WHEREAS, Atlantic Cape Community College Foundation has applied for approval to sell alcoholic beverages at an affair to be held at college campus, 341 CH SO Dennisville Rd, on October 19, 2007 from 6 pm to 9:00 pm, and
WHEREAS, they have provided
proper documentation to the

that the Township Committee, in the

place where an Agricultural Fair and Exhibition organized for the purpose of
holding Agricultural Fairs and Exhibitions which is approved by the State
Department of Agriculture, and

proper applications have been made to the

Cape May and State of New Jersey that the Amusement Games applicant is hereby
licensed by the Township of Middle pursuant to the "Amusement Games
Licensing Law" for the games mentioned in said applications for the period
of July 19, 2007 through July 21, 2007 at the Cape May County 4-H Fairgrounds, Dennisville Rd. Cape May Court House, NJ.

WHEREAS, the Township of Middle has an agreement with Atlantic City Electric to utilize a portion of their property known as Block 10.02 Lot 1, for ingress and egress only, and
WHEREAS, the term of this License Agreement shall be for a period of one (1) year commencing June 1, 2007 and terminating May 31, 2008, and from year to year thereafter as long as mutually agreeable unless terminated under terms as provided in said agreement, and
WHEREAS, the Township agrees to pay Atlantic City Electric one hundred ($103.00) dollars annually for the use of said premise and shall be due on the first day of June during the original term of this License and any renewal term thereafter.
NOW THEREFORE BE IT RESOLVED, by

WHEREAS, DELCO, LLC has previously received the Department of Transportation Permit to develop highway accesses in the Rio Grande section of Middle Township; and
WHEREAS, the

WHEREAS, the original approvals by the Department of Transportation for Grande Properties, in reference to New York Avenue restricted the traffic flow in a one way direction; and
WHEREAS, experience is providing the reasons why it is advantageous to have New York Avenue sustain 2 way traffic in and out of Grande Center Properties; and
WHEREAS, the Township of Middle is authorizing the Municipal Engineer, Vincent Orlando, and the Municipal Solicitor, James Pickering, to prepare an amended application to the Department of Transportation seeking approval to provide 2 way traffic from Grande Properties to Route 47; so
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Township of Middle, County of Cape May, State of New Jersey that the Municipal Engineer and the Municipal Solicitor prepare the necessary documentation and submit the application to the Department of Transportation to implement 2 way traffic on New York Avenue and Route 47 ingress and egress out of Grande Center Properties.
WHEREAS, N.J.S.A. 19:44A-20.4 et.
seq. requires that contracts with a value exceeding
$17,500 be awarded pursuant to a “fair and open” or “non-fair
and open” process; and
WHEREAS,
the Township Committee feel the best interests of the residents of
Middle Township would be best served by the Township requesting proposals and
qualifications, and considering and awarding contracts by use of a Fair and
Open process; and
WHEREAS, the Township Committee desires to establish the Fair and Open Process; and
WHEREAS, the Township Committee desires to establish the criteria for the consideration of proposals and qualifications, and the award of Contracts submitted in accordance with the Fair and Open Process; and
WHEREAS, the Township Committee desires to establish the positions which for the year 2007 shall be subject to the Fair and Open Process and also where stated below additional criteria for certain position; and
WHEREAS, the Township Committee has decided to go beyond what is required by the state statute and to submit all professional services contracts to the Fair and Open process, even those that are below the $17,500.00 threshold;
NOW THEREFORE BE IT RESOLVED, by the Township Committee of the

6. On June 19, 2007 at 11:00 AM, James Alexis shall open each of the proposals and shall announce the proposals received by name, and a short summary of the proposal and qualifications.

The proposals shall be submitted to Township Committee for consideration at its meeting on July 2, 2007 at 6:00pm at which time Township Committee may award a contract by approving a resolution, or, it may choose to award at the next regularly scheduled Township Committee meeting. If a majority votes to seek interviews, interviews may be held between Township Committee and the person or entity that submitted proposals. Township Committee may send proposals to Township Board’s or Agency’s for consideration and approval as is appropriate.
2. CRITERIA BY WHICH REQUESTS FOR PROPOSALS AND QUALIFICATIONS SHALL BE EVALUATED

No criteria will unfairly or illegally discriminate or exclude otherwise capable vendors.

i. Does the vendor’s proposal demonstrate a clear understanding of the scope of work and related objectives?

v. Are sound environmental practices such as recycling, energy efficiency, and waste reduction used?

i. How well does the proposed scheduling timeline meet the agency’s needs?
ii. Is there a project management plan?
b. History and experience in performing the work:
i. Does the vendor document a record of reliability of timely delivery and on-time and on-budget implementation?
ii. Does the vendor demonstrate a track record of service as evidenced by on-time, on-budget, and contract compliance performance?
iii. Does the vendor document industry or program experience?
iv. Does the vendor have a record of moral integrity?
c. Availability of personnel, facilities, equipment and other resources:
i. To what extent does the vendor rely on in-house resources vs. contracted resources?
ii. Are the availability of in-house and contract resources documented?
d. Qualification and experience of personnel:
i. Documentation of experience in performing similar work by employees and when appropriate, sub-contractors?
ii. Does the vendor make use of business capabilities or initiatives that involve women, the disadvantaged, small and/or minority owned business establishments?
iii. Does the vendor demonstrate cultural sensitivity in hiring and training staff?
III. Cost criteria:
a. Cost of goods to be provided or services to be performed:
i. Relative cost: How does the cost compare to other similar proposals?
ii. Full explanation: Is the price and its component charges, fees, etc., adequately explained or documented?
b. Assurances of performance:
i. If required, are suitable bonds, warranties, or guarantees provided?
ii. Does the proposal include quality control and assurance programs?
c. Vendor’s financial stability and strength:
i. Does the vendor have sufficient financial resources to meet its obligations?

Their members must have the cooperation of all American employers on encouraging employee participation in Guard and Reserve.
NOW THEREFORE BE IT RESOLVED, by

WHEREAS Donald Arndt has the qualifications to substitute for Mr. James performing the duties of Construction Official; and
WHEREAS it is appropriate to name Donald Arndt Acting Construction Office in the absence of Ralph James during the time period of June 8 through June 25, 2007; and
WHEREAS this action is for coverage of the Middle Township Construction Official’s Office during the absence of Ralph James during this time period; so

Sam Kelly stated he does not understand difference between variances going in front of zoning or planning or township committee.
Jim Pickering stated he will give him reading information explaining the differences. He also explained that permitted use goes in front of zoning and non-permitted uses go in front of planning.
Vilma Pombo questioned what happened to the explanations that were usually on the agenda.
Jim Alexis stated that Kimberly Tomkinson was out sick and that was why they were not on there.
Eileen Fausey commented on
Jim Alexis explained that we are sending our Code Enforcement Officer out to take pictures for 2008. The State comes down and does a mass count and then decides where the spraying will take place. No chance for anymore spraying for 2007. The moths peak in June.
Mr. Shermans stated Stone Harbor Manor Civic Association wanted to commend the Committee for passing Resolution 231-07
Mr.
Sherman feels they should amend this to include Bidwell Creek and
Miles Truesdale questioned whether the Township has received funds for this.
Jim Alexis explained that this is the initial survey and it is being done along with Avalon. It is only in the beginning stages.
Miles Truesdale said they would like to help out when the time comes
Miles also questioned several of the resolutions for explanations including payment of bills. Said there was nothing on the agenda to tell what was being paid. Mr. Truesdale was told that there was more info on the agenda on the website. Also explained that to print out the bills being paid would require several pages, not just a couple. Anyone can come up and view them.
Madelyn
Filipski questioned Item #2 on the agenda and wanted to know why we were not using that
money to defray taxes.
Jim Alexis explained that
money was designated for funding the snack stand at the Goshen Davies Complex.
Whenever a grant is given, it must be used for the use it was applied for.
Mayor Doughty explained
that there has been much donated work done on the snack stand and this was
needed in order to keep it up for the many sports activities that take place at
the Goshen Complex.
Madelyn wanted to know
why the committee meetings were not broadcast on TV for people who might want
to know what was going on but were unable to get out to get
to the meetings.
Jim Pickering said he
would check into that.
