on 04/16/2007 at 6:00 p.m.

 

  1. RESOLUTION NO. 126-07 – PROMOTIONAL TITLE CHANGE – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

  1. RESOLUTION NO. 128-07 – ACKNOWLEDGEMENT OF TERMINATION – On motion by Committeemember DeLanzo seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

  1. RESOLUTION NO. 129-07 – RELEASE OF TRUST ACCOUNTS – On motion by Committeemember Barry seconded by Mayor Doughty and passed on roll call, the following resolution was adopted.

WHEREAS, certain monies held in Trust Accounts from time to time may have balances remaining after all fees have been paid, and

WHEREAS, the applicants are entitled to a refund of this money,

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that upon request of the Zoning Officer the following balances in the Trust Accounts as listed on the attached sheets shall be released.

 

  1. RESOLUTION NO. 130-07 – RELEASE OF PERFORMANCE BOND – STREET OPENING – JAMES BARTLESON – On motion by Committeemember Barry seconded by Mayor Doughty                    and passed on roll call, the following resolution was adopted.

WHEREAS, $5,000.00 is being held as a performance guarantee for James Bartleson / Marv Austin for the street opening located at 18 Lafayette, Del Haven, and

WHEREAS, certified Public Works Manager has conducted his inspection and determined that all improvements have been completed, and

WHEREAS, it has been recommended that the performance guarantee for the above stated project be released.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the $5,000.00, be and is hereby released.

 

  1. RESOLUTION NO. 131-07 – AUTHORIZING MAYOR TO SIGN TREATMENT WORKS APPLICATION – EFFLUENT REUSE PROJECT – On motion by Committeemember Barry           seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the Statements of Consent by Governing Body and Certification by Wastewater Conveyance System Owner are a portion of the documents that this resolution authorizes the mayor to sign on behalf of the governing body of the Township of Middle.

THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the mayor is hereby authorized to sign treatment works application for the Cape May County Effluent Reuse Project for Crest Haven Complex, County Park/Zoo, County College and Davies Complex.

 

  1. RESOLUTION NO. 132-07 – PERSON TO PERSON TRANSFER OF CAMPGROUND LICENSE NO. 11 – SEA PINES CAMPGROUND (OUTDOOR WORLD) – On motion by Mayor Doughty  seconded by Committeemember Barry and passed on roll call, the following resolution was adopted. Sharon Stokes and Done Delaplane represented Outdoor World.

WHEREAS, Outdoor World Corporation is the holder in good standing of Campground License # 11, Sea Pines Campground, located on Block 12.01, Lot 2, also known as 1533 Rte 9 North, Swainton, and

WHEREAS, Outdoor World Corp. has made application to transfer said license to Outdoor World Resorts, LLC., and

WHEREAS, all legal requirements for said transfer have been fulfilled.

NOW THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that Campground License # 11 be and hereby is transferred from Outdoor World Corporation to Outdoor World Resorts LLC.

 

  1. RESOLUTION NO. 133-07 – APPROVAL OF ADDITIONAL VEHICLES – TOWING LICENSES (ITEMS A THROUGH B) – On motion by Mayor Doughty seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

133-07(A) WHEREAS, the following Company has applied to the Township of Middle for a license to operate a Towing Vehicle within the confines of the Township of Middle,

WHEREAS, the company now wishes to add an additional vehicle under said license, and

WHEREAS, this company is in good standing with the Township of Middle and has followed all of the rules and regulations as set forth.

  1. RESOLUTION NO. 134-07 – JOINT APPLICATION – CAPE MAY COUNTY AND TOWNSHIP OF MIDDLE – On motion by Committeemember Barry seconded by Committeemember DeLanzo and passed on roll call, the following resolution was adopted.

WHEREAS, the opportunity has presented itself for the County of Cape May and the Township of Middle to submit an application to the New Jersey Division of Archives and Records Management for a Public Archives and Records Infrastructure Support Grants Program Funding, commonly referred to as PARIS Grant; and

WHEREAS, the Township of Middle, being the county seat of the County of Cape May has previously submitted an application for an Inventory Needs Assessment and Strategic Plan; and

WHEREAS, it is important in the preservation of records to provide additional backup of documents and recovery of same; and

WHEREAS, the County of Cape May has previously installed a fiber-optic cable to the Township of Middle municipal building; and

WHEREAS,  it is in the best interest of the Township of Middle to provide additional protection of its electronic records by cooperating with the County of Cape May to provide additional electronic backup and recovery of records; and

WHEREAS,  the application being submitted by Cape May County will contain supporting information to include the $50,000 grant opportunity available to the Township of Middle, application is due March 23, 2007; so

NOW THEREFORE BE IT RESOLVED, by the Governing Body of the Township of Middle, County of Cape May, State of New Jersey, that the Township Committee hereby authorizes the County of Cape May to submit an application on behalf of the Township of Middle a PARIS Grant Application up to $50,000 in associated cost for the electronic backup and recovery of Middle Township records.

 

  1. RESOLUTION NO. 135-07 – EMERGENCY TEMPORARY BUDGET AMENDMENT – On motion by Mayor Doughty seconded by Committeemember Barry and passed on roll call, the following resolution was adopted.

WHEREAS, an emergent condition has arisen and no adequate provision has been made in the 2007 temporary appropriations for the aforesaid purpose; and NJSA 40A:4-20 provides for the creation of an emergency appropriation for the purpose above mentioned, and

WHEREAS, the total emergency temporary resolutions adopted pursuant to the provisions of Chapter 96 PL 1951 (NJSA 40A:4-20) including this resolution total  $2,491,842.72.

NOW THEREFORE BE IT RESOLVED (not less than two-thirds of all members thereof affirmatively concurring) that in accordance with NJSA 40A:4-20

  1. An emergency temporary appropriation be and the same is hereby made in the amount of  $1,626,342.72 That said emergency temporary appropriation shall be provided for in the 2007 budget under the title of:
